RAUB, BEIN, FROST & XSSOCIATEIS, a civil engineering consulting firm,
hereinafter referred to as "Engineer".:
R E C I T A L S
1. City intends to improve portions of Lafayette Avenue,
Lido Park Drive, and Villa ay Stract (as shown on Exhibit "A" attached
hereto aid made a part hereof by this reference), with the construction
of streQt irprov ment3, storm drain improvements, sewer inprovamsnt3,
straet lighting improvements, and other miscellaneous improvements.
2. Engineer has submitted a proposal to City to perform
the engineering services in connection with said project, which City
desires to accept.

Engineer shell:

project, including contacts with the City, Unger Pacific, Curci- Turner

b. Perform subpl?azantal field topographic location
and elevation survaya and sufficient cross - Sections to provide the

necessary field data for d�-,sirn.. Sufficient field data has been
cerpiled by the City to tie the proposed street inprovema -nts into
the existing permanent improvcnents which influence the design,
including an evaluation of the drainage ra..ufre_mant .
c. Prepare detailed Street Improvement Plans and
Special Provision_z, in accordance with the vtandard specifications
for Public Works Construction, 1970 Edition of the City of Necport
Beach for the construction of the following street and alley
location3. the construction of new A.C. pavement, F.C.C. curb and
gutter, sidewalk and drive approaches, a sewer system, a storm drain
system, a street light systc -n and other miscellaneous knprovements
for:
(1) Reconstruction of Lafayette Avenue from 32nd
Street to a point approximately 60' t 3/0 CL 29th Street.
(2) Reconstruction of 29th Street from 50' t tJ /O CL
Lafayette Avenue to the street end at The Rhine.
(3) Regrading and resurfacing of alley 343d (between
29th Street and 30th Street) from 50' ± W/O CL Lafayette Avenue
to the westerly PL of Lafayette Avenue.
(4) Reconstruction of 30th Street from 35' ± W/O C;,
Lafayette Avenue to Lafayette Avenue.
(5) Regrading of alley 3424 (between 30th and 31st
Streets) from 50' '- F +/O CL Lafayette Avenue to the westerly P,
of Lafayette Avenue.
(6) Reconstruction of 31st Street from Villa Way
to Lafayette Avenue.
(7) Regrading of alley 341d (between 313t and 32nd
Streets) from 70' 3' y7 10 CL L3fayatta Avanue to Lafayette Avenue,
(8) Reconstruction of Lido Park Drive from

(10) COnstruction of curb inlet catch basin3
(L =3.50) and 1 8" connector pipes at the no.:thwest and southwest
eorner3 of Lafayette Avenue and 29th Street, and construction
of 30" pipe in 29th Stri�-at if existing 16" storm drain has to be
removed due to lowered intersection grad~.
(11) Construction of curb inlet catch basin
(L=7.01) and 16" corn::actor pipe on Lido Park Drive.
(12) Construction of a storm water tidal structure
inlet (Y. -3.50) on Lido Park Dive at Tile Rhine.
(13) Construction of curb inlet catch basin3
(L =3.54) and 18" connector pipes at the intersections of Villa
Way and 30th Street and at Villa Flay and 31st Street.
(14) Replacement of existing 6" concrete sewer
with 6" V.C.P. sewer in Lafaye3tte Avenue from alley 344 (southerly
of 29th Stre=et) to 30th Street.
(15) Installation of street lighting system on
Lafayette Avenue east side between 30th Street and 32nd Street.
(16) Installation of street lighting system On
Lafayette Aver_ue west side between alley 3424 and 31st Street.
(17) Installation of street lighting system on
Lido Pxk Drive from Lafayette Avenue to approximately 150, L/O
Lafayette Avenue.
(18) Installation of street lighting system on
31st Street rsouth aide.
(19) Installation of street lighting system on
Lafayette Avenue south side if power company decides to undargrourd
its line and remove power poles.
d. The plans will be prepared on .standard City of
Newport Beach plan and profile sheets with the plan view scale to the
sati3fsctien of the City Lngineer, and in accordance with the
following project de3ign criteria:
(1) Vertical aligrment shall be b33ad on control

points shown on pr(ali*ain-ary plans prepared by City.
(2) Stationing shall conform to those shown on
the preliminary plan: prepared by City.
(3) n, a straet izmprov =ants shall include n::w
asphaltic concrete pavzment, P.C.C. curb an3 gutter, P.C.C.
sidewalk, P.C.C. driveways, A.C. s1houldcr3, R.C. driveways,
P.C.C. cross gutty - -rs, survey monuments at all Street inter-
sections, B.C.s and E.C.s, niscellanaous patching and other
related work.
(4) Plan view scale shall be in - 204. Profila
scale shall ba in _ 20' horizontal,. and 1° - 2' vertical.
(5) Structural sections shall be determined by
the City and furnished to the Engineer.

e. Storm D, -ain Improvcza:nt P1::ns shall be prepared on
plan and prof-Ile sheets supplied by the Citr and shall ba prepared in
accordance with the standard require�aent3 of the City of Neumort
Brach.
(1) Curb inlets and pipes shall be sized in
accordance with the hydrology study prepared by the City.
(2) Curb inlets, pipe and tidal structure shall
be located as sho:Yn on preliminary plar.3 prepared by City.
(3) Reinforced corcret pipe (O -ring rubber gasket)
or asbestos ce:aant pipe shall be accepteb3.2.
(4) Minimum slope on all storm drain pipe shall
be .002 ft. /ft.
(5) D-lo: ds shall be c'al culztted by the Encineer.

and profile :sheets supplied by the City and shall be prep:.red in
accordance with the standard reauiremants of the City of Newport
Beach.
g. Prep.re construction specifications, bid proposals
and contract documents on multilith masters for the iraprovs:ments
outlined above suitable for u:;e by the City in calling for coap=etitive
bids.
h. Complete a field survey o° location ties of all
existing CL monument3 tiirich will clear anticipated construction in
Order to facilitate th -ir resetting after completion of construction.
I. Perfo.,i a field survey to resat all existing
centerline monumentation sho%•m on the approved plans in accordance
with the City standards. Engineer will provide cross ties and punch
monuments (monuraents to be set by others).
J. Complete the invEeatigation of tbs existing Edison
Company and other underground utility information using the
information supplied by the City as the basis for expanding the
location .an3'elevation data for the lines.
k. Prepare one ccnstruction quantity estimate and
related engineer's cost estimate for the impcoveutents outlined above.

the construction p- Ario.i of the project.

revisions of the plans and specifications as n•acessary in order to
acccuaodate unknown conditions discovered during construction.

5. City raner✓es the right to terminate this contract at
any time by giving 'ngineor three (3) days' prior written notice.
Notice shall be deemed served upon deposit in the United States mail,
Postage prep-yid, adaress : =d to any of Engineer's business offices. If
thin sar- n7 nt is taxnmin :at_d for any rvaso n other th-In fe:ult of the
Engineer, City agrees to compensate Engin4ar for work completed up to
the date of termination on the basis of the fee schedule contained
in this agreement.
6. Enginaer 4grae3 to complete all of the services
specified herein within sis:ty (60) days after execution of this
contract.

7. In consid- aratioa of the perfornince of the above - &_scribed
engineering service3, City agrees to pay ngin : :er an amount based
upon the hourly rata 7,che•3ulfa set fo-th below, but in no event shall
said c -Ount be greater than 513,500.00:

any work performed after August 1, 1972.
711a amount to be paid to Engineer shall be payable as
follows:
a. Monthly partial payment -, each payment to be the
amount earned as detercainad by the fee schedula. The sera of the
monthly partial payments shall not exceed ninety percent (90 %) of
the above maximum fee.
b. 2"na balance of the total amount to ba paid upon
acceptance of tho construction work by tha City Council, but in no
event later than twelve (12) months after the Public Works Director
signs the plans.
In addition, City shall reimburse Engineer for the
actual coat of repro3uction of copies of acid plans, specifications
and related docuaants, ar_d filing fees, checking fees and other
relatod costs auvhori ed by the Public 'Viorks Director and advanced by
Engineer.
S. Thy scope of thr project may be changed and the
maxima fe =a reviacd upon prior written approval of the Public Vo :ka
Director.
9. Engineer shall indemnify and save harmless City _nd

WHEREAS, there has .b"a.;psrtented to thw -City Council

City of Newport Beach and RAM, BETH, FP4DST jgASSOCIAT%5 for
the design of street storm drain and sewer improve<aents on
Lafayette Avenue, Villa Way and Lido Park Driver and
WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair and
equitable
NOW, THEREFORE, BE IT RESOLVED that said agreement
for the engineering services above described Is approved,
and the Mayor and City Clerk are hereby authorized and directed
to execute the same on behalf of the City of Newport Beach..
