H -2 (e) SUBJECT: AGREEMENT FOR ENGINEERING SERVICES -- BAYSIDE DRIVE IMPROVEMENTS (STREET, STORM DRAIN, WATER, AND SEWER) FROM NEWPORT BAY TO MARGUERITE AVENUE - -FINAL DESIGN RECOMMENDATION: Adopt a resolution authorizing the Mayor and City Clerk to execute the subject agreement with Shuirman- Simpson, Consulting Civil Engineers for the final design of the subject improvements. DISCUSSION: On August 13, 1973 the Council authorized the staff to obtain a proposal from Shuirman- Simpson Consulting Civil Engineers for providing engineering services to prepare final plans and specifications for the subject improvements. The major services to be provided by the engineer are: 1. Perform supplemental field surveys and drainage study. 2. Prepare detailed plans and specifications for the proposed improvements. 3. Prepare a detailed quantity and cost estimate. 4. Prepare supporting plans and data necessary for the Coastal Zone Permit Application. 5. Provide consultation and interpretation of plans during construction. The firm of Shuirman- Simpson is highly qualified and has prepared both the Master Plan (1971) and the preliminary project plans (1973) for these improvements. Compensation is based on standard hourly rates with a specified maximum fee of $27,000. This fee has been compared with the schedule recommended by the American Society of Civil Engineers for work of similar magnitude and complexity. The pro- posed fee is in accordance with the recommended schedule. The preliminary estimate for the work is $419,000. The project will be cooperatively financed by the City (Street, Water, and Sewer Improvements) and the Orange County Flood Control District (Storm Drain Improvements). Funds are appro- priated for the project in the current budget. DISCUSSION: Included in the current budget is a project for the construc- tion of the Bayside Drive storm drain. This work will be done in conjunc- tion with street and water line improvements in Bayside Drive. It is anticipated that construction will start in May 1974. The Flood Control District will finance the actual cost of the storm drain improvement in an amount not to exceed $200,000. A preliminary estimate for cost of the storm drain work is $155,000. The agreement sets up the following maintenance responsibilities: 1. The District will maintain the mainline pipe, junction structures, and manholes. 2. The City will maintain all catch basins and their connector pipes. DISCUSSION: On November 13, 1972, the Council authorized the preparation of preliminary plans and cost estimates for the subject improvements. Included in the current budget (Accounts: 02- 3497 -008, 50- 9297 -004 and 19- 3322 -004) are funds for the final design of the improvements; and for construction of the street, storm drain, and water im- provements. Sewer improvements which are the responsibility of the Orange County Sanitation Districts will not be constructed at this time. This project will be cooperatively financed by the City (street and water improvements) and the Orange County Flood Control District (storm drain improvements). The preliminary estimate for the work is $419,000. It is anticipated that construction of the proposed improvements will be started in May, 1974, under a single contract to be administered by the City. The Parks, Beaches, and Recreation Commission in their review of the Master Plan for this project had expressed concern regarding the proposed ultimate street width of Bayside Drive at 44 feet. The City Council, at the study session of July 26, 1971, indicated that the Parks, Beaches, and Recreation Commission's concerns would be taken into consideration when the improvements are to take place. The preliminary plans call for a width of 40 feet face of curb to face of curb; which is the standard width for a local street with two travel lanes and a shoulder on each side. Because of the infrequent use of the roadway shoulders for on- street park- ing, it is anticipated that the shoulders will provide for satisfactory use as bicycle lanes. The engineering firm of Shuirman- Simpson, Consulting Civil Engineers, is highly qualified and has prepared both the Master Plan (1971) and the preliminary project plans (1973) for these improvements. / oseph T. After approval of plans and specifications by DISTRICT, CITY shall incorporate PROJECT with the street improvements into a single contract and shall advertise. for bids, receive and open same, and award a contract to the lowest responsible bidder, all in accordance with applicable provisions of state and local laws. 4. CITY shall promptly notify DISTRICT upon award of a contract and shall furnish DISTRICT with a construction schedule and keep 'DISTRICT informed of any revision in said schedule. During construction, CITY shall assign a qualified resident engineer charged with overall contract administration and for obtaining construction in accordance with the plans and specifications. DISTRICT's Chief Engineer shall assign a qualified in- spector to PROTECT whose function shall be certification at the end of construction to said Chief Engineer that PROTECT has been accomplished in good and workmanlike manner in accordance with the plans and specifications. In the event of a disagreement between CITY and DISTRICT inspectors regarding conformance with plans and specifications, the decision of DISTRICT's inspector shall be final. During the progress of the work, CITY' resident engineer shall cooperate fully with.DISTRICT's inspector regarding conformance th the plans and specifications and shall promptly provide copies of materials tests, logs of test borings, soils tests, survey results and other items necessary or desirable Ito determine adherence to the plans and specifications. 5. Upon completion of.construction, CITY shall file a Notice of Completion and submit to DISTRICT for file purposes two copies of the Notice of Completion and original tracing of the plans on a medium of a:,like quality to the original and modified to represent the "as- built" conditions. Upon certification by DISTRICT's inspector and concurrence by DISTRICT's Chief Engineer that the PROJECT has been accomplished in accordance with the plans and specifications, DISTRICT shall pay to CITY upon deaand by CITY the PROJECT cost (less amounts previously paid) including engineering, inspection, testing and contract administration, but not to exceed $200,000. 10. After completion of construction, DISTRICT shall assume maintenance responsi- bilities for the main line portion of PROJECT and CITY shall assume maintenance.responsi- bilities for all inlets, catch basins, connector pipes and laterals to PROJECT. DISTRICT's responsibilities for operation and maintenance under this agreement shall commence 30 days from the receipt of notification by CITY that it has filed a Notice of Completion of the work, unless prior to the expiration of said 30 -day period,. DISTRICT's Chief Engineer has notified CITY in writing that the work in not acceptable. Said notice of unacceptability shall be given only upon finding by DISTRICT's Chief Engineer that the work has not been accomplished in compliance with the plans and specifications and duly issued change orders or, that during and subsequent to the con- struction period, the works have undergone deterioration by the accumulation of debris, sediment, vegetative growth, erosion or structural changes. Said notice, if givtnp shall include specific work required for acceptance, and, in the event that second party does not promptly undertake and complete said remedial work, DISTRICT shall accomplish same and CITY agrees to pay the cost of same and to indemnify and save DISTRICT harmless from all claims arising out of said deficiencies. - 3 - 11. Time is of the essence, and if CITY has not awarded the contract for PROJECT by January 1, 1975, this agreement shall become void and the obligations of DISTRICT hereunder shall terminate. 12. GENERAL A. City engages Engineer to perform the services hereinafter described for the compensation herein stated. B. Perform supplemental field surveys as needed to complete a final design. B. Prepare detailed plans for the construction of the project. The pump station plans will be complete drawings, including required gravity and force main lines, and appur- tenances; and will designate those portions of the work to be constructed as part of this project. C. Prepare a drainage study of the area tributary to Bayside Drive in cooperation with the Orange County Flood Control District. The study will include a map defining the drainage area and indicating the direction of street flows, location, and size of existing and proposed facilities. The calculations for the determination of runoff quantities, recommendations for the drainage facilities included in the final design, and hydrau- lic grade line for the mainline storm drain in Bayside Drive shall also be included. D. Prepare the necessary special provisions and bid proposal in conjunction with the City's Standard Specifications, on xerox masters suitable for use by the City in calling for competitive bids. E. Prepare a final cost estimate based on the quantities used in the bid proposal. The cost estimate will also be broken down to show allocation by bid item of the cost to be borne by the City and the Orange County Flood Control District. F. Prepare the necessary supporting plans and data for use in the City's application to the California Coastal Zone Conservation Commission for a permit to construct the project. G. Review the progress of the design periodically with the staffs of the City and the Orange County Flood Control District. H. DUTIES OF CITY and materials: City hereby agrees to supply Engineer with the following information A. Hydrology report for the Bayside Drive storm drain system pre- pared by the Orange County Flood Control District. B. Soil investigation report prepared by the Orange County Road Department. C. Mylar plan and profile and standard sheets for preparation of original project drawings. D. Any other additional information available which the parties agree may be beneficial to the final design of the project. 4. OWNERSHIP OF PROJECT DOCUMENTS Original drawings, reports, notes, maps, and other documents shall become the property of the City and may be reproduced as deemed necessary by the Public Works Director. 5. ENGINEER IN CHARGE Fritz C. Steppat, RCE No. 19249, shall be the Engineer in charge of the project design. 6. RIGHT OF TERMINATION City reserves the right to terminate this agreement at any time by giving Engineer three (3) days' prior written notice; notice shall be deemed served upon deposit in the United States mail, postage prepaid, addressed to any of Engineer's business offices. In the event of termination due to fault of Engineer, City shall be relieved of any obligation to compensate Engineer. If this agreement is terminated for any reason other than fault of Engineer, City agrees to compensate Engineer for the actual services performed up to the effec- tive date of the notice of termination, on the basis of the fee schedule contained herein. 7. COMPLETION OF FINAL DESIGN All plans and other documents for the project shall be submitted to the Public Works Director of City for final review by January 1, 1974. -3- 0 0 8. FEE SCHEDULE AND PAYMENT A. In consideration of the performance of the above described engineering services, City hereby agrees to pay Engineer an amount based upon the hourly rate schedule set forth below. Balance of the total amount earned to be paid upon com- pletion of work specified in Section 2 above. c. In addition, City agrees to reimburse Engineer for the actual cost of reproduction of copies of said plans, and related documents, as well as computer costs, fil- ing fees, checking fees, cost of aerial topographic mapping, and other related costs authorized by the Public Works Director and advanced by Engineer. 9. ADDITIONAL WORK Should Engineer complete any additional work not outlined in this agreement, but authorized by City, such as legal descriptions, revisions to final plans, design of off -site facilities, additional topography, additional utility design or construction staking, the extra work shall be performed on an hourly basis in accordance with the hourly rate standard fee schedule set forth in Section 8 above. -4- • 10. PROJECT SCOPE REVISIONS The scope of the project may be changed and the maximum fee revised upon prior written approval of the Public Works Director i.f the increase in the maximum fee does not exceed $2,700. If revisions to the scope of the project would result in an increase in the maximum fee exceeding $2,700, an amendment providing for such revisions shall be processed and executed by the parties hereto. 11. HOLD HARMLESS Engineer shall indemnify and save harmless City, and its officers and employees, from any damage or liability arising from any errors, omissions, or negligence in Engineer's performance of this agreement, or in the engineering work and services herein provided. DISCUSSION: Included in the current budget is an appropriation for the design and preparation of plans and specifications for the subject improvements. The cost of the street improvements will be financed by the City; storm drain reconstruction by the City and Orange County Flood Control District; and the trunk sewer reconstruction by the Orange County Sanitation District No. 5. It is anticipated that the proposed improvements will be constructed during fiscal year 1973 -74 in a single contract administered by the City. Significant financial savings and the least public inconvenience should result by combining the improvements into a single project. The design of the project will be accomplished in two phases. Phase I will provide for: (1) Aerial topographic mapping supplemented by field surveys. (2) Preliminary plans. and (3) Preliminary cost estimate. Phase II will provide for detailed design and preparation of plans, special provisions, and engineer's estimate. A proposal has been obtained from the firm of Shuirman- Simpson, Consulting Civil Engineers to perform the work required for Phase I. They are highly qualified and have satisfactorily performed similar work for the City. Compensation is based on standard hourly rates with a specified maximum fee of $12,000.00. Funds for Phase I will be advanced by the City. Credit for funds advanced by City for Phase I will be applied to the cost of Phase II. The preliminary design will be for the following improvements: 1. Widening of portions of Bayside Drive from Fernleaf Avenue to Marguerite Avenue. 2. Storm drain system reconstruction. 3. Gravity trunk sewer reconstruction. 4. Water system improvements. The limits and nature of the improvements would be generally as shown on the master plan for this section of Bayside Drive that we had prepared previously. The scope of our services will include the following: 1. Preparation of a 40 -scale aerial topographic map supplemented with field surveys as necessary. A pencil manuscript only would be prepared at this time. However, the manuscript and photo work will be done in such a manner that photo- type strip plans for plan and profile sheets can be printed. 2. Preparation of preliminary plans for all contemplated improvements in sufficient detail to allow the City to establish the scope of work and the final design parameters. Surface Water Surface runoff water containing mud, silt, or other deleterious material from the project shall be treated by filtration or retention in a settling basin or basins, sufficient to prevent such waters from entering storm drains or the bay. The contractor shall submit a plan for implementing siltation control concurrently to the City and to the California Regional Water Quality Control Board, Santa Ana Region (6833 Indiana Avenue, Suite Riverside, California 92506, Telephone (714) 684 -9330, Mr. Herrara), prior to commencing construction. Upon approval of the plan by the City and the Board, the contractor shall be responsible for the implementation and maintenance of the control facilities. The contractor's attention is called to Subsection 7 -8.1 of the Standard Specifications as regards proj- ect site maintenance. Ground Water It is anticipated that ground water will be encountered at various times and locations during the work herein contemplated. The contractor, by submitting a bid acknowledges that he has investigated the risks arising from ground water and has prepared his bid accordingly. Dewatering All water removed from excavations shall be pumped to a portable settling box of a size and configuration capable of removing suspended solids from the dewatering operation. The discharge from the box shall have a 2 -1/2" standard fire hose connection. The discharge from the box shall be metered. Water from the settling box shall be discharged into the nearest sewer manhole. Discharge from the box will be periodically sampled by the Orange County Sanitation District No. 5. The City will obtain and pay for the necessary permit from Orange County Sanitation District No. 5. One standard fire hydrant meter will be furnished to the Contractor and may be picked up at the City's maintenance yard at 592 Superior Avenue from the Utility Division. All costs involved in the dewatering operation shall be included in the price bid for the related item requiring dewatering. i ! The Cooperative Financing Agreement (C814) between the City and the District stipulates that award of this con- tract be made prior to January 1. 1975. Prepare detailed plans and special provisions for the construction of the project. The plans will be prepared on standard plan and profile sheets to be furnished by the City. The plan view scales will be 1" = 40'. The pumping station plans would be complete drawings, including the required gravity line and force main, but would designate the portions to be constructed with this project. 3. Prepare a drainage study of the area tributary to Bayside Drive in cooperation with the Orange County Flood Control District. The study will include a map defining the drainage area and indicating the direction of street flows, location, and size of existing and proposed facilities. The calculations for the determination of runoff quantities, recommendations for the drainage facilities included in the final design, and hydraulic grade line for the mainline storm drain in Bayside Drive, shall also be included. The studies used in the preparation of the preliminary design shall serve as a basis for this final study. 4. The proposed project begins at Bayside Place adjacent to Lower Newport Bay and continues along Bayside Drive to Marguerite Avenue. Development along the project is primarily residential, with a City park abutting the project in the vicinity of Carnation Avenue. 2. PROJECT DESCRIPTION: The work consists of: reconstruction and widening of a portion of Bayst e Drive from Fernleaf Avenue to Marguerite Avenue; resur- facing Bayside Drive from Bayside Place to Fernleaf Avenue; replacement of an existing water main in Bayside Drive from Bayside Place to Marguerite Avenue; and reconstruction of an existing storm drain system in Bayside Drive from Bayside Place to Marguerite Avenue. Bayside Drive is a local two - lane collector street. Storm drain reconstruction is in conformance with the City's Master Plan of Drainage. The street widening will provide for parking and bicycle lanes only; additional travel lanes are not being con- structed. All widening is within the existing right -of -way for the street. 3. PURPOSE OF THE PROJECT: (a) To provide adequate capacity and safety to meet present and future traffic demands. (b) To complete the widening of Bayside Drive to its ultimate width of 40 feet from Fernleaf Avenue to Larkspur Avenue and to 49 feet from Larkspur Avenue to Marguerite Avenue. (c) To resurface Bayside Drive from Bayside Place to Fernleaf Avenue to prolong pavement life by increasing the structural section. (d) To reconstruct a deteriorated existing storm drain system to City and Orange County Flood Control District Standards, from Bayside Place to Fernleaf Avenue. (e) To replace deteriorated sections of water main installed in 1925 from Bayside Place to Marguerite Avenue. DISCUSSION OF ENVIRONMENTAL IMPACTS: (a) Land Resources RECastruction of this project wi17 require the use of a strip of land some 27 feet wide within the existing dedicated right -of -way for Bayside Drive, which is not presently being utilized as a street or, parkway; however, the improvements to traffic safety and capacity Page,2 • �I resulting from the project are felt to offset this change in use. (b) Human Resources Therewill be no effects on human resources due to the project since the work is well within the street right -of -way and no relocation of residences will be made. 5. BASIS FOR NEGATIVE DECLARATION: The proposed project has been reviewed in conjunction with Sections 15081 and 15082 of Article 7, Chapter 3 (Guidelines for Implementation of the California Environmental Quality Act of 1970), Title 14, Division 6 of the California Administrative Code. The criteria set forth in the above sections indicate that the proposed project will not have a significant environmental impact. A copy of an informational fact sheet is attached for reference thereto. �J 0 January 2, 1974 IMPROVEMENT OF BAYSIDE DRIVE FROM BAYSIDE PLACE TO MARGUERITE AVENUE FACT SHEET TO DETERMINE IF PROJECT HAS SIGNIFICANT ENVIRONMENTAL EFFECT A. CONFORMANCE WITH CITY AND COUNTY GENERAL PLANS This project is in conformance with the City's current Master Plan of Streets and Highways element of the General Plan. The project is also in conformance with: The City's Master Plan of Drainage, Orange County Flood Control District's Master Plan of Drainage, City's water main replacement policies, and the County's Master Plan of Arterial Highways. Bayside Drive is classified as a local street on the City's and County's Master Plans. Minimum width for a local street is 40 feet, curb to curb. The existing width of Bayside Drive is 22 feet from Fernleaf Avenue to Larkspur Avenue, and 40 feet from Larkspur Avenue to Marguerite Avenue. B. LAND USE AND AESTHETICS Street widening for this project will require the use of a 27' strip of land along the northerly side of Bayside Drive from Fernleaf Avenue to Larkspur Avenue. Over the remaining portion of the project, a substantial portion of this strip is presently in use as street or parkway. Use of the strip will require the relocation or removal of bush type shrubbery which is presently planted in a portion of the strip area. Ample space is available in the remaining unused right -of -way to replant this shrub- bery and use of this strip of land will not have a significant effect on the present land use. Page 2 C. HUMAN RESOURCES There will be no effects on human resources due to this project since the work is well within City right -of -way, and no relocation of residences or major alterations to private property will be made. D. GEOLOGIC HAZARDS This project is in a general area of geologic concern. However, no signi- ficant geologic hazards are within the area encompassed by the improvements. Extensive grading will not be required. E. FLOODING, EROSION, AND SILTATION Project planning calls for construction of this project to occur during late spring and summer, prior to the normal rainy season in this area. Construc- tion during those periods should preclude the possibility of flooding, erosion, and any subsequent siltation of material downstream. The project specifica- tions will require the contractor to employ sufficient erosion control measures during construction to further reduce the possibility of siltation. F. GROUNDWATER There are no known aquifers in the area of the project; however, a soil engi- neering survey and report is being made by the Orange County Road Department, and those investigations will determine the existence of aquifers, if any are present. However, the nature of the construction is such that contamina- tion or blockage of aquifers (if present) will not occur. G. NOISE LEVEL Widening of the street should not substantially alter the ambient noise levels for the surrounding area, since no new travel lanes will be added to the road- way, and use of the roadway will not increase drastically. During construction noise levels may rise due to operations which are necessary to construct the project; however these operations will be limited as to working hours to create Page 3 the minimum of disturbance to neighboring residents, and the operation will cease upon completion of the project. H. SECONDARY CONSEQUENCES It has been determined that no secondary consequences will arise from the minor primary consequences related to this project. I. AIR RESOURCES This project will not significantly increase or decrease the total volume of vehicle emissions in this air quality region. Dust control procedures will be required during construction by the project specifications. J. VEGETATION AND ANIMAL LIFE There are no known rare or endangered species or habitats of such species of animal or plant life within or adjacent to the project area. K. SHORT TERM IMPACTS The only short term impacts anticipated are those associated with any street or utility construction. They are such items as noise and motorist inconven- ience during construction. Traffic control provisions are made in the project specifications to provide for the smooth and continued flow of traffic through this traffic corridor. Access to residences adjacent to the improvements will be maintained at all times. These impacts are not considered to have a signi- ficant effect on the environment. L. SUMMARY The project does not appear to have a significant effect on the environment.
