The undersigned, WILHELMINA D. BRUNNERg WALLACE M.
KINDELp, and JAMES H.. KINDELO JR., owners of certain real
property located in the State of California, County of Orange,
City of Newport Beach, more particularly described as Lots
72 and 73 of Tract No. 1011, as shown on a map recorded in
Book 36, pages 37-40 inclusive, of Miscellaneous Maps, records
of Orange County, hereby grant their permission to the City of
Newport Beach to use said property under the following terms
and conditions and for the following purposes:
10 To construct the Balboa, Coves Odor Reduction
System (Contract No. 1494), a noxious gas collection system.
2. This license to permit construction of the
Balboa Coves Odor Reduction System is irrevocable by owners
as. long as the subject property is leased to the Union Oil
Company, or until December 31, 1984, whichever occurs later.
The City retains the right to discontinue use of the system at
any time it is determined to be in the best interest of the City.
3. Subject to Paragraph 2 hereinabove, notice of
termination of this license must be in writing and served on
the City three (3) months in advance of the effective date of
such termination.
4. Upon termination of this license, the City will
be allowed to abandon the noxious gas collection system in place
and will not be required to remove same. P
5. This license shall be binding upon the heirs,
successors and assigns of the undersigned and shall be recorded • .
in the office of the County Recorder of Orange County.
In consideration of the license hereby granted, the
City of Newport Beach agrees to pay Wilhelmina D. Brunner,

Wallace M. Kindel, and James H. Kindel, Jr., the sum of one
dollar ($1000) per year.

RESOLUTION NO. 7 (i "'
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH ACCEPTING A GRANT
OF EASEMENT FROM THE BALBOA COVES HOME-
OWNERS' ASSOCIATION IN CONNECTION WITH
THE BALBOA COVES ODOR REDUCTION SYSTEM
WHEREAS, the City Council of the City of Newport
Beach has directed the staff to install an odor reduction
system in the Balboa Coves area; and
WHEREAS, part of said odor reduction system will
be installed on private property owned by the Balboa Coves
Homeowners' Association; and
WHEREAS, the Balboa Coves Homeowners' Association
has indicated a willingness to grant the City an easement
over said private property for the purpose of installation
of said odor reduction system; and
WHEREAS, the City Council has determined that it
would be in the best interest of the City to accept the grant
of easement in order to allow the City to proceed with the
installation of said odor reduction system;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said grant of easement is
hereby accepted, and the City Clerk is authorized and directed
to execute and attach thereto a Certificate of. Acceptance and
consent to its recording and to cause said document to be
recorded in the Orange County Recorder's office.
