DISCUSSION:
The contract for improvements to Irvine Avenue northerly of Heather
Lane has been completed to the satisfaction of the Public Works Department.
The bid price was: $7,520.00
Amount of unit price items constructed: $8,149.30
Amount of change orders: none
Total contract cost: $8,149.30
Amount budgeted in Account No. 18- 3329 -081: $8,000.00
The increase in the cost of the unit price items constructed was due
primarily to the need for additional asphalt concrete paving material. A
budget amendment has been submitted to cover the additional costs. Funds are
available in the unappropriated Gas Tax Account.
The contractor is Moses Galluzzo of Santa Ana, California.
The contract date of completion was September 1, 1972. The work was
completed by August 22, 1972.
The engineering was performed by the Public Works Department.

Gentlemen:
The City Council awarded the subject contract to you on July 10, 1972.
Enclosed are four copies of the contract documents for the construction of the
project.
It will be necessary for you to execute and return a Material and Labor
Bond for 50% value of the contract amount; a Faithful Performance Bond for
100% of contract amount; and four copies of the contract. The date of the
contract is to be left blank, and it will be filled in when the City executes
the agreement.
The rocessed contract documents will be distributed as follows: (1) City
Clerk, (2� Public Works Department, (3) Contractor, and (4) bonding company.
In addition to the above documents, please submit certificates for public
liability and property damage insurance and workmen's compensation insurance.
THE FOLLOWING INSURANCE REQUIREMENTS MUST BE STRICTLY FOLLOWED:
1. The City of Newport Beach is to be named as an additional
insured on the public liability and property damage insurance.
The public liability and property damage policies shall be
endorsed as follows:
"It is hereby understood and agreed that the policy to

ENCLOSURE: IRVINE AVENUE ACCIDENT ANALYSIS
November 9, 1970
Because a recent review of Police Department traffic accident reports indi-
cated that Irvine Avenue between Santiago and Santa Isabel was developing a high
accident rate, a detailed accident analysis was undertaken by the Traffic Engineer to
discover correctible weaknesses in operation and design. The study is summarized in this
report and a complete copy is attached for those interested in the details.
More recently, residents of the area in a petition to the City Council, have
called for a reduction in accidents. This formal report, in response, includes a summary
of the accident analysis, discussion of possible improvements, and recommendations for a
course of action.
Irvine Avenue is a primary artery in the local street network. With a large,
fully- developed residential and commercial area on the south and a burgeoning industrial
area plus connections to the freeway system on the north, this street will continue to
attract increasingly greater volumes of traffic, probably doubling within the next 10 to
15 years.
A possible explanation for the recent history of accidents could be the
nature of the development in this part of the community. Appearing to some drivers as a
rural road, Irvine Avenue is actually a city street. When development is complete, the
general appearance and feeling of the area plus the added marginal frictions will serve
to restrain most drivers.
With the increased traffic we can also expect more accidents. However,
buildup in traffic volumes generally causes the average speed to drop -- because there
are fewer occasions for the adventurous drivers to put their vehicles to the test.
Therefore, the speeding accidents discussed below should also decrease in number.
In the meantime, current accident records do reveal the section of Irvine
Avenue between Santiago and Santa Isabel to have a significantly high accident rate -- 56
percent greater than that of the average 4 -lane divided street in urban California. The
neighboring residents are alarmed for good reason.
The principal cause of the traffic accidents is a matter of driver behavior;
specifically, driving too fast for the prevailing conditions. Out of a total of 25
accidents over the past 16 months, 14 are known to involve speeding. This problem is
further complicated by the fact that half of these drivers had been drinking.
Of the other 11 accidents, 2 were hit and run, 2 related to interference
with drivers, 2 resulted from drivers admittedly diverting attention, one involved a
driver who lost control when cut off by another car, one involved possible lapse of
consciousness, and one mechanical failure. The remaining two were right -angle collisions

at intersections; one of these including a driverless car coasting down 23rd onto Irvine,
the other a right -of -way violation at Santa Isabel. Intuitively, we can suggest the two
hit- and -run incidents combined speeding and drinking. Therefore, it would seem that of
the accidents not recorded as directly related to speeding, only three would be amenable
to correction by physical or operational changes -- the 2 hit - and -runs, and the one cut
off by another.
In the remainder of this report, three principal alternatives will be discussed:
1. Modification of driver behavior
2. Improvement of street lighting
3. Redesign and reconstruction
MODIFICATION OF DRIVER BEHAVIOR
The conditions which result in the failures (accidents) of the small percentage
of drivers should be called out to all in order that the poor behavior of the few might
be modified; police surveillance and warning signs coming first to mind.
Before anything else is done, a large curve sign including an advisory speed
and flashing yellow beacon will be installed 500 feet south of Santa Isabel and ahead of
the curve where most of the trouble has occurred. This sign, unusual in our community,
should alert all but the most inattentive drivers.
A suggestion that STOP signs be installed on Irvine at Santa Isabel and at
23rd Street has been offered with the feeling that such signs would control speeds in
this area. The proposition has strong appeal -- if a driver reduces his speed to zero
twice along the way, it is held that he should be less likely to speed. However, in
view of the acceleration characteristics of present day automobiles, the curves in
questions could still be approached at unsafe speeds. For example, published performance
data indicate that an average Detroit auto can reach 50 mph in 440 feet. In testing
one of our own city vehicles, we find the Plymouth station wagon, certainly no competition
vehicle, requires only 350 feet to attain this speed.
The southbound curve north of Heather, where most of the trouble is focused,
is 800 feet from Santa Isabel; more than enough distance to overcome the effect of a full
stop. Considering this fact, and recognizing the types of drivers and vehicles involved
in accidents here, we could expect to see them continuing to power themselves into
trouble, in spite of having stopped -- if they did stop.
The suggestion has also been made that drivers would proceed at a slower
pace away from the first stop sign knowing the second stop was required shortly. This
idea is also compelling, however, a San Francisco study of the effectiveness of STOP signs
as speed control devices indicated the opposite effect in 1959. A summary of the study
is attached (Figure I). Since that time the average vehicle power -to- weight ratio has
increased while average driver ability probably has remained the same. It is now even
easier to go faster quicker.
In more prosaic terms, a STOP sign is a right -of -way control and should not
be used in attempts to control speed. Stopping Irvine at these minor street connections

could be anticipated to cause other accidents due to a combination of driver surprise at
an apparently unwarranted control, coupled with confusion resulting from predictable
failures to observe the regulation.
The STOP sign installations cannot be recommended at this time.
Traffic signals will be installed at these locations when cross traffic
increases. However, on the basis of recent observations, such installations are
probably 5 to 10 years off. (It should be noted that a signal will be installed within
the next few months at 22nd Street and Irvine.)
Of course, the time - honored method for changing driver behavior is police
enforcement. A moment's reflection, however, should reveal the challenge posed by the
desire to generate a quick and effective change. Most of the accidents occur during
light traffic periods. The effect of greater than normal visible patrolling of the
area during these periods would probably be lost on those found to have accidents. They
would likely be on the lookout for police vehicles and modify their arrival times rather
than their behavior. Many of these drivers would still see the street as a slalom,
challenging their skill and daring. There is good reason to feel that most of the
accidents which involve speeding are caused by intentional risk takers not especially
ready to restrain themselves except when they are under direct police observation.
We understand that the Police Department is already assigning this area a
high priority and in view of the total public safety needs, it may be unreasonable to
commit more manpower and equipment to this problem; however, the department might
continue to test the effectiveness of selective enforcement of the traffic rules
governing speed, lane changing, and headways in this general area. While it would seem
to be an almost impossible assignment, the situation calls for action. Perhaps the new
Police helicopters teamed with ground units could help meet the challenge.
IMPROVEMENT OF STREET LIGHTING
Street lights were installed along the westerly side of Irvine between
Santa Isabel and 23rd Street as part of the original residential property development,
some years ago. These fixtures are typical of those now installed only on local
neighborhood streets, not primary arteries such as Irvine Avenue. Therefore, the
existing street lights between Santa Isabel and 23rd should be replaced with new units
meeting our arterial illumination standards.
With almost three - quarters of the accidents occurring after dark, improved
lighting will provide greater traffic safety. However, unless special action is taken,
such upgrading would probably not take place for many years. Safety considerations argue
for advancing the schedule. The estimated cost of this street lighting improvement is
$10,000.00. The potential benefits of better lighting should not be dismissed lightly.
REDESIGN
Those drivers who choose to over -drive the curves could be accommodated by
reconstruction of the roadway to soften the effects of the curvature.

Design studies indicate that adding more superelevation to the existing curves,
in this area would not be productive. Within the limits available for increasing the
banking, only 2 or 3 mph increase in safe operating speed could be provided. For this
reason, realignment offers the only means of accommodating the speeders.
Several design changes seem possible; each bringing traffic into the trouble
zone on a flatter curve:
1. Prohibition of parking and relocation of the southbound traffic lane line
would offer a minimal improvement in the operation or "feel" of the
principal trouble spot. This would move the traffic lane closer to the
curb in the curve just north of Heather; but would also provide a
tangent or straight portion between the two curves, thereby improving the
flow pattern. This change could be made within the current operations
budget.
2. Realignment of the median curb line and widening of the roadway would
permit a result somewhat similar to the restriping described in No. i
above; but, would retain curb parking in the area and maintain the
present separation from the residential frontage. This would require
employment of a contractor for about $9,000.00.
3. Widening the roadway into the median on the left in the first cuN.e. and
also moving the traffic lane to the right in the second curve would offer
better operational results than either No. 1 or No. 2 above (Contract cost
of $9,000.00,)
4. Two major redesigns and reconstruction on new right -of -way alignments
would be possible; one with 560 feet radii for $137,000.00; the other
with 800-feet radii for $251,000.00.

Another suggestion which might be offered is to use barrier guard rails through
the curves. In view of the accident experience here, such installation would seem to
offer marginal benefit at best, and could be expected to increase the severity of certain
accidents. Greater benefit would come from other changes described above. If guard rails
were to be considered necessary, the realignment of traffic lanes and reshaping of the
median island would preclude placement of the barrier without acquisition of considerable
added right -of -way.
In terms of guard rails, another solution would call for construction of a
barrier to prevent errant vehicles from running onto existing private residential
properties. Such hopes could only be supported by construction of a substantial barrier
completely isolating the properties from the street traffic and provision of a totally
new alignment for Irvine with frontage road treatment for a considerable distance. The
nature and severity of the problem doesn't seem to warrant such heroic measures.

Three proposals to provide greater traffic safety on Irvine near Heather Lane
are available for immediate action:
1. Install curve sign and flashing beacon 500 feet south of Santa Isabel.
(As previously noted, the Public Works Department is proceeding to install
the sign and beacon).
2. Investigate the effectiveness of more intensive traffic law enforcement.
3. Include for Council consideration in the 1971 -72 budget, a project to
provide improved street lighting.
As a second step, the alignment for southbound vehicles can be improved by
utilizing the entire roadway surface and relocating the traffic lane line through the
curves just north of Heather. This change will require prohibition of curb parking
along the southerly curve. But, as the petitioning residents have said, they do not
park there now.
Finally, because reconstruction on a completely new alignment would be
expensive ($137,000.00 to $251,000.00), we should evaluate the effects of the first stage
improvements. Traffic accident and operation studies and police activity reports should
be prepared at three -month intervals, over a year's time. If the warning device, more
intensive enforcement, and possible restriping prove ineffective in curbing the accidents,
serious consideration of redesign and reconstruction would then be in order.

In 1959, in connection with a

RECOMMENDATIONS:
1. Approve the Plans and Specifications.
2. Authorize the City Clerk to advertise for bids to be
opened at 10:00 A.M. on June 30, 1972,
DISCUSSION:
This contract will provide for widening of 550 foot length of the southbound
roadway of Irvine Avenue northerly of Heather Lane and installation of a metal beam
barrier along the median side of the widened roadway.
It is anticipated that the drivers who ignore the warning signs and over-
drive the curves could be accommodated by the additional roadway width provided. In
addition, the barrier will serve to prevent errant vehicles from crossing the median.
The estimated cost of the work is $8,000.00.
The plans were prepared by the city. The estimated date of completion is
August 10, 1972.
An addition to the 1972 -73 Budget will be required. Sufficient unappro-
priated funds are available from the State Gas Tax Fund (2107). A budget amendment
will be presented for Council consideration at the time of award of the contract.

DISCUSSION:
Six bids for Contract No. 1445 were received and opened in the office of the
City Clerk at 10:00 A.M. on June 30, 1972.
The low bid is 9% below the engineers estimate of $8,000.00.

DISCUSSION:
The contract for improvements to Irvine Avenue northerly of Heather
Lane has been completed to the satisfaction of the Public Works Department.
The bid price was: $7,520.00
Amount of unit price items constructed: $8,149.30
Amount of change orders: none
Total contract cost: $8,149.30
Amount budgeted in Account No. 18- 3329 -081: $8,000.00
The increase in the cost of the unit price items constructed was due
primarily to the need for additional asphalt concrete paving material. A
budget amendment has been submitted to cover the additional costs. Funds are
available in the unappropriated Gas Tax Account.
The contractor is Moses Galluzzo of Santa Ana, California.
The contract date of completion was September 1, 1972. The work was
completed by August 22, 1972.
The engineering was performed by the Public Works Department.

NOTICE INVITING BIDS
SEALED BIDS will be received at the office of the City Clerk, City Hall, Newport Beach,
California, until 10:00 A.M. on the 30th day of June , 19 72,
at which time they will— opened and read, for performing work as fol ows:

Bids must be submitted on the proposal form attached with the contract documents furnished
by the Public Works Department. The additional copy of the proposal form is to be
retained by the bidder for his records.
Each bid must be accompanied by cash, certified check or Bidder's Bond, made payable
to the City of Newport Beach, for an amount equal to at least 10 percent of the amount
bid.
The title of the project and the words "SEALED BID" shall be clearly marked on the
outside of the envelope containing the bid.
The contract documents that must be completed, executed, and returned in the sealed bid
are:

D. Non - collusion Affidavit
E. Statement of Financial Responsibility
F. Technical Ability and Experience References
These documents shall be affixed with the signature and titles of the persons signing
on behalf of the bidder. For corporations, the signatures of the President or Vice
President and Secretary or Assistant Secretary are required and the Corpora e Seal shall
e�affi-xed to all documents requiring signatures. In the case of a Partnership, the
signature of at least one general partner is required.
No bids will be accepted from a contractor who has not been licensed in accordance with
the provisions of Chapter 9, Division III of the Business and Professions' Code. The
contractor shall state his license number and classification in the proposal.
One set of plans and contract documents, including special provisions, may be obtained
at the Public Works Department, City Hall, Newport Beach, California, at no cost to
licensed contractors. It is requested that the plans and contract documents be returned
within 2 weeks after the bid opening.

The city has adopted the Standard Specifications for Public Works Construction (1970
edition and supplements) as preparea by the Southern California Chapters of the American
Public Works Association and the Associated General Contractors of America. Copies
may be obtained from Building News, Inc., 3055 Overland Avenue, Los Angeles, California
90034, (213) 870 -9871.
The city has adopted Standard Special Provisions and Standard Drawings. Copies of these
are available at the Public Works Department at a cost of $3.00 per set.
In accordance with the provisions of Article 2, Chapter 1, Part 7 of the California
Labor Code (Sections 1770 et seq.), the City Council of the City of Newport Beach has
ascertained the general prevailing rate of per diem wages in the locality in which the
work is to be performed for each craft, classification, or type of workman or mechanic
needed to execute the contract and has set forth these items in Resolution No. 7718
adopted June 12, 1972. A copy of said resolution is available in the office of the
City Clerk. All parties to the contract shall be governed by all provisions of the
California Labor Code relating to prevailing wage rates (Sections 1770 -1781 inclusive)
The city reserves the right to reject any or all bids and to waive any informality in
such bids.

All bids are to be computed on the basis of the given estimated quantities of work,
as indicated in this Proposal, times the unit price as submitted by the bidder. In case
of a discrepancy between words and figures, the works shall prevail. In case of an error
in the extension of a unit price, the corrected extension shall be calculated and the bids
will be computed as indicated above and compared on the basis of the corrected totals.
The estimated quantities of work indicated in this Proposal are approximate only,
being given solely as a basis for comparison of bids.
The undersigned has checked carefully all of the above figures and understands that
the City will not be responsible for any errors or umissiors on the part of the under-
signed in making up this bid.
The undersigned agrees that in case of default in executing the required contract
with necessary bonds within ten (10) days, not including Saturday, Sunday and Federal
Holidays, after having received notice that the contract is ready for signature, the
proceeds of check or bond accompanying this bid shall become the property of the City
of Newport Beach.

City, party of the first part, and MOSES GALLUZZO
hereinafter designated as the Contractor, party of the second part.
WITNESSETH-, That the parties hereto do mutually agree as follows-
1. For and in consideration of the payments and agreements hereinafter mentioned
to be made and performed by the City, the Contractor agrees with the City to furnish all
materials and labor for the construction of
IRVINE AVENUE IMPROVEMENTS (STA. 27+64.64 TO STA. 33+71.10) CONTRACT NO. 1445
and to perform and complete in a good and workmanlike manner all the work pertaining
thereto shown on the Plans and Specifications therefor; to furnish at his own proper
cost and expense all tools, equipment, labor, and materials necessary therefor, (Except
such materials, if any, as in the said Specifications are stipulated to be furnished by
the City), and to do everything required by this Agreement and the said Plans and
Specifications.
2. For furnishing all said materials and labor, tools and equipment, and doing
all the work contemplated and embraced in this Agreement, also for all loss and damage
arising out of the nature of the work aforesaid, or from the action of the elements,
or from any unforeseen difficulties which may arise or be encountered in the prosecu-
tion of the work until its acceptance by the City, and for all risks of every description
connected with the work; also, for all expenses incurred by or in consequence of the
suspension or discontinuance of work, except such as in said Specifications are expressly
stipulated to be borne by the City, and for well and faithfully completing the work
and the whole thereof, in the manner shown and described in the said Plans and
Specifications, the City will pay and the Contractor shall receive in full compensation
therefore the lump sum price, or if the bid is on the unit price basis, the total price
for the several items furnished pursuant to the Specifications, named in the bidding
sheet of the Proposal, as the case may be.
3. The City hereby promises and agrees with the said Contractor to employ, and
does hereby employ the said Contractor to provide the materials and to do the work
according to the terms and conditions herein contained and referred to for the price
aforesaid, and hereby contracts to pay the same at the time, in the manner, and upon
the conditions set forth in the Specifications, and the said parties for themselves,
their heirs, executors, administrators, successors and assigns, do hereby agree to
the full performance of the covenants herein contained.
4. The Notice to Bidders, Instructions to Bidders, Contractor's Proposal, and the
Plans and Specifications, and all amendments thereof, when approved by the parties
hereto, or when required by the City in accordance with the provisions of the Plans and
Specifications, are hereby incorporated in and made part of this Agreement.

5. Pursuant to the Labor Code of the State of California, the City Council has
ascertained the general prevailing rates of per diem wages for each craft or type of
workman needed to execute the contract and a schedule containing such information is
included in the Notice Inviting Bids and is incorporated by reference herein.
6. The Contractor shall assume the defense of and indemnify and save harmless the
City, the Director of Public Works, and their officers and employees, from all claims,
loss, damage, injury, and liability of every kind, nature, and description, directly or
indirectly arising from the performance of the contract or work, regardless of responsi-
bility for negligence; and from any and all claims, loss, damage, injury, and liability,
howsoever the same may be caused, resulting directly or indirectly from the nature of
the work covered by the contract, regardless of responsibility for negligence.

WHEREAS, pursuant to the notice inviting bids for work
in connection with the improvement of Irvine Avenue northerly of
Heather Lane, in accordance with the plans and specifications
heretofore adopted, bids were received on the 30th day of June,
1972, and publicly opened and declared; and
WHEREAS, it appears that the lowest responsible bidder
therefor is MOSES GALLUZZO, of Santa Ana;
NOW, THEREFORE, BE IT RESOLVED by the City Council of

All bids are to be computed on the basis of the given estimated quantities of work,
as indicated in this Proposal, times the unit price as submitted by the bidder. In case
of a discrepancy between words and figures, the works shall prevail. In case of an error
in the extension of a unit price, the corrected extension shall be calculated and the bids
will be computed as indicated above and compared on the basis of the corrected totals.
The estimated quantities of work indicated in this Proposal are approximate only,
being given solely as a basis for comparison of bids.
The undersigned has checked carefully all of the above figures and understands that
the City will not be responsible for any errors or omissions on the part of the under-
signed in making up this bid.
The undersigned agrees that in case of default in executing the required contract
with necessary bonds within ten (10) days, not including Saturday, Sunday and Federal
Holidays, after having received notice that the contract is ready for signature, the

NOTICE INVITING BIDS
SEALED BIDS will be received at the office of the City Clerk, City Hall, Newport Beach,
California, until 10:00 A.M. on the 30th day of June 19 72,
at which time they will be opened and read, for performing work as follows:

Bids must be submitted on the proposal form attached with the contract documents furnished
by the Public Works Department. The additional copy of the proposal form is to be
retained by the bidder for his records.
Each bid must be accompanied by cash, certified check or Bidder's Bond, made payable
to the City of Newport Beach, for an amount equal to at least 10 percent of the amount
bid.
The title of the project and the words "SEALED BID "shall be clearly marked on the
outside of the envelope containing the bid.
The contract documents that must be completed, executed, and returned in the sealed bid
are:

These documents shall be affixed with the signature and titles of the persons signing

signature of at least one general partner is required.
No bids will be accepted from a contractor who has not been licensed in accordance with

The city has adopted Standard Special Provisions and Standard Drawings. Copies of these
are available at the Public Works Department at a cost of $3.00 per set.
In accordance with the provisions of Article 2, Chapter 1, Part 7 of the California
Labor Code (Sections 1770 et seq.), the City Council of the City of Newport Beach has
ascertained the general prevailing rate of per diem wages in the locality in which the
work is to be performed for each craft, classification, or type of workman or mechanic
needed to execute the contract and has set forth these items in Resolution No. 7718
adopted June 12, 1972. A copy of said resolution is available in the office of the
City Clerk. All parties to the contract shall be governed by all provisions of the
California Labor Code relating to prevailing wage rates (Sections 1770 -1781 inclusive).
The city reserves the right to reject any or all bids and to waive any informality in
such bids.

IRVINE AVENUE IMPMEMENTS (STA 27+54.64 TO STA, 33 +71.10) CONTRACT 1445_
in the City of Newport Beach, in strict conformity with the Drawings and Specifications
and other contract documents on file in the office of the City Clerk.
WHEREAS, said Principal has executed or is about to execute said contract and the
terms thereof require the furnishing of a bond with said contract, providing that if
said Principal or any of his or its subcontractors, shall fail to pay for any materials,
provisions, provender, or other supplies or teams used in, upon, for, or about the per-
formance of the work agreed to be done, or for any work or labor done thereon of any

Code with respect to such work or labor, that the Surety or Sureties will pay for the same,
in an amount not exceeding the sum specified in the bond, and also, in case suit is brought

City, party of the first part, and MOSES GALLUZZO
hereinafter designated as the Contractor, party of the second part.
WITNESSETH, That the parties hereto do mutually agree as follows,
1. For and in consideration of the payments and agreements hereinafter mentioned
to be made and performed by the City, the Contractor agrees with the City to furnish all
materials and labor for the construction of
IRVINE AVENUE IMPROVEMENTS (STA. 27+64.64 TO STA. 33+71.10) CONTRACT NO. 1445
and to perform and complete in a good and workmanlike manner all the work pertaining
thereto shown on the Plans and Specifications therefor; to furnish at his own proper
cost and expense all tools, equipment, labor, and materials necessary therefor, (Except
such materials, if any, as in the said Specifications are stipulated to be furnished by
the City), and to do everything required by this Agreement and the said Plans and
Specifications.
2. For furnishing all said materials and labor, tools and equipment, and doing
all the work contemplated and embraced in this Agreement, also for all loss and damage
arising out of the nature of the work aforesaid, or from the action of the elements,
or from any unforeseen difficulties which may arise or be encountered in the prosecu-
tion of the work until its acceptance by the City, and for all risks of every description
connected with the work; also, for all expenses incurred by or in consequence of the
suspension or discontinuance of work, except such as in said Specifications are expressly
stipulated to be borne by the City, and for well and faithfully completing the work
and the whole thereof, in the manner shown and described in the said Plans and
Specifications, the City will pay and the Contractor shall receive in full compensation
therefore the lump sum price, or if the bid is on the unit price basis, the total price
for the several items furnished pursuant to the Specifications, named in the bidding
sheet of the Proposal, as the case may be.
3. The City hereby promises and agrees with the said Contractor to employ, and
does hereby employ the said Contractor to provide the materials and to do the work
according to the terms and conditions herein contained and referred to for the price
aforesaid, and hereby contracts to pay the same at the time, in the manner, and upon
the conditions set forth in the Specifications; and the said parties for themselves,
their heirs, executors, administrators, successors and assigns, do hereby agree to
the full performance of the covenants herein contained.
4. The Notice to Bidders, Instructions to Bidders, Contractor's Proposal, and the
Plans and Specifications, and all amendments thereof, when approved by the parties
hereto, or when required by the City in accordance with the provisions of the Plans and
Specifications, are hereby incorporated in and made part of this Agreement.

5. Pursuant to the Labor Code of the State of California, the City Council has
ascertained the general prevailing rates of per diem wages for each craft or type of
workman needed to execute the contract and a schedule containing such information is
included in the Notice Inviting Bids and is incorporated by reference herein.
6. The Contractor shall assume the defense of and indemnify and save harmless the
City, the Director of Public Works, and their officers and employees, from all claims,
loss, damage, injury, and liability of every kind, nature, and description, directly or
indirectly arising from the performance of the contract or work, regardless of responsi-
bility for negligence; and from any and all claims, loss, damage, injury, and liability,
howsoever the same may be caused, resulting directly or indirectly from the nature of
the work covered by the contract, regardless of responsibility for negligence.

SUBJECT: IMPROVEMENT IF IRVINE AVENUE NORTHERLY OF HEATHER LANE (CONTRACT 1445)
RECOMMENDATION:
Adopt a resolution awarding Contract No. 1445 to Moses Galluzzo
for $7,520.00 and authorizing the Mayor and City Clerk to execute
the contract.
DISCUSSION:
Six bids for Contract No. 1445 were received and opened in the office of the
City Clerk at 10:00 A.M. on June 30, 1972.
The low bid is 9% below the engineers estimate of $8,000.00.
This contract provides for the widening of a 550 foot length of the southbound
roadway of Irvine Avenue northerly of Heather Lane and installation of a metal beam barrier
along the median side of the widened roadway. The estimated completion date is August 10,
1972. The plans were prepared by the city.
Although Moses Galluzzo has not previously done work for the City of Newport
Beach, a check of the references supplied indicates that the firm is qualified to perform
the work required by this contract.
A budget amendment to the gas tax fund in the amount of $8,000 has been
prepared for Council consideration.

SUBJECT: IMPROVEMENT OF IRVINE AVENUE NORTHERLY OF HEATHER LANE (CONTRACT 1445)
RECOMMENDATIONS:
1. Approve the Plans and Specifications.
2. Authorize the City Clerk to advertise for bids to be
opened-at 10:00 A.M. on June 30, 1972.
DISCUSSION:
This contract will provide for widening of 550 foot length of the southbound
roadway of Irvine Avenue northerly of Heather Lane and installation of a metal beam
barrier along the median side of the widened roadway.
It is anticipated that the drivers who ignore the warning signs and over-
drive the curves could be accommodated by the additional roadway width provided. In
addition, the barrier will serve to prevent errant vehicles from crossing the median.
The estimated cost of the work is $8,000.00.
The plans were prepared by the city. The estimated date of completion is
August 10, 1972.
An addition to the 1972 -73 Budget will be required. Sufficient unappro-
priated funds are available from the State Gas Tax Fund (2107). A budget amendment
will be presented for Council consideration at the time of award of the contract.
