A G R E E M E N T
OFFER OF DEDICATION AND MEMORANDUM OF UNDERSTANDING
THIS AGREEMENT, made and entered into this 7,f_ day
of dyiiU .5 %' , 1972, by and between the CITY OF NEWPORT
BEACH, a municipal corporation, hereinafter referred to as "CITY"
and NEWPORT HARBOR COMMUNITY YOUTH CENTER, a non - profit corporation,
hereinafter referred to as "YOUTH CENTER;"
W I T N E S S E T H:
WHEREAS, the Youth Center was formed as a non - profit
corporation for the purpose of construction, maintenance and
improvement of certain buildings and grounds for the recreational
use of the young people of the City of Newport Beach; and
WHEREAS, said buildings and recreational facilities are
located partially on property owned by the Newport -Mesa Unified
School District, known as a portion of the Harbor View school
property, and partially by the City of Newport Beach, located
adjacent to the school property, both of said parcels lying
northerly of Fifth Avenue between Goldenrod Avenue, Harbor
View Elementary School and the northerly extension of Jasmine
Avenue, more particularly described and depicted in the attached
legal description and plot plan marked Exhibits "A" and "B"
respectively which are made a part herein by this reference; and
WHEREAS, Youth Center has constructed various improve-
ments on the school property, including a Youth Center building,
a food concession building, a combination restroom-storage
building, two Boy Scout buildings, a baseball diamond with
lighting facilities, a basketball court, two backboards, a
chain -link fence, a water sprinkler system, playground apparatus

for small children, and other miscellaneous recreational facilities;
and
WHEREAS, Youth Center has also constructed recreational
facilities on the City -owned property including tennis courts and
light standards; and
WHEREAS, it would be to the mutual advantage of both
parties and the public to use the above - described school property
and the City -owned property as a unit for park and recreational
purposes; and
WHEREAS, the Board of Directors of the Youth Center
wishes to dissolve as an entity;
NOW, THEREFORE, IN CONSIDERATION of their mutual promises
the parties hereto agree as follows:
1. Youth Center will convey, transfer, and assign
all of its right, title and interest to all buildings, facilities
and improvements located on the City -owned property and on the
Harbor view School property to the City under the following
conditions as set forth in this memorandum of understanding:
A. That the name of Grant Howald Park will
be retained as the official designation for the
facility.
B. That the Youth Center will be operated
under the same philosophies and policies as in
the past, i.e., youth activities having first
priority, and adult activities having second
priority.
C. That a storage area for the Lions Club
will be retained underneath the main building,
in the athletic field restroom building and in
the former office of the main building.

D. That Boy Scout Troop 17 and Troop 308
shall have first priority for the use of the two
Scout house facilities.
IN WITNESS WHEREOF, the parties have hereunto set their
hand the day and year first above written.

Beginning at the intersection of the center line of Goldenrod
Avenue (formerly Thirty -third Avenue) with the northeasterly boundary
line of Corona del Mar Tract, as Thirty -third Avenue and the said
northeasterly boundary line are shown on a map of Corona del Mar
recorded in Book 3, pages 41 and 42 of Miscellaneous Maps, records
of Orange County, California; thence North 320 27' 08" East 191.55
feet; thence South 500 14' 20" East 967.50 feet to a point distant
North 520 34' 20" East 194.85 feet from the intersection of the
center line of Jasmine Avenue (formerly Thirty -sixth Avenue) with
the northeasterly boundary line of said Corona del Mar as said
Thirty -sixth Avenue and northeasterly line are shown on said map;.
thence South 52 34' 20" West 194.85 feet; thence along the said
northeasterly boundary of Corona del Mar to the point of beginning.
RESERVING THEREFROM for road, drainage and utility purposes the
following described parcels:
1. A strip of land 30 feet in width along the entire
northwesterly and southeasterly boundaries of the
above described parcel.
2. A strip of land 35 feet in width along the entire
southwesterly boundary of the above described parcel.
The intersection of the inside lines of the above described
strips of land on the northwesterly and southwesterly side lines with
the strip of land on the southwesterly side line to be rounded off
with curves tangent to said inside lines and having a radius of 20 feet.
Containing 4.07 acres.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
AN AGREEMENT ENTITLED "AN OFFER OF DEDICATION
AND MEMORANDUM OF UNDERSTANDING" DEDICATING
THE COMMUNITY YOUTH CENTER FACILITIES TO THE
CITY OF NEWPORT BEACH
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and the Newport Harbor Community Youth
Center, entitled "An Offer of Dedication and Memorandum of
Understanding ", dedicating the Community Youth Center facilities
to the City of Newport Beach; and
WHEREAS, the City Council has considered the terms and
conditions of said agreement and found them to be fair and
equitable;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said agreement above described is
approved, and the Mayor and City Clerk are hereby authorized and
directed to execute the same on behalf of the City of Newport
Beach.
ADOPTED this 28th day of August, 1972.
