BETWEEN
COUNTY OF ORANGE AND CITY OF NEWPORT BEACH
BEACH EROSION CONTROL PROJECT, STAGE 4A

THIS AGREEMENT is made and entered into this _11d day of

by and between the COUNTY OF ORANGE, a political subdivision of the State
of California, hereinafter called "COUNTY" and the CITY OF NEWPORT BEACH, a
.municipal corporation, hereinafter called "CITY '.
WHEREAS, Congress has by the enactment of Public Law 874, 87th Congress,

adopted and authorized a beach erosion control project which extends from
Anaheim Bay Harbor to the West Jetty of Newport Beach Harbor in Orange County;
and
and
WHEREAS, the aforesaid project is financed on the following basis:
Federal Government 67%
State of California (Department 162%
of Water Resources)
Shoreline Owners both public and
private, including State Division
of Beaches and Parks lbz%
100%
WHEREAS, the COUNTY has advanced $115,180 as the share for all city and
shoreline owners for Stage 4A construction not including State Division of
Beaches and Parks; and
WHEREAS, the shoreline owners' share of the cost for Stage 4A construction,
based on the formula used for Phase I, is as follows:
Private beach owners: Huntington Pacific Corporation
Surfside Colony, Ltd.
Public beach owners: City of Newport Beach
City of Huntington Beach
County (Sunset Beach)
County (50% for locally
owned public beach)

NOW, THEREFORE, the parties hereto mutually agree as follows:
1. The CITY agrees to pay the COUNTY upon demand the sum of $19,260.00
which represents the CITY'S contribution towards the cost of Stage 4A of the
aforesaid beach erosion control project.
2. The COUNTY agrees to furnish to the CITY an accounting of the expenditures
of all funds received for Stage 4A of the aforesaid project, and to refund to the
CITY its pro rata share of any - refunds received of monies advanced in excess of
actual costs within thirty (30) days after receipt thereof by the COUNTY.
IN WITNESS WHEREOF, the parties hereto executed this Agreement as of the
date first above written.

A RESOLUTION OF THE CITY COUNCIL
OF NEWPORT BEACH AUTHORIZING THE

WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and the County of Orange for the contribution
of costs in connection with Stage 4A of the beach erosion control
project; and
WHEREAS, the City Council has considered the terms and
conditions of said agreement and found them to be fair and
equitable;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said agreement for the contribution
of costs above described is approved, and the Mayor and City Clerk
are hereby authorized and directed to execute the same on behalf
of the City of Newport Beach.
