RECOMMENDATIONS:
1. Accept the work.
2. Authorize the City Clerk to file a Notice of Completion.
3. Authorize the City Clerk to release the bonds 35 days after
Notice of Completion has been filed.

The contract for the construction of median paving in Jamboree Road Medians
4 and 5 has been completed to the satisfaction of the Public Works Department.
The lump sum bid was: $8,122.39
Total Contract Cost: 8,122.39
Funds were budgeted in Account Number 18- 3315 -072.
The contractor is Concrete Textures of South Laguna, California.
The contract date of completion was February 27, 1972. The work was completed
on January 20, 1972.

RECOMMENDATION:
Adopt a resolution awarding the contract to Concrete Textures of
South Laguna, California for $8,122.39, and authorizing the Mayor
and the City Clerk to execute the contract.

This project will provide for the construction of decorative paving of a
portion of two traffic islands on Jamboree Road between San Joaquin Hills Road and
a point northerly of the Ford Road - Eastbluff Drive intersection. The paving
would be similar to that recently installed on Jamboree Road northerly of Coast
Highway.
Two bids were received and opened in the office of the City Clerk at
10:00 A.M. on January 4, 1972.

The low bid is 3% less than the engineer's estimate of $8,400.00. Funds
for the project are available in Gas Tax Budget Appropriation 18- 3315 -072.
This project was re- advertised after a rejection of the one bid received
when the project was previously advertised. Rejection was recommended at that time
(December 13, 1971) because the amount of the bid was too high (10% above the engineer's
estimate).
The plans were prepared by the city. The estimated date of completion is
February 29, 1972.

RECOMMENDATION:
December 13, 1971
Reject the bid received, and authorize the City Clerk to readvertise
for bids to be opened at 10:00 A.M. on January 4, 1972.
DISCUSSION:

This project provides for the construction of decorative, textured concrete
paving on portions of two median islands on Jamboree Road between San Joaquin Hills
Road and northerly of the Ford Road - Eastbluff Drive intersection. The paving would
be similar to that recently installed on Jamboree Road northerly of Coast Highway.
One bid, in the amount of $9,250,was received for the work from Donn 0.
Michaels, General Engineering Contractor, of Newport Beach. The bid was 10% more
than the Engineer's estimate of $8,400.
Rejection of the bid and readvertising for new bids are recommended because
it is felt the bid price was too high. The unit costs of the work previously com-
pleted were $1.31 and $1.53 per square foot, as compared to $1.85 per square foot bid
for the present contract. Because of the comparatively high cost of the special
median paving as compared to conventional - concrete median paving, it is felt special
effort should be devoted to obtaining the lowest cost. (Conventional concrete median
island paving is estimated to cost $0.60 to $0.70 per square foot for plain concrete,
and $0.90 to $1.00 per square foot for colored concrete.)
If however, it is decided to proceed with the work at this time the
appropriate action would be to adopt a resolution awarding the contract to Donn 0.
Michaels, General Engineering Contractor, for $9,250 and authorizing the Mayor and
the City Clerk to execute the contract. Sufficient funds for the work have been
appropriated in the Gas Tax Fund under account no. 18- 3315 -072.
The plans were prepared by the city. The estimated date of completion
is February 29, 1972 if the contract is readvertised, or January 28, 1972 if the
contract is awarded at this time.

RECOMMENDATION:
Authorize the City Clerk to readvertise for bids to be opened
at 11:00 A.M., December 7, 1971.
DISCUSSION:
No bids were received by the City Clerk at the scheduled bid opening at
2:00 PAM, October 28, 1971.
One incomplete bid was mailed and received by the Purchasing Agent on
October 28, 1971. This bid was forwarded to and opened by the City Clerk at 2:30 P,M.,
October 28, 1971.
The bid was rejected because it was received late by the City Clerk and
because it was incomplete. The bidder's bond, non - collusion affidavit, designation
of sub - contractor, statement of financial responsibility, and a statement of ability
and experience were not included.
This project provides for the construction of decorative paving of a portion
of two traffic islands on Jamboree Road between San Joaquin Hills Road and northerly of

Bids must be submitted on the proposal form attached with the contract documents furnished
by the Public Works Department. The additional copy of the proposal form is to be
retained by the bidder for his records.
Each bid must be accompanied by cash, certified check or Bidder's Bond, made payable to
the City of Newport Beach, for an amount equal to at least 10 percent of the amount bid.
The title of the project and the words "SEALED BID" shall be clearly marked on the
outside of the envelope containing the bid.
The contract documents that must be completed, executed, and returned in the sealed bid
are:

E. Statement of Financial Responsibility

These documents shall be affixed with the signature and titles of the persons signing

shall be affixed to all documents requiring signatures. In the case of a Partnership,
the signature of at least one general partner is required.
No bids will be accepted from a contractor who has not been licensed in accordance
with the provisions of Chapter 9, Division III of the Business and Professions' Code.
The contractor shall state his license number and classification in the proposal.
Plans and Contract Documents, including Special Provisions, may be obtained at the
Public Works Department, City Hall., Newport Beach,..California, at no cost to licensed
contractors. A non - refundable charge of $2.00 will be required for each set of Plans
and Contract Documents issued to others. It is requested that the Plans and Contract
Documents be returned within 2 weeks after the bid opening.
The City has adopted the Standard Specifications for Public Works Construction (1970
Edition and Supplements) as prepared by the Southern California Chapters of the American
Public Works Association and the Associated General Contractors of America. Copies
may be obtained from Building News, Inc., 3055 Overland Avenue., Los Angeles, California.

The City has adopted Standard Special Provisions and Standard Drawings. Copies of these
are available at the Public Works Department at a cost of $2.00 per set.

ascertained the general prevailing rate of per diem wages in the locality in which the

needed to execute the contract and has set forth these items in Resolution No. 6982,
adopted May 12, 1969. A copy of said resolution is available in the office of the

6. The Contractor shall assume the defense of and indemnify and save harmless the
City, the Director of Public Works, and their officers and employees, from all claims,
loss, damage, injury, and liability of every kind, nature, and description, directly or
indirectTy arising from the performance of the contract or work, regardless of responsi-
bility for negligence; and from any and all claims, loss, damage; injury, and liability,
howsoever the same may be caused, resulting directly or indirectly from the nature of

FOR THE
JAMBOREE ROAD MEDIAN PAVING, ISLANDS 4 AND 5 NORTHERLY OF
SAN JOAQUIN HILLS ROAD
CONTRACT NUMBER 1406
I. SCOPE OF WORK
The work to be done under this contract consists of constructing
Portland cement concrete median paving, including supplemental
items on Jamboree Road Islands 4 and 5 northerly from San Joaquin
Hills Road to Ford Road. The contract requires completion of all
the work in accordance with these Special Provisions, the City's
Standard Special Provisions, the Plan (P- 5044S), and the City's
Standard Drawings and Specifications. The City's Standard Specifications
are the Standard Specifications for Public Works Construction (1970
Edition).
II. CO�iiPLEfION OF WORK
The Contractor must complete all work on the contract within 30
calendar days after execution of the contract by the City.
III. TRAFFIC CONTROL
Traffic on Jamboree Road may be restricted to one 12 -foot wide lane in
each direction beUreen 8:30 a.m. and 3:30 p.m., bfonday through Friday,
during construction, except Veterans Day October 25, Thanksgiving Day
November 25, 1971, Christmas Eve December 24, 1971, and New Years Eve
December 31, 1971.
IV. PA]'iwEA
Payment for all incidental items of work must be included in the limp
sum price bid for the work and no additional compensation will be made.
V. WATER
The Contractor will make his own provisions for obtaining and applying
water necessary to perform his work. If the Contractor wishes to use
available City water, it will be his responsibility to make arrangements
for water purchases by contacting the City's Utility Superintendent,
Mr. Tom Phillips, at (714) 673 -2110, extension 267.

VI. CONSTRUCTION DETAILS
1. ' Bomanite Cobblestone" Pavement
2.
Portland cement concrete used in Bomanite cobblestone pavement
shall be 6.0 -C -3000.
Colored hardener shall be terra cotta (A -29) "lithochrome
color hardener" as manufactured by L. M. Scofield Company, Los
Angeles, California. The mininnun.rate of application of the
hardener shall be 60 pounds per 100 square feet.
Colorwax curing and finishing compound shall be terra cotta
"lithochrome colorwae' as manufactured by L. M. Scofield
Company, Los Angeles, California. Minimum application coverage
shall be 600 square feet per gallon of unthinned colorwax.
The pattern used shall be Bomanite cobblestone (without grout).
Imprinting of the-_concrete shall be done utilizing the " Bomanite
process" as patented by the Bomanite Corporation, Palo Alto,
California.
Weakened plane joints and expansion joints shall be constructed
per applicable portions of City of Newport Beach STD- 103 -L.
Imprinting of the concrete shall be done in a uniform manner
with depth and width of imprint being 1/2 inch having no more
than 1/8 inch variance from one area to another. Imprint
valleys shall be free from ridges.
Final color appearance shall be uniform throughout the entire
surface area. All surfaces that are not uniform in color and
surface texture will be rejected.

The Contractor's attention is called to the existence of PVC
sprinkler lines and to direct burial electrical control wires
under a portion of the work area as shown on the plans. Extreme
caution should be used in working near these lines and wires.
Any damage shall be repaired at the Contractor's expense.

Adopt a resolution awarding the.contract to Concrete Textures of
South Laguna, California for $8,122.39, and authorizing the Mayor
and the City Clerk to execute the contract.
DISCUSSION:

This project will provide for the construction of decorative paving of a
portion of two traffic islands on Jamboree Road between San Joaquin Hills Road and
a point northerly of the Ford Road - Eastbluff Drive intersection. The paving
would be similar to that recently installed on Jamboree Road northerly of Coast
Highway.
Two bids were received and opened in the office of the City Clerk at
10:00 A.M. on January 4, 1972.

The low bid is 3% less than the engineer's estimate of $8,400.00. Funds
for the project are available in Gas Tax Budget Appropriation 18- 3315 -072.
This project was re- advertised after a rejection of the one bid received
when the project was previously advertised. Rejection was recommended at that time
(December 13, 1971) because the amount of the bid was too high (10% above the engineer's
estimate).
The plans were prepared by the city. The estimated date of completion is
February 29, 1972.

I. SCOPE OF WORK
The work to be done under this contract consists of constructing
Portland cement concrete median paving, including supplemental
items on Jamboree Road Islands 4'and 5 northerly from San Joaquin
Hills Road to Ford Road. The contract requires completion of all
the work in accordance with these Special Provisions, the City's
Standard Special Provisions, the Plan (P- 5044S), and the City's
Standard Drawings and Specifications. The City's Standard Specifications
are the Standard Specifications for Public Works Construction (1970
Edition).
II. COMPLETION OF WORK
The Contractor must complete all work on the contract within 30
calendar days after execution of the contract by the City.
III. TRAFFIC CONTROL
Traffic on Jamboree Road may be restricted to one 12 -foot wide lane in
each direction between 8:30 a.m. and 3:30 p.m., Monday through Friday,
during construction, except Veterans Day October 25, Thanksgiving Day
November 25, 1971, Christmas Eve December 24, 1971, and New Years Eve
December 31, 1971.
IV. PAYMENT
Payment for all incidental items of work must be included in the limp
sum price bid for the work and no additional compensation will be made.
V. WATER
The Contractor will make his own provisions for obtaining and applying
water necessary to perform his work. If the Contractor wishes to use
available City water, it will be his responsibility to make arrangements
for water purchases by contacting the City's Utility Superintendent,
Mr. Tom Phillips, at (714) 673 -2110, extension 267.
VI. CONSTRUCTION DETAILS
1. " Bomanite Cobblestone" Pavement
2�.
Portland cement concrete used in Bomanite cobblestone pavement
shall be 6.0 -C -3000.
Colored hardener shall be terra cotta (A -29) "lithochrome
color hardener" as manufactured by L. M. Scofield Company, Los
Angeles, California. The minimum.rate of application of the
hardener shall be 60 pounds per 100 square feet.
Colorwax curing and finishing conpo d shall be terra cotta
"lithochrome colorwax" as manufactur d by L. M. Scofield
Company, Los Angeles, California. nimum application coverage
shall be 600 square feet per gallon f unthinned colorwax.
The pattern used shall be Bomanite c bblestone (without grout).
Imprinting of the concrete shall be 4one utilizing the " Bomanite
process" as patented by the Bomanite Corporation, Palo Alto,
California.
Weakened plane joints and expansion oints shall be constructed
per applicable portions of City of N wport Beach STD- 103 -L.
Imprinting of the c�ncrete sh 1 be one in a uniform manner
with depth and width imp nt bein 1/2 inch having no more
than 1/8 in variance one area to another. Imprint
valleys shall be free f ridges.
Final color appearanc shall be uniOrm throughout the entire
surface area. All s�5re faces that are not uniform in color and
surface texture will be rejected.

The Contractor's attention is called to the existence of PVC
sprinkler lines and to direct burial electrical control wires
under a portion of the work area as hown on the plans. Extreme
caution should be used in working ne r these lines and wires.

Gentlemen:
The City Council awarded the subject contract to you on January 109 1972
Enclosed are four copies of the contract documents for the construction of the
project.
It will be necessary for you to execute and return a Material and Labor
Bond for 50% value of the contract amount; a Faithful Performance Bond for
100% of contract amount; and four copies of the contract. The date of the
contract is to be left blank, and it will be filled in when the City executes
the agreement.
The processed contract documents will be distributed as follows: (1) City
Clerk, (2) Public Works Department, (3) Contractor, and (4) bonding company.
In addition to the above documents, please submit certificates for public
liability and property damage insurance and workmen's compensation insurance.
THE FOLLOWING INSURANCE REQUIREMENTS MUST BE STRICTLY FOLLOWED:
1. The City of Newport Beach is to be named as an additional
insured on the public liability and property damage insurance.
The public liability and property damage policies shall be
endorsed as follows:
"It is hereby understood and agreed that the policy to
which this certificate refers may not be cancelled,
materially changed, nor the policy allowed to lapse
until ten (10) days after receipt by the City Clerk of
the City of Newport Beach, City Hall, Newport Beach,
California, of a registered written notice of such

Bids must be submitted on the proposal form attached with the contract documents furnished
by the Public Works Department. The additional copy of the proposal form is to be
retained by the bidder for his records.
Each bid must be accompanied by cash, certified check or Bidder's Bond, made payable to
the City of Newport Beach, for an amount equal to at least 10 percent of the amount bid.
The title of the project and the words "SEALED BID" shall be clearly marked on the
outside of the envelope containing the bid.
The contract documents that must be completed, executed, and returned in the sealed bid

E. Statement of Financial Responsibility

These documents shall be affixed with the signature and titles of the persons signing

the signature of at least one general partner is required.
No bids will be accepted from a contractor who has not been licensed in accordance
with the provisions of Chapter 9, Division III of the Business and Professions' Code.
The contractor shall state his license number and classification in the proposal.
Plans and_Contract Documents, including Special Provisions, may be obtained at the
Public Works Department, City Hall, Newport Beach, California, at no cost to licensed
contractors. A non - refundable charge of $2.00 will be required for each set of Plans
and Contract Documents issued to others. It is requested that the Plans and Contract
Documents be returned within 2 weeks after the bid opening.
The City has adopted the Standard Specifications for Public Works Construction (1970
Edition and Supplements) as prepared by the Southern California Chapters -of the American
- Public Works Association and the Associated General Contractors of America. Copies

RECOMMENDATION:
Reject the bid received, and authorize the City Clerk to readvertise
for bids to be opened at 10:00 A.M. on January 4, 1972.
DISCUSSION:
This project provides for the construction of decorative, textured concrete
paving on portions of two median islands on Jamboree Road between San Joaquin Hills
Road and northerly of the Ford Road - Eastbluff Drive intersection. The paving would
be similar to that recently installed on Jamboree Road northerly of Coast Highway.
One bid, in the amount of $9,250,was received for the work from Donn 0.
Michaels, General Engineering Contractor, of Newport Beach. The bid was 10% more
than the Engineer's estimate of $8,400.
Rejection of the bid and readvertising for new bids are recommended because
it is felt the bid price was too high. The unit costs of the work previously com-
pleted were $1.31 and $1.53 per square foot, as compared to $1.85 per square foot bid
for the present contract. Because of the comparatively high cost of the special
median paving as compared to conventional. concrete median paving, it is felt special
effort should be devoted to obtaining the lowest cost. (Conventional concrete median
island paving is estimated to cost $0.60 to $0.70 per square foot for plain concrete,
and $0.90 to $1.00 per square foot for colored concrete.)
If however, it is decided to proceed with the work at this time the
appropriate action would be to adopt a resolution awarding the contract to Donn 0.
Michaels, General Engineering Contractor, for $9,250 and authorizing the Mayor and
the City Clerk to execute the contract. Sufficient funds for the work have been
appropriated in the Gas Tax Fund under account no. 18- 3315 -072.
The plans were prepared by the city. The estimated date of completion
is February 29, 1972 if the contract is readvertised, or January 28, 1972 if the
contract is awarded at this time.

SPECIAL PROVISIONS
FOR THE
JAMBOREE ROAD MEDIAN PAVING, ISLANDS .4 AND 5 NORTHERLY OF
SAN JOAQUIN HILLS ROAD
CONTRACT NU&ER 1406
I. SCOPE OF WORK
The work to be done under this contract consists of constructing
portland cement concrete median paving, 'including -supplemental
items on Jamboree Road Islands 4 and 5 northerly from San Joaquin
Hills Road to Ford Road. The contract requ res',cpmpletion of all
the work in accordance with these Special Provisions,'the City's'
Standard Special Provisions, the Plan (P- 5044S), and the City's
Standard Drawings and Specifications. The City's Standard Specifications
are the Standard Specifications for Public Works Construction (1970
Edition).
II. COMPLETION OF WORK
The Contractor must complete all work on the contract within 30
calendar days after execution of the contract by the City.
III. TRAFFIC CONTROL
Traffic on Jamboree Road may be restricted to one 12 -foot wide lane in
each direction between 8 :30 a.m, and 3:30 p.m., Monday through Friday,
during construction, except Veterans Day October 25, Thanksgiving Day
November 25, 1971, Christmas Eve December 24, 1971, and New Years Eve
December 31, 1971.
IV. PAYMENT
Payment for all incidental items of work must be included in the lump
sum price bid for the work and no additional compensation will be made.
V. WATER
The Contractor will make his own provisions for obtaining and applying
water necessary to perform his work. If the Contractor wishes to use
available City water, it will be his responsibility to make arrangements
for water purchases by contacting the City's Utility Superintendent,
Mr. Tbm Phillips, at (714) 673 -2110, extension 267.

VI. CONSTRUCTION DETAILS
1. ' Bomanite Cobblestone" Paveme4''
Portland cement concrete used in Bomanite. cobblestone pavement
shall be 6.0 -C -3000.
Colored hardener shall be terra cotta (A -29) "lithochrome
color hardener" as manufactured by L. M. Scofield Company, Los
Angeles, California. The minimum rate of application of the
hardener shall be 60 pounds per 100 square feet.
Colorwax curing and finishing compound.shall be terra cotta
"lithochrome colorwax" as manufactured by L. M. Scofield
Company, Los Angeles, California. Minimum application coverage
shall be 600 square feet per gallon of unthinned colorwax.
The pattern used shall be Bomanite cobblestone (without grout).
Imprinting of the concrete shall be done utilizing the " Bomanite
process" as patented by the Bomaaite Corporation, Palo Alto,
California.
Weakened plane joints and expansion joints shall be constructed
per applicable portions of City of Newport Beach STD- 103 -L.
Imprinting of the concrete shall be done in a uniform manner
with depth and width of imprint being 1/2 inch having no more
than 1/8 inch variance from one area to another. Imprint
valleys shall be free from ridges.
Final color appearance shall be uniform throughout the entire
surface area. All surfaces that are not uniform in color and
surface texture will be rejected.
2. Protection of existing sprinkler system and Direct BL
The Contractor's attention is called to the existence of PVC
sprinkler lines and to direct burial electrical control wires
under a portion of the work area as shown on the plans. Extreme
caution should be used in working near these lines and wires..:
Any damage shall be repaired at the Contractor's expense.

DISCUSSION:
This project provides for the construction•of decorative paving of a
portion of two traffic islands on Jamboree Road between .San:Joaquin.Hills Road and
northerly of the Ford Road /Eastbluff Drive intersection.
The estimated cost of the work is $8,400.00. Funds are available in
Gas Tax Budget Appropriation 18- 3315 -072.
The Plans were prepared by the city. The estimated date of 'completion is
December 31, 1971.
