THIS AGREEMENT, entered into this / ,/-/ day of pc r03E/2
1972, by and between the ORANGE COUNTY" TRANSIT DISTRICT, hereinafter
referred to as "DISTRICT ", and the CITY OF NEWPORT BEACH, hereinafter
referred to as "CITY ",
W I T N E S S E T H
a WHEREAS, CITY is desirous of having safe, reliable, and econ
9 public transportation services provided to its citizens; and
10i WHEREAS, DISTRICT has the authority to establish and operate
"!I services; and
WHEREAS, CITY wishes such services to be provided by DISTRICT
within CITY:
1* NOW, THEREFORE, the parties hereto agree as follows:

Zi15 1. CITY agrees to facilitate the operation of buses within CITY

0 0161 by establishing and marking bus stop zones upon approval by the City

00171 Council, installing and maintaining bus stop signs, removing hazards

18 such as tree limbs, cooperating in the emplacement of benches at
19 designated bus steps, and including DISTRICT informational material in

CITY utility bill mailings.

2. Bus stop signs and promotional material shall be provided

to
CITY when deemed appropriate by DISTRICT, and shall be provided at
23
no
expense to CITY.

3. DISTRICT agrees to consult with CITY regarding schedules,
25
routes,
and fares of bus lines wholly or partly within CITY.

4. Excepting responsibilities of CITY specified in paragraphs
27
1
and 2, DISTRICT agrees to bear the financial burden for operating
28
bus
lines wholly or partly within CITY.

FOR BUS SERVICES WITHIN THE CITY

OF NEWPORT
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of .Newport Beach and the Orange County Rapid Transit
District for bus services within the City of Newport Beach;
and
WHEREAS, the City Council has considered the terms
and conditions of said Agreement and found them to be fair
and equitable;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said agreement for the ser-
vices above described is approved, and the Mayor and City
Clerk are hereby authorized and directed to execute the same
on behalf of the City of Newport Beach.
