AGREEMENT FOR ENGINEERING SERVICES
(Design of Zone V Pumping Station
for Harbor View Hills, Sector IV)
THIS AGREEMENT is made and entered into this`t
day of �!.��� �_ 1972, by and between the CITY OF NEWPORT
BEACH, a municipal corporation hereinafter referred to as "CITY,"
and the firm of RAUB, BEIN, FROST AND ASSOCIATES, Civil Engineers,
hereinafter referred to as "ENGINEER."
WHEREAS, CITY proposes to provide domestic water ser-
vice to a hillside area known as Harbor View Hills, Sector IV,
which is partially located in three water pressure zones (Master
Plan Zones III, IV and V); and
WHEREAS, engineering services are necessary to design
and prepare plans and specifications for a pumping station to
deliver domestic water to the water pressure Zone V portion of
Harbor View Hills, Sector IV; and
WHEREAS, ENGINEER has submitted a proposal to design
and prepare plans and specifications for the proposed pumping
station.
NOW, THEREFORE, the parties hereto agree as follows:
1. General
CITY engages ENGINEER to furnish the services
hereinafter specified for the compensation herein stipulated,
and ENGINEER agrees to perform such services upon said terms.
2. Duties of Engineer
ENGINEER SHALL:
A. Investigate alternative designs (above ground
and below ground) for the pump station located adjacent to Spy-
glass Hill Reservoir. This investigation shall be based upon

the following two general operating conditions:
1. Provisions for a domestic water service
to a closed system serving the water pressure
Zone V service area to Harbor View Hills,
Sector IV.
a. Suction from Spyglass Hill Reservoir.
b. Suction directly from the Zone IV
main while Spyglass Hill Reservoir is out
of service.
2. Conversion with only minor modification
to provide pumping capability of 1,500 GPM to a
potential Zone V storage reservoir, including an
allowance for a Zone V transmission loss of 40 PSI.
The elevation established for the Zone V reservoir
will include an allowance of about 10 feet for head
losses when supply is from only the ZoneiV reser-
voir.
B. Investigate the potential use of both vertical
and horizontal pumps driven by electric motors, and recommend the
types, capacities and the number of pumps required to meet the
operating conditions.
C. After selection of a design concept in consul-
tation with CITY, prepare detailed plans and specifications for
construction of the pump station including:
1. Provisions for operation of pump station
from the control building at Big Canyon Reservoir.
2. Coordination with utility companies to
provide service to the pump station.
3. Provisions for rapid external hookup of a
portable emergency generator in case of power failure.

4. Provisions for external hookup of a pumper
fire truck from Zone IV suction to Zone V dis-
charge line.
5. Provisions for connecting electrical
and telephone service of Spyglass Hill Reservoir
to the Zone V pump station.
6. Site preparation for items 1 through 5
above.
D. Perform all field surveys, if any, required
for the preparation of the plans and specifications.
E. Perform detailed checking of shop drawings
required in Item C.
F. Prepare a manual describing in detail the
operation of the Zone V pump station.
G. Provide consultation, as required, during the
construction of the Zone V pump station.
H. Consult and maintain liaison with CITY during
the engineering design project.

3. Duties of CITY
CITY agrees to provide ENGINEER with the following:

5. Payment by CITY
A. CITY agrees to pay ENGINEER for all services re-
quired under the provisions of this Agreement on the basis of
the hourly rate schedule set forth below, but not to exceed the
sum of Four Thousand Two Hundred Dollars ($4,200.00):

The hourly rates shown above will be subject to an eight percent
(8 %) increase each ensuing August 1, beginning August 1, 1973,
until completion of the project.
B. ENGINEER shall be compensated as follows:
1. Monthly partial payments shall be based upon
the amount earned in each month as determined by the fee schedule.
The sum of the monthly partial payments shall not exceed ninety
percent (900%) of the above maximum fee.
2. The balance of the total amount to be paid upon
acceptance of the construction work by the City Council but, in
any event, not later than twelve (12) months after the signing
of the plans by the Public Works Director.
C. CITY shall reimburse ENGINEER for the actual cost
of reproduction of copies of plans, specifications and related
documents and other related costs authorized by the Public Works
Director and advanced by Engineer.
6. Termination
This Agreement may be terminated at any time by
CITY upon three (3) days written notice to ENGINEER. Notice

shall be deemed served by placing a copy thereof in the United
States mail, postage prepaid, addressed to ENGINEER=S business
office. In the event of termination due to the fault of
ENGINEER, CITY shall be relieved of any obligation to com-
pensate ENGINEER. If this Agreement is terminated for any
reason other than the fault of ENGINEER, CITY agrees to com-
pensate ENGINEER for the actual services performed up to the
effective date of the notice of termination on the basis of
the fee schedule contained in this Agreement.
7. Amendment
The scope of services to be furnished by ENGINEER
may be changed and the maximum fee revised upon prior written
approval of the Public Works Director if the increase in the
maximum fee specified does not exceed $800.00.
If a change in the scope of services to be furnished
by ENGINEER would result in an increase in the specified maxi-
mum fee exceeding $800.00, a written amendment to this Agree-
ment providing for such change shall be prepared and executed
by the parties to the Agreement.
8. Assignment
This Agreement or any portion thereof shall not be
assigned without the written consent of CITY.
9. Hold Harmless
ENGINEER shall assume the defense of and indemnify
and save harmless the CITY, and its officers and employees,
from all claims, loss, damage, injury and liability, directly
arising from any errors, omissions, or negligence in ENGINEER'S
performance of this Agreement or from the engineering work and
services herein provided.

WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain engineering services
agreement between the City of Newport Beach and Raub, Bein, Frost
& Associates, Civil Engineers, to perform the design of c7ie Zone V
pumping station for Spyglass Hill; and
WHEREAS, the City Council has considered the to ms and.
conditions of said agreement and found them to be fair and
equitable;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said agreement for the engineering
services above described is approved, and the Mayor and City
Clerk are hereby authorized and directed to execute the su,.,: on
behalf of the City of Newport Beach.
