Originally it was planned to install a concrete fillet as shown on the attached sketch. However, subsequent discussions with our field personnel have led us to conclude that, because of the small cross sectional area, the proposed con- crete fillets would not hold up under traffic conditions. It is now believed that the use of an asphalt fillet would be a better choice of material. If asphalt is used in the fillet, a light dusting of the asphalt surface with cement would be done to give it a concrete -like appearance. It should be understood that all work will be within the public right -of -way, and the costs will be assumed by the City. The Council will again consider this matter on May 29, 1973. Plans are available for inspection at the Public Works Department in the rear of the City Hall. The alley is proposed to be constructed of Portland cement concrete 6 inches thick. The grade of the alley has been lowered to permit it to drain easterly. At the east and of your property the edge of the alley will be approxi- mately 0.30 feet lower than your apron. At the west and of your property the edge of the alley will be approximately 0.25 foot lower than your apron. It is proposed to remove a strip of apron 3 feet wide by 27 feet long and replace it with a strip of peotland cement concrete 4 inches thick, joining the edge of the alley and the apron in a'pmooth transition. Should you desire not to have the strip of concrete apron removed, do not return the consent form. You will not be assessed for work done on your property without your written consent. The city's contractor will construct the alley at the design grade and then you may at your discretion, either modify the apron or leave it as it is. Relocating Existing Street Lights . ... . . . . . . . . ... . . . 7 i CITY OF NEWPORT BEACH PUBLIC WORKS DEPARTMENT SPECIAL PROVISIONS FOR ALLEY IMPROVEMENTS IN NEWPORT HEIGHTS AND BALBOA CONTRACT NO. 1415 SCOPE OF WORK The improvements to be constructed under this contract consist of the construction of alley pavement and alley approaches in 24 city blocks; the adjustment of sewer manhole covers to grade; the construction of a retaining wall; adjustment to grade of garage approaches and driveway approaches on private property; and appurtenant work necessary, to complete the. project. The alleys in 23 blocks in Newport Heights will be constructed of 4 inches of asphalt concrete pavement over compacted native materials. Each alley Will include a portland cement concrete center gutter 4 feet in width, 6 inches in thickness, over 4 inches of imported aggregate base. The alleys will be edged by 2 x 6 redwood headers: The alley in one block in Balboa will be.constructed of portland cement concrete pavement 6 inches in thickness over compacted native materials. The alleys contain various types of structures owned by utility companies. The contractor must use a reasonable amount of care to .protect the structures during construction of the alleys.. Included are sewer manholes, sewer cleanouts, water meter boxes, water valve covers, street light pull boxes, cable television pull boxes; electrical vaults, telephone vaults, gas vaults; power and telephone poles, and underground wires, cables, conduits and pipes. Each structure in the alley will be adjusted to grade by its respective owner, except for the following: (a) Sewer manhole covers will be adjusted by the contractor and paid for at the unit price bid for adjusting sewer .manholes to grade. (b) Water valve covers and sewer cleanouts will be adjusted to final grade by the.contractor. Payment therefor will be included in the unit prices paid for other items of work. (c) The contractor will be required to remove and dispose of water meter boxes and install new water meter boxes which will be pro - vided by the city and made available to the contractor at the Corporation Yard located at 592 Superior Avenue: Compensation for the installation of new water meter boxes will be included in the unit prices bid for other items of work. SP2of7 II. SPECIAL ASSESSMENT DISTRICT PROCEDURE The work under this contract will be accomplished under the authority of and using the procedure of the Improvement Act of 1911. Payment to the contractor is made by the city delivering a warrant, assessment,.and diagram to the contractor after the work is completed and the assessment spread and confirmed. The particulars of the Improvement Act of 1911 are found in Division 7 of the Streets and Highways Code of the State of California, commencing with Section 5000. In no case, except where it is otherwise provided by law or by charter will the City of Newport Beach, or any officer thereof, be liable for any portion of the expense; nor for any delinquency of persons or property assessed. III. PLANS AND SPECIFICATIONS A. Plans The plans consist of: (a) City of Newport Beach Public Works Department Drawing No. A- 5044 -S, consisting of 41 sheets numbered 1 through 41 inclusive. (b) Standard drawings 106 -L, 116 -L, 118 -L,, 510 -L B. Specifications The specifications consist of these Special Provisions, and the Construction Standards and Specifications for Construction of Public Works in the City of Newport Beach dated April 1970, which may be purchased from the Public-Works Department of the city at a cost of $2.00 per copy. The Standard Specifications incorporate by reference Standard Specifications for Public Works Construction, 1970 Edition, and supplements thereto, as prepared by the Southern California Chapter of the American Public Works Association and the Associated General Contractors of America. IV. TIME OF COMPLETION All work shall be completed within 180 calendar days after execution of the contract by .the city. V. TRAFFIC CONTROL. The contractor shall provide traffic control in compliance with the Standard Specifications. VI. NOTIFICATION TO RESIDENTS The city will mail a preliminary notice to all residences affected by this work. Between 40 and 55 hours prior to closing a particular alley to vehicular traffic, the contractor shall distribute to each affected residence and business a written notice stating when construction operations will start and approximately when vehicular accessibility will be restored. The written notice will be prepared by the city and the contractor shall insert the applicable dates at the time he distributes the notice. Errors in distribution,, false starts, unforeseen natural occurrences, strikes, or other alterations of the schedule will. require renotifica- ti.on using ;an explanatory letter. SCHEDULING OF WORK • SP3of7 Upon execution of the contract by the city the contractor shall submit to.the engineer a written schedule of work. The schedule shall include the following requirements: 1. No more than 5 alleys may be closed to vehicular traffic at any one time. 2. The sequence of construction shall be as follows: a. Removal of existing alley surface. b. Grading and compaction of subgrade. c. Construction of portland cement concrete alley ,approaches; portland cement concrete center gutter, portland cement concrete.pavement, portland cement concrete driveways, portland cement concrete garage approaches, and adjustment of sewer manhole covers. d.. Five days of curing portland cement concrete must elapse before any other work is permitted in the alley. e. Construction of redwood headers. f. Adjustment to grade of structures. g. Construction of asphalt concrete pavement, asphaltic . concrete driveways and asphaltic concrete garage approaches: 3. Alley construction will follow replacement of water mains which will be done by a separate contractor. The water main contractor will commence construction approximately one month before construction of alleys is scheduled to begin. Approximately 120 calendar days will be allowed for water main construction. The water main contractor will. be required to start at Irvine Avenue and work toward the west... Alley construction shall commence with construction in Balboa and the most easterly alleys in Newport Heights. Work must proceed. in a westerly direction, in order to avoid interference with.the water main contractor. The water main contractor will not replace any pavement over trenches. He will be required to compact the top 12 inches of trench to a relative compaction of 95 %; and the remainder of the trench to 90% of relative compaction. 4. Each alley and garage approach with access from that alley must be returned to normal vehicular use within 30 consecutive calendar days, from the day it is first closed. The contractor must employ sufficient. men and equipment necessary to accomplish this schedule. If it becomes apparent during the course of the work that the contractor will not be able to meet this schedule,.he will be prohibited from starting work in additional alleys, until he has exerted extra effort to catch up on his original schedule, and has demonstrated that he will be able to maintain his approved schedule in the future: W ` SP 4 of 7 Such stoppages of -work shall in no way relieve the contractor from his overall time of completion requirement., nor shall it be construed as the basis for payment of extra work because additional men and equipment were required on the job. The intent-of this section of the Special Provisions is to emphasize to the contractor the importance of prosecuting the alley, construction work in an orderly, planned, and continuous fashion in order to minimize time any alley is closed to traffic.. VIII. WATER The contractor shall make his own provisions for obtaining and applying water necessary to perform his work. If the contractor desires to use available city water, it shall be his responsibility to make arrangements for water purchase by contacting the city's Utility Superintendent, at (714) 673 -2110, extension 267. IX: CONSTRUCTION SURVEY STAKING Field surveys for control of construction shall be the responsibility of the contractor. All such surveys, including construction staking, shall be under the supervision of a California Licensed Land Surveyor or Civil. Engineer. Staking shall be performed on all items ordinarily staked at intervals normally accepted by the agencies and trades involved: Sufficient survey stakes shall be placed to control the accuracy of the concrete forms to within 1/8 -inch vertically and 1/4 -inch horizontally. CONSTRUCTION DETAILS AND PROPOSAL ITEMS A. The unit price paid for constructing portland cement concrete alley approaches shall include compensation for furnishing imported aggregate. base under the alley approaches; street pavement patching adjacent to the alley approaches; and imported aggregate base under street pavement patching. 3. The unit price paid for constructing portland cement concrete center gutter shall include compensation for furnishing imported aggregate base under and adjacent to the center gutter, and extending'ohe foot on each side beyond the edge of the center gutter. The quantities shown in Items 6,7, 'an 15 ,of the Proposal represent the,quantities of work that would be required if all property owners gave their written consent as described above. No work shall be done on any, private property for which the owner may be assessed without the prior written authorization of the engineer. 2. Unpaved private property adjacent to alleys will be graded with earthen materials in order to provide a smooth, neat transition between the edge of the .alleys and the existing ,ground surface. The cost of such grading will be included in the unit prices paid for other items of work in the alleys.. 3. Sidewalks., curbs, gutters, Portland cement concrete pavement, bituminous surfacing, base material, lawns and plants, sprinkling systems, fences, walls, or any other improvements on private property removed, broken, or damaged by the contractor's operations shall be replaced or reconstructed at the contractor's expense with the same kind of material as originally found on the work or with materials of equal quality. The new work shall be left in a serviceable condition satisfactory .to the engineer. C. Removal of Unauthorized Encroachments from Public Right of Way All unauthorized encroachments such as concrete slabs, asphalt concrete, brick walks, rubble, fences, walls,, chains, wood and steel.protection posts, steps, etc., shall be removed from alleys to be improved.. Such improvements shall be sawcut at the property line and removed. All usable construction materials so removed shall be staked neatly and left on the private property. All non - usable materials so removed shall be disposed of by the contractor. Payment for removal.of unauthorized encroachments from the public-right of way will be included in the unit prices paid for other items of work'in the public right of way, and no extra payment will be made therefor. . Alley Approaches Portland cement,concrete alley approaches shall,be constructed in accordance with the City of Newport Beach Drawing No. STD 106 -L, The price paid for construction of alley approaches includes the cost of imported aggregate base and the cost of patching between the edge of the gutter and the.ex.isting street pavement. Street pavement patching shall match the existing street pavement as follows: Newport Heights . Patching existing portland cement.concrete avement: 6 inches of portland cement concrete pavement over inc es ot imported aggregate Patching existing asphalt concrete avement: 6 inches of asphalt concrete pavement over compacte native materials. Balboa nt: 6 inches of native materials. Patching existing asphalt concrete pavement: 4 inches of asphalt concrete pavement over compacted native materials. 2. Alley approaches in Balboa shall be constructed over compacted native materials. Imported aggregate base will not be required. No deduction will be made from the unit price paid because of not providing imported aggregate base. Special alley approaches in Newport Heights shall be constructed the full width of parkways having an approximate width of 22 feet from the. face of curb to the street right of way line. Where sewer manholes occur in new portland cemen.t.concrete alley approaches; no deduction will be made from the.unit prices paid for alley approaches or adjusting sewer manholes to grade because of the concrete apron included in the price paid for adjusting sewer .manholes to grade. Where other structures occur in new portland cement.concrete alley approaches, no additional compensation will be allowed for adjusting these structures to grade. Newport Blvd. Area Code 714 673 -2110 On April 23, 1973, the City Council directed the staff to develop plans and specifications for an interim improvement to the grade differential that now exists between the alley surface and the garage approaches in your block. Originally it was planned to install a concrete fillet as shown on the attached sketch. However, subsequent discussions with our field personnel have led us to conclude that, because of the small cross sectional area, the proposed con- crete fillets would not hold up under traffic conditions. It is now believed that the use of an asphalt fillet would be a better choice of material. If asphalt is used in the fillet, a light dusting of the asphalt surface with cement would be done to give it a concrete -like appearance. It should be understood that all work will be within the public right -of -way, and the costs will be assumed by the City. The Council will again consider this matter on May 29, 1973. D -2 SUBJECT: ASSESSMENT DISTRICT 54 (ALLEY IMPROVEMENTS IN NEWPORT HEIGHTS AND BALBOA, CONTRACT 1415) RECOMMENDATIONS: 1. Continue adjourned Public Hearing to consider written protests concerning the manner in which the work was done or the way in which the assessments were spread. 2. Close Public Hearing and direct the Superintendent of Streets to correct and modify the assessment. 3. Adopt a resolution confirming the assessment and diagram as they were corrected and modified after the close of the Public Hearing; and ordering the Superintendent of Streets to attach a warrant to said assessment as corrected and modified. DISCUSSION: A memorandum to the City Council from the Public Works Department, dated March 26, 1973, concerning Assessment District 54, is attached and labeled Exhibit "A ". On March 26, 1973, the City Council opened a Public Hearing to consider written protests concerning the manner in which the work was done or the way in which the assessments were spread. Eight written protests were received prior to the Public Hearing. The written protests represented approximately 2% of the area within the district. Most of the complaints centered around the following items: (1) The asphalt was improper- ly compacted; (2) The water meter boxes were low; (3) The alley grades in Newport Heights are too high; and (4) The alley grades in Balboa are too low. The City Council adjourned the Public Hearing until April 23, 1973, to hear a report from the Public Works Department on the manner in which the work was done. Following are the results of the investigation made by the Department. 1. Mr. Roland Landrigan had a general complaint regarding construction. On March 27, 1972, Mr. Landrigan toured the alleys with staff members to point out areas that he considered deficient. Nine asphalt concrete cores were taken at locations pointed out as appearing to represent the worst conditions in the district. (2) This was the first alley paved with asphalt concrete. As a result of the open appearance of the surface, a number of residents complained. The mix was subse- quently changed to a finer mix which was used for the remainder of the alleys. (3) Location where property owner stated that asphalt was not compacted by contractor, and that surface water soaked into the pavement. While the pavement density at two locations is less than specified, both the average of the densities and the thicknesses of the tests taken exceeded the minimum requirements. The results are within acceptable limits for work of this type. Water was applied to the alley surface at 2904 Cliff Drive on March 27, and it did not soak through the asphalt surface. Because of the concern over the prob- lemsinhrent with the design selected by the Newport Heights Association, a seal coat was specified and applied to all asphalt surfaces after the paving operation. The incident of water soaking may have occurred prior to seal coating. In order to obtain proper compaction, the specifications called for the asphalt surface to be higher than the adjoining concrete surfaces. To construct each water meter box to grade as is normally done in street paving would have cost an additional $50 per lot. The reason for this additional cost is that each meter box would have to be lowered and installed below grade prior to paving. After the paving operation, the meter box would have to be cut out and raised to grade. At 0 April 23, 1973 Subject: Assessment District 54 Balboa, Contract 1415) Page 3 (Alley Improvements in Newport Heights and the time the district was formed, the stated desire of the residents was to minimize the first cost of the project in every way. An estimate of an additional $50 per lot to adjust water meter boxes would not have been acceptable. The desire to keep costs to an absolute minimum also resulted in placing the asphalt in one lift. Normally 4 inches of asphalt would be placed in two lifts. A two -lift operation would have allowed the alley surface to be constructed to a much closer tolerance. 2. Mr. R. T. Hubbell of 543 Redlands Avenue stated that his driveway will not drain because the alley grade was too high. Drainage is critical in this area because of the flat grades. A portion of the alley adjoining Mr. Hubbell's property was regraded to alleviate the problem. 3. Captain Shadbolt of 513 Catalina Drive stated that his property will not drain to the alley. His house is located in what was originally a swale that connects to Catalina Drive. The natural slope of his property is toward the street in front. There is no practical way that his property could be made to drain to the alley. 4. Mr. Ernest Vogt of 519 Aliso Avenue stated that the contractor cracked his driveway. The plans show that the crack in the driveway existed rp for to alley construction. 5. Mrs. Margaret L. Jarosse and Mrs. Bernice C. Caya of 507 Riverside Avenue complained about the length of the construction period and the amount of their assessment. The assessment was $354.00 for alleys, plus $76.74 for concrete driveway adjustment on their private property. Their total assessment was within $20.00 of the estimates prepared by the City. During the construction of the alleys the City received a number of complaints about the length of the construction period. A typical letter of response to this type of complaint is attached and labeled Exhibit "B ". 6. Mrs. Agnes Tipping, owner of four lots in Newport Heights, protested the whole assessment district. At the Public Hearing on the Resolution of Intention to form the District, the Council overruled a large number of protests of this type and directed the staff to proceed with the formation of the district. At the time of the Resolution of Intention there was over a 30% protest from the property owners within the district. 7. Mr. Raymond L. Gray of 304 East Balboa Boulevard and his father, Mr. Raymond L. Gray of Los Angeles, stated that the alley grade was set low in order to accommodate a house that has since been demolished, and that the edges of the alley should have been warped to meet existing improvements. In the con- struction of concrete alleys, it is not recommended that the edges of alleys be warped to meet building elevations. The preferred method is to design alleys to an optimum grade and section, and then to adjust driveways on private property to accommodate the alley grade. On February 23, 1972, the senior Mr. Gray called the Public Works Depart- ment about the estimate of $110.00 that the staff had given him to reconstruct a a April 23, 1973 Subject: Assessment District 54 (Alley Improvements in Newport Heights and Balboa, Contract 1415) Page 4 his driveway ($1.20 per square foot). Mr. Gray thought the cost was too high and stated that he would reconstruct it himself. 8. Mr. Hugh Lilly of 300 East Balboa Boulevard complained of the work practices of the workmen, plus the lack of adjustments to private driveways. The City has little control over the contractor's workmen. All adjustments to private driveways require the written permission of the property owners. The City had a very poor response in obtaining the required permission. 9. Mrs. Mary Lewis of 316 East Balboa Boulevard made a verbal complaint about the alley grade in relation to her property. The property owners were sent consent forms in February, 1972, requesting permission to make adjustments on private property. On April 26, 1972, the Public Works Department and the contractor verbally agreed that work would commence around June 15, 1972, and that the City would not order any additional work done on private property for which consent forms had not been received by June 15, 1972. The purpose was to allow the contractor time to schedule removals. On June 27, Mrs. Lewis signed consent forms for driveway reconstruction for three lots, but the Griffith Company refused to do the work in accordance with the agreement of April 26. City forces later attempted to construct temporary asphalt ramps to the driveways, but the work was stopped at the request of the property owners. Since the Public Hearing of March 26, 1973, the City has been attempting to secure written permission from Mr. and Mrs. Lewis to enter onto their property and repair a hazard to tires that exists at the intersection of the two alleys. To date they have not given their permission. It is the opinion of the staff that in spite of the limitations of the design, the contractor performed well, and there was substantial compliance with both the plans and the specifications. It should be kept in mind that in 1911 Act proceedings, the contractor receives no partial payments and is required to wait until the confirmation of the assessments by the City Council before being paid. The rationale is that the benefit to an individual lot in having an improved alley is substantially the same whether the lot is in the middle of the block, at the end of a block, or at the intersection of two alleys; and the benefit is substantially the same whether the lot is slightly wider or narrower than the average of all the lots in the district. A 1970 amendment to the Improvement Act of 1911 provides that if the written consent of the owners of property is first obtained, work may be done on private property to eliminate any disparity in level between the improvement in public right - of -way and the private property. Only a few of the people so affected gave their written consent. After construction was under way, it became evident that provisions had to be made to provide vehicular access to lots in Newport Heights even where no written consent had been given. This was done and the cost distributed evenly over all the assessed lots in Newport Heights except those lots whose owners had signed up to have work done on private property by the Griffith Company. No garage approaches were adjusted in Balboa. After a series of communi- cations and meetings, the staff received the impression that each property owner in the Balboa area needing adjustments made on his private property desired to make his own arrangements. For Assessment No. 457. at 325 Aliso Avenue, the property owner was assessed for 40 sq. ft. of concrete constructed on his property which he himself had constructed. It is recommended that the assessment be reduced by $34.40. The recommended figures include this change. At the time the assessment district was formed, the primary concern of the residents in t,ie area was cost. In an effort to keep the cost down to an absolute minimum, the following decisions were made: 1. A combination asphalt and concrete alley was selected. 2. The use of temporary resurfacing after water main construction was eliminated. 3. The time limit on construction was kept at a maximum to encourage as rutny bidders as possible. 4. The city staff was to assume the inspection burden with existing personnel to prevent any increase in incidental cost. 5. The size of the district was to be kept large as possible to encourage lower unit prices. As a result of these decisions, the construction costs were kept to a minimum, however in doing do, the length of construction time was greatly increased. In addition, prior to construction of the alleys, it was necessary to replace the entire water system, replace the entire C.A.T.V. system and replace a large portion of the existing gas system, all of which have contributed greatly to the complexity and the scheduling problems of the work. At the time of formation of the district, the city staff recommended that the entire alley be concrete. While concrete alleys would probably have cost more, they would have the advantage of a much shorter time of construction and they would reduce the need for 95% compaction on the sub -base. As it turned out, obtaining this 95% compaction proved to be an even greater problem titan was anticipated by the staff. September 1, 1972 Page Two By way of comparison, the city included a one block area on the Peninsula as part of the Newport Heights Assessment District. The alley on the Peninsula was paved with all concrete and had no utility problems. As a result the work was completed in record time and the alley has been open for traffic for a number of weeks. We regret the inconvenience being caused to the residents and, while on a large job of this type there are probably numerous examples wiiere the work could have been done in a more expeditious manner, the project has proceeded reasonably well and so far is within the overall time lindts established by tie contract. Adopt a resolution awarding the contract to the Griffith Company for $191,927.21; authorizing the Superintendent of Streets (Public Works Director) to execute the contract; and authorizing the Superintendent of Streets, after construction has begun, to order changes in the work not exceeding one percent of the original contract without the necessity of a public hearing. 2. Approve city contributions to the district in the total estimated amount of $73,988. 0 DISCUSSION: Five bids were received and opened by the City Clerk at a public meeting held in City Hall at 10:00 A.M. on March 20, 1972. The bids were for the work as described in Resolution No. 7603. The bids have been checked and tabulated, and it was found that the bid of the Griffith Company is the lowest received. The City contribution is now estimated to be $73,300., as compared with the previous estimate of $46,916. Of the total increase, approximately $4,000 is due to acceptance of the responsibility for reconstructing alley no. 117 (approved on January 24, 1972); and approximately $22,400 is due to the increase in the unit prices bid for work which is the City's responsibility (primarily reconstruction of alley approaches).
