Home My WebLink AboutC-1304 - Buffalo Hills Park, Property conveyance agreementM AGREEMENT TO CONVEY PARK PROPERTY (Buffalo Hills Parma THIS AGREEMENT, made and entered into this _ day of , 1970, by and between the CITY OF NEWPORT BEACH, hereinafter referred to as "City," and THE IRVINE COMPANY: 'RECITALS 1. The Irvine Company has conveyed to the City a park site (Buffalo Hills Park) consisting of approximately 5.73 acres, which is designated as Parcel "A", as shown on that certain parcel map recorded in Book 22, page 27 of Parcel Maps, County of Orange, State of California; 2. In addition to said Parcel A, The Irvine Company has offered to convey to the City an easement for park and recreation purposes allowing the City to improve and use approxi- mately 1.61 acres of property adjoining said Parcel A, which said property is hereinafter referred to as Parcel "C, and is more particularly described in the legal description designated Exhibit "A" and on the drawing designated Exhibit "B ", both of which are attached to this agreement; 3. It is anticipated that the Newport -Mesa Unified School District, hereinafter referred to as "School District," will acquire a school site adjacent to Parcel A, the Buffalo Hills Park site, and that Parcel C referred to above will sub- sequently be conveyed to the School District for use jointly by the City and the School District for park and playground on THS:eg 3/5/70 purposes. In the event the School District does not take title to said Parcel C as anticipated, The Irvine Company is willing to convey a fee interest in Parcel C to the City. NOW, THEREFORE, IN CONSIDERATION of the mutual promises, terms and provisions of this agreement, it is agreed between the parties hereto as follows: 1. The Irvine Company agrees to grant to the City of Newport Beach an easement for park and recreation purposes over said Parcel C, and City agrees to accept said easement. 2. If within a period of five (5) years after the date of completion of the improvements on Buffalo Hills Park and the City's acceptance thereof, the Newport -Mesa Unified School District does not take title to said Parcel C from The Irvine Company, The Irvine Company agrees to convey said Parcel C in fee to the City for park purposes.
