SUBJECT: ACCEPTANCE OF FEDERAL AID TOPICS PROJECT - INSTALLATION OF TRAFFIC

RECOMMENDATIONS:
1. Accept the Work.
2. Authorize the City Clerk to file a Notice of Completion.
3. Authorize the City Clerk to release the bonds 35 days after
Notice of Completion has been filed.
DISCUSSION:
The contract for the construction of the subject traffic signals
has been completed to the satisfaction of the Public Works Departm &nt.
The bid price was $141,787:00
Amount of unit price items constructed 141,787.00
Amount of change orders - 144.76
Total contract cost 141;642.24
Amount budgeted in Gas Tax and Contribution Funds: 141,787.00
(Account No. 25- 5607 -056)
Two change orders were issued. Change Order 1 (- $442.00) provided
for a 5 -foot shorter pole at the Bayside Drive - Jamboree Road intersection in
deference to the view homes on top of the bluff. Change Order 2 ($297.24) pro-
vided for additional louvers and hoods at the Placentia Avenue - Superior Avenue
intersection. Due to the skewed intersection the louvers and hoods were
necessary to prevent the motorist from being confused by seeing the cross
street signal lights.
The design engineering was performed by Herman Kimmel and Associates
of Newport Beach.
The contractor is Steiny and Company of Anaheim, California.
The contract date of completion was December 18, 1972. While the
contractor was delayed by the prolonged rainy weather, the signals were all in
operation by December 21, 1972. Acceptance has been delayed pending correction
of minor electronic malfunctions.

RECOMMENDATION:
Adopt a resolution authorizing the Mayor and City Clerk to
execute a reimbursement and right of entry agreement with
The Irvine Company for the subject traffic signal installations.
DISCUSSION:
The City Council Policy Number F -9 covering the financing of Capital
Improvements provides in General Provision No. 3, the following:
"Where private streets or private entrances occur at the
intersection of two arterial streets, the developer will
be required to pay only for the additional signal work re-
quired to signalize his entrance ".
The subject three signal installations each have one private roadway
or entrance belonging to The Irvine Company. The reimbursement agreement pro-
vides for The Irvine Company to pay the following amounts for the signalization
of the private entrances or roadways:

Total 22,455
These amounts are the estimated costs of installing the additional
signal equipment necessary to serve the private leg of the intersections.
The right of entry portion of the agreement allows the City to install,
operate and maintain the traffic signal equipment installed on Irvine Company
property.
The subject three traffic signals are part of the traffic signals
being installed through the Federal Aid TOPICS Program.

RECOMMENDATION:
Adopt a resolution accepting a TOPICS fund assignment from
the County of Orange for the County's share of the subject
installation.
DISCUSSION:
On November 22, 1971 the City Council authorized the execution
of a cooperative agreement with the County of Orange to cover the County's
share of the cost of installing a traffic signal at Placentia Avenue and
Superior Avenue. This signal installation is one of the three signals
presently being installed using TOPICS funds.
The agreement with the County did not provide for an assignment
of County TOPICS funds to the City for a portion of their share of the in-
stallation. On November 7, 1972 the County Board of Supervisors adopted
a resolution assigning $20,700.00 more or less of County funds to the City
for the subject installation.
The State Division of Highways and FHWA require that the City
accept the County's assignment of TOPICS funds by resolution.
Below is a breakdown of the funding of the Placentia Avenue -
Superior Avenue traffic signal.

FOR ITS SHARE OF THE TRAFFIC SIGNAL INSTAL-

AVENUE, CONTRACT No. C -1403
WHEREAS, on November 22, 1971, the City Council
authorized the execution of a cooperative agreement with the
County of Orange to cover the County's share of the cost of
installing a traffic signal at Placentia Avenue and Superior
Avenue; and
WHEREAS, said signal installation is one of three
signals presently being installed using TOPICS funds; and

RECOMMENDATION:

Federal Highway Administration (FHWA).
DISCUSSION:
Four bids for the installation contract were received and opened in the office
of the City Clerk at 11:00 A.M., May 16, 1972.

contract cannot be executed until the FHWA has approved the bids and authorized the
award of the contract. However, the City has been directed to award the contract
subject to the approval of the FHWA.
The traffic signals to be installed on this project are at the following

Kindly accept the following comments on the
proposed traffic signal installation at the
Intersection of Bayside Drive and Jamboree
Road and the bridge approach to Balboa Island
as an expression of sincere personal opinion.
I do not tihink that this particular Installa-
tion is needed. My observation is based on
use of this intersection continually over a
period of more than twenty years, ever since
I purchased the store at 204 Marine Avenue,
Balboa Island.
The signal is not needed because at this
Intersection the "rule of courtesy" has
worked so beautifully. With few exceptions,
each motorist defers to the driver on his
left until one or two have made the crossing,
then he asserts his rights in turn. It seems
to work as smoothly as the shuffling of a deck
of cards.
As you know, signals are costly. Furthermore,
It is very possible that the rigid operation
of a signal at this point will back up the
traffic over the bridge and create a problem.
If I had a vote in this case, it would be
negative.

DISCUSSION:
This project provides for the installation of three traffic signals at

advertise for bids. TOPICS funds will pay for 71.3% of the improvements.
Three eights of the Placentia Avenue - Superior Avenue signal will be
funded by the County of Orange through cooperative financing agreement executed
December 14, 1971,
The engineer's estimate and funding breakdown follows:

The amount remaining in the Gas Tax Fund project account for matching
TOPICS funds is $37,562.89. Additional monies required will be transferred from
funds presently allocated to other Gas Tax projects. A budget amendment will be

the contract documents furnished by the Public Works Depart-
ment. The additional copy of the proposal form is to be
retained by the bidder for his records.
Each bid must be accompanied by cash, certified check or
Bidder's Bond, made payable to the City of Newport Beach,
for an amount equal to at least 10 percent of the amount bid.
The title of the project and the words `SEALED BID" shall
be clearly marked on the outside of the envelope containingi

The City has adopted Standard Special Provisions and

In accordance with the provisions of Article 2, Chapter 1,
Part 7 of the California Labor Code (Sections 1770 at seq.),
the City Council of the City of Newport Beach has ascertained
the general prevailing rate of per diem wages in the locality'
in which the work is to be performed for each craft, classifica-
tions, or type of workman or mechanic needed to execute the
contract and has set forth these items in Resolution No. 9423
adopted May 17, 1971. A copy of said resolution is available
in the office of the City Clerk, All parties to the contract
shall be governed by -all provisions of the- California Labor
Code relating to prevailing wage rates (Sections 1770 -1781
inclusive).

The rate of compensation for any classification not listed
in the schedule, but which may be required to execute the
proposed contract, shall be commensurate and in accord
with the specified rates for similar or comparable classifica-
tions or for those performing similar or comparable duties.
This project will be partially financed with Federal funds
under the TOPICS program.
If there is a difference between the minimum Federal,
State, or City wage rates for similar classifications of labor,
the contractor and his subcontractors shall pay not less than
the highest wage rate.
The improvement contemplated in the performance of this
contract is a TOPICS improvement over which the State of
California shall exercise general supervision; and, the State
of California therefore shall have the right to assume full and
direct control over this contract whenever the State of
California, at its sole discretion, shall determine that its
responsibility to the United States so requires. In such cases,
the State Contract Act will govern.
SPECIAL INSTRUCTIONS TO BIDDERS: Bidders must satisfy
themselves by personal examination of location of the proposed
work and by such other means as they may prefer as to the
actual conditions and requirements of the work, and shall not
at any time after submission of the bid dispute, complain, or
assert that there was any misunderstanding in regard to the
nature or amount of work to be done.

RECOMMENDATION:
Adopt a resolution authorizing the Mayor and City Clerk to execute
the subject agreement with the County of Orange.
DISCUSSION:
The intersection of Placentia Avenue and Superior Avenue is approximately
3/8 in unincorporated county area.
The subject agreement provides for the county to pay for 3/8 of the cost of
the design and installation of a traffic signal at this intersection
It is proposed to include this intersection signalization with the projects
to be funded with TOPICS monies. If the project is approved by the State Division of
Highways and Federal Highway Administration for TOPICS funding the project will be
funded as follows:

THIS AGREEMENT, made and entered into this,,---day
1971, by and between the CITY OF NEWPORT
BEACH, a municipal corporation, hereinafter designated as "City,"
and the COUNTY OF ORANGE, a political subdivision of the State of
California, hereinafter designated as "County;"
W I T N E S S E T H•
WHEREAS, a considerable volume of traffic presently
exists and is progressively increasing at the intersection of
Placentia Avenue and Superior Avenue; and
WHEREAS, City and County have determined that a traffic
signal and highway lighting system at the intersection of Placentia
Avenue and Superior Avenue is warranted; and
WHEREAS, City and County contemplate the installation
of a traffic control signal system and highway lighting at said
intersection which is partially within the boundaries of the City
of Newport Beach and is partially within unincorporated County
area, hereinafter referred to as the "project," and wish to specify
the proportionate share of the costs that are to be borne by City
and County and provide for maintenance following completion of
the project; and
WHEREAS, the provisions of Title 1, Division 7, Chapter 5,
Article 1, of the California Government Code entitled "Joint Powers
Agreements" authorize two or more public agencies to jointly exer-
cise any power common to the contracting parties;

NOW, THEREFORE, IT IS AGREED by the parties hereto as
I. City shall prepare detailed plans, specifications
and cost estimates for the project. The project shall include
the installation of a traffic signal and highway lighting system
at the intersection of Placentia Avenue and Superior Avenue. The
controller at said installation shall be modular solid state type
90 or type 100 with five phases and shall be capable of being ex-
panded to six phases by addition of plug -in solid state modules.
II. City is designated as the agent of County for the
purposes of administering, contracting, and constructing the pub-
lic improvements called for in this agreement and is authorized
by the County to perform all acts necessary or required in order
to construct the improvement in accordance with the plans and
specifications. On completion of the plans, specifications and
cost estimates for the project, City shall transmit the same to
the appropriate County department for approval. After written
approval has been obtained from the County, City shall proceed to
advertise for bids for the project pursuant to the public bid re-
quirements of the City Charter and upon receipt of bids acceptable
to the City, award a contract.
III. Upon completion of the Project, County's share of
the traffic signal and intersection lighting system installation
will be determined in the same ratio to the total cost of such sys-
tem as the number of legs under County jurisdiction entering the
intersection are to the total number of legs entering the inter-
section.
IV. For the purpose of determining the proportionate
share of the traffic signal costs to be borne by the respective
parties hereto, the City limits shall be established as those
existing on the day which City advertises the project for construc-
tion bids.

V. All construction and installation costs shall be
based on the contract costs. The total construction and instal-
lation cost to County is presently estimated to be $15,000.00
and the total construction and installation cost to City is
presently estimated to be $25,000.00 based on the fact that one
and one -half (1 -1/2) legs of the intersection presently lie in
County area and two and one -half .(2 -1/2) legs of the intersection
presently lie in City area.
VI. County's share of design, engineering and inspection
costs shall be based upon a percentage equivalent to the ratio
which County's share of the project construction costs bears to
the total construction costs and shall include a charge not to
exceed fifteen percent (15 %) of County's share of project construc-
tion costs to cover City's overhead cost.
The estimated cost for the entire project is $44,000.00
and the total cost to County is estimated at $16,500.00. The actual
amount of the County's share shall be determined after completion
of the work covered by the construction contract.
VII. Upon completion of the Project, said traffic signal
shall be maintained and operated by City. The maintenance and
operational costs for said traffic signal shall be borne by the
parties hereto in accordance with provisions in the Standard
Traffic Signal Maintenance Agreement No. 169 -310 executed February 18,
1969, by and between the City and the County.
VIII. It is mutually understood and agreed:
(a) That neither County nor any officer or employee
thereof shall be responsible for any damage or liability occurring
by reason of anything done or omitted to be done by City under or
in connection with any work, authority or jurisdiction delegated
to City under this agreement. It is also understood and agreed that
pursuant to Government Code Section 895.4, City shall fully indemnify

and hold County harmless from any liability imposed for injury (as
defined by Government Code Section 810.8) occurring by reason of
anything done or omitted to be done by City under or in connection
with any work,authority or jurisdiction delegated to City under
this agreement.
(b) That neither City nor any officer or employee
thereof is responsible for any damage or liability occurring by
reason of anything done or omitted to be done by County under or
in connection with any work, authority or jurisdiction not dele-
gated to City under this agreement. It is also understood and
agreed that, pursuant to Government Code Section 895.4, County
shall fully indemnify and hold City harmless from any liability
imposed for injury (as defined by Government Code Section 810.8)
occurring by reason of anything done or omitted to be done by
County under or in connection with any work, authority or juris-
diction not delegated to City under this agreement.
IN WITNESS WHEREOF, City has caused this agreement to be
executed by its Mayor and attested by its Clerk and County has
caused this agreement to be executed by the Chairman of its Board
of Supervisors and attested by its Clerk, all thereunto duly autho-
rized by resolution of the City Council and minute order of the
Board of Supervisors, respectively, on the date written opposite
their signatures.

WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and the County of Orange providing for the
installation of a traffic signal at Placentia Avenue and Superior

WHEREAS, the City Council has considered the terms and
conditions of said cooperative agreement and found them to be fair
and equitable;
NOW, THEREFORE, BE IT RESOLVED that said cooperative
agreement above described is approved, and the Mayor and City Clerk
are hereby authorized and directed to execute the same on behalf of
the City of Newport Beach.
