CONTRACT FOR ENGINEERING SERVICES
(Improvement of Hospital Road between Placentia Avenue
and Newport Boulevard)
THIS CONTRACT is made and entered into this as ni day of
A0 G ro j%X4 , 1971, by and between the CITY OF NEWPORT BEACH, a municipal
corporation, herein referred to as "City ", and RAUB, BEIN, FROST AND
ASSOCIATES, a civil engineering consulting firm, herein referred to as
"Engineer ".
RECITALS:
1. City intends to undertake a Public Works project for the
widening of Hospital Road between Placentia Avenue and Newport Boulevard and
the modification of a traffic signal at Hospital Road and Newport Boulevard.
2. Engineer has submitted a proposal to City to perform the
engineering services in connection with said project which City desires to
accept.
AGREEMENT:
1. General
City engages Engineer to perform the services hereinafter described
for the compensation herein stated and Engineer agrees to perform said services
upon the terms hereinafter set forth.
2. Services to be Performed by Engineer.
Engineer shall:
a. Perform a preliminary investigation of the overall project,
including contacts with the City, the State Highway Department,
Hoag Hospital, Park Lido Building and the adjoining convalescent
hospital in order to ascertain any requirements they might have for
the design of the road widening.
b. Perform a field topographic location and elevation survey
with sufficient cross - sections to provide the necessary field data
for design. Sufficient field data shall be compiled to tie the
proposed street improvements into the existing permanent improvements
which influence the design at each end and adjoining the right -of -way,

including an evaluation of the drainage requirements. The survey
shall extend a sufficient distance past the beginning and end of
the project and the sidelines to provide enough information to
adequately evaluate the existing condition.
c. Prepare a preliminary engineering design showing the
results of the preliminary meetings and survey information for
presentation to the City and adjoining property owners for their
review and approval.
d. Prepare Street Improvement Plans in accordance with the
standard requirements of the City of Newport Beach for approxi-
mately 1000 feet of widening and the revision to the vertical
alignment of the full section of Hospital Road between Newport
Boulevard and Placentia Avenue for the construction of curb, gutter,
sidewalk and paving. The plans will be prepared on Standard City
of Newport Beach Plan and Profile sheets with the plan view scale
of 1" = 40'.
e. The Improvement Plans shall also include provisions for
the required revisions to the existing sewer system, water system
and street light system within the limits of the road widening.
f. The Improvement Plans shall also include provisions for
the reconstruction of the existing driveways within the limits of
the road widening so that they correspond to the reconstructed
street alignment and grade.
g. The Improvement Plans shall also include the design and
location of all retaining walls required along the Hoag Hospital
property line due to the widening of the right -of -way into the
existing slope at locations where the top of slope cannot be
sufficiently moved back to provide an acceptable slope.
h. Prepare construction specifications, bid proposals and
contract documents on multilith masters for the improvements out-
lined above suitable for use by the City in calling for competitive
bids.

i. Prepare the necessary supporting plans and data for use in
application submittal to the State Division of Highways for an
encroachment permit.
j. Preparation of one final quantity estimate and related
cost estimate for the improvements outlined above.
k. Be available for consultations and advice during the
construction period of the project.
1. Check the required shop drawings and make minor revisions
of the plans and specifications as necessary in order to accommodate
unknown conditions discovered during construction.
m. Be available for consultations with the Public Works
Director and his staff regarding interpretation of the plans and
specifications
n. Prepare plans and specifications for the modification of
the traffic signal at Hospital Road and Newport Boulevard, and obtain
State Division of Highways approval of the plans and specifications
3. Duties of City
City shall:
a. Provide the necessary soils data required for Engineer to
complete services listed in Section 2.
b. Provide standard plan sheets.
c. Provide consultation as required during the project.
4._ Original drawings, reports, notes, maps and other documents
shall become the property of the City and may be reproduced as deemed necessary
by the Public Works Director.
5. City reserves the right to terminate this contract at any time
by giving Engineer three (3) days' prior written notice in the United States
mails, postage prepaid, addressed to any of Engineer's business offices. In
the event that City shall terminate this contract, it shall reimburse Engineer
on the basis of the standard fee schedule contained in this agreement.
6. All engineering services for the project as set forth in
paragraph 2 of this agreement shall be completed to the satisfaction of the

Public Works Director of City within seventy (70) calendar days following
authorization by City to proceed.
7. In consideration of the performance of the above described
engineering services, City agrees to pay Engineer an amount based upon the
hourly rate schedule set forth below, but in no event shall said amount be
greater than $7,650.00.

The above hourly rates shall be increased by 8% for any work performed after
August 1, 1972.
The amount to be paid to Engineer shall be payable as follows:
a. Monthly partial payments, each payment to be the amount
earned as determined by the fee schedule. The sum of the monthly
partial payments shall not exceed ninety percent (90 %) of the above
maximum fee. The aerial photo map and printing beyond that necessary
for the preparation of the drawings will be invoiced at cost.
b. The balance of the total amount to be paid upon acceptance
of the construction work by the City Council, but in no event not
later than twelve (12) months after the Public Works Director signs
the plans.
In addition, City shall reimburse Engineer for the actual
cost of reproduction of copies of said plans, specifications and
related documents, and filing fees, checking fees and other related
costs authorized by the Public Works Director and advanced by
Engineer.
8. The scope of the project may be changed and the maximum fee
revised upon prior written approval of the Public Works Director.

9. Engineer shall indemnify and save harmless City, and its
officers and employees, from all damage and liability arising from any errors,
omissions, or negligence in Engineer's performance of this contract and of the
engineering work and services herein provided.
IN WITNESS WHEREOF, the parties have executed this contract as
of the day and year first above written.

hereby certifies and warrants that the prices, wages, or salaries required
to be paid by City of Newport Beach under the engineering contract for
preparation of the Plans, Specifications and Estimate for the improvement
of Hospital Road between Newport Boulevard and Placentia Avenue are not
higher than those permitted under Executive Order No. 11615 executed by
the President of the United States on August 15, 1971.

WHERNt16, there has been presented to the City Council
of the City of Newport Beach a certain contract between the
City of Newport Beach and Raub, Bein, Frost & Associates for
engineering services in connection with the improvement of
Hospital Road Setween Placentia Avenue and Newport Boulevard)
and
WEMUW , the City Council has considered the terms
and,conditions of said agreement and found them to be fair and
equitable
NOW, THEREFORE, BE IT RESOLVED that said agreement
for the engineering services above described is approved, and
the Mayor and City Clerk are hereby authorized and directed to
execute the same on behalf of the City of Newport Beach.
