Enclosed please find the original plus 3 copies of
an Amendment to the employment agreement between .
the City of Newport Beach and Bud Porter. Section IV
of the original agreement has been amended to reflect
the increase in your fee as requested, in your letter
to Bob Wynn dated May 31, 1974. In addition, a
provision has been added requiring monthly reporting
of legislation of particular interest to the City.
Please sign the original and all copies of the docu-
ment and return them to this office so that we may
obtain the signatures of the Mayor and City Clerk.
A fully executed copy will be forward to you for
your files when the agreement has been processed.

Dear Bob:
As I indicated to you recently over the telephone, I would
very much appreciate the City's consideration of a modest
increase in my contract for the fiscal year 1974 -75.

Travel, living and administrative expenses have increased
over the past two years by aDme 20% to 30% and these increases,
of course, cannot be absorbed under my present agreement
with the City.
I hope it would appear reasonable to increase our 1974 -75
contract by 20%. This could be accomplished by increasing
the monthly retainer from $250 to $300 and the monthly
expense reimbursible allowance from $250 to $300. I would
sincerely appreciate your favorable consideration of this
increase.

OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
AN AMENDMENT TO AN AGREEMENT BETWEEN THE CITY
OF NEWPORT BEACH AND CHARLES E. "BUD" PORTER
FOR LEGISLATIVE ADVOCATE SERVICES
WHEREAS, the City of Newport Beach and Charles E.
"Bud" Porter have entered into an agreement for legislative
advocate services dated August 31, 1972; and
WHEREAS, the City and Bud Porter desire to amend
said agreement to increase Porter's compensation and reimburse-
ment for expenses, and to provide for monthly reporting on
legislative of interest to the City; and
WHEREAS, the City Council has reviewed the terms
and conditions of said amendment and found them to be fair
and equitable;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that the above described Amendment
to Agreement is hereby approved and the Mayor and City Clerk
are hereby authorized to execute the same on behalf of the
City of Newport Beach.

AMENDMENT TO AGREEMENT
FOR
LEGISLATIVE ADVOCATE SERVICES
THIS AMENDMENT TO AGREEMENT, made and entered into
by and between the CITY OF NEWPORT BEACH, a municipal corpora-
tion, hereinafter referred to as "City ", and CHARLES E. "BUD"
PORTER, hereinafter referred to as "Porter ";
RECITALS
WHEREAS, City and Porter have entered into an
agreement for legislative advocate services dated August 31,
1972; and
WHEREAS, City and Porter desire to amend said agree-
ment to increase Porter's compensation and reimbursement for
expenses, and to provide for monthly reporting on legislation
of interest to City;
NOW, THEREFORE, in consideration of the services
provided by Porter and the fees paid by City to Porter for
said services, it is mutually agreed by and between the parties
as follows:

Paragraph IV of the Agreement between City and Porter
dated August 31, 1972, is hereby amended to read as follows:
"City agrees to compensate Porter at the rate of
$300 per month. City further agrees to reimburse Porter
for expenses incurred in the performance of his duties
under this Agreement. Such expenses may not be incurred
without prior approval of City, and shall not exceed
$300 per month."

10th day of each month, summarizing legislative activities of

THIS AGREEMENT, made and entered into by and between
the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter
referred to as "CITY," and CHARLES E. "BUD" PORTER, hereinafter
referred to as "PORTER:"
W I T N E S S:
WHEREAS, CITY desires constant representation before
the State legislature and other State agencies to promote and
protect the interests of the City of Newport Beach before those
bodies; and
WHEREAS, the services of a legislative advocate are
necessary and desirable to perform such functions; and
WHEREAS, CITY has previously employed PORTER as a
legislative advocate; and
WHEREAS, CITY has determined that PORTER is well
qualified to perform said services; and
WHEREAS, CITY desires to retain PORTER to represent
CITY to protect and promote the best interests of the City of
Newport Beach;
NOW, THEREFORE, IT IS MUTUALLY AGREED by and between
the parties as follows:

CITY hereby retains and employs PORTER to act as
legislative advocate for the CITY to perform those functions set
forth in Paragraph III herein.
II
PORTER agrees to coordinate his activities with the
staff of CITY, to keep the City Council of CITY fully informed
of all developments in connection with matters which may be of

interest to CITY, and to submit to the City Council a bi- weekly
report of the status of such matters.
III
The scope of services of this Agreement shall include
but not be limited to the following:
A. Analysis and representation in connection with
legislative and administrative proposals affecting highway and
freeway developments in the area of the City of Newport Beach.
B. Analysis and representation on legislative and
administrative proposals affecting airport uses in the area of
the City of Newport Beach,
C. Analysis and representation on major legislative
tax proposals which have a bearing on the financial structure
and functions of the City of Newport Beach.
D. Analysis, investigative research and representation
in connection with proposed and existing legislation which affects
the use of tidelands and other water areas.
E. Analysis and representation in connection with
such other legislative and administrative proposals as the
parties ascertain have an effect upon the City of Newport Beach.
IV
CITY agrees to compensate PORTER at the rate of $250.00
per month. CITY further agrees to reimburse PORTER for expenses
incurred in the performance of his duties under this Agreement.
Such expenses may not be incurred without prior approval of CITY,
and shall not exceed $250.00 per month.
V
This Agreement shall remain in force and effect until
June 30, 1973. Renewal thereafter for additional periods of one
year each shall be automatic. CITY reserves the right to terminate

this Agreement at any time. In the event CITY exercises its right
of termination, it shall be liable to pay PORTER only for ser-
vices and expenses incurred prior to the receipt of the notice
of termination.
VI
This Agreement may be modified, altered or amended pro-
vided that a written instrument containing such modifications,
alterations or amendments be executed by the parties hereto.
IN WITNESS WHEREOF the parties hereto have set their
hands the day and year as is written below.
