Gentlemen:
At the Newport Beach City Council meeting of May 24, 1976, the
City Council asked that I inform you that, as required in the
Orange County- Cities Unified Disaster Organization agreement,
the City of Newport Beach is formally withdrawing from this
agreement effective June 30, 1976.
The City of Newport Beach has adopted a disaster plan which has
been approved by the State of California. Also, the City of
Newport Beach has established its own disaster committee, and
feels that to continue this agreement would be a duplication of
efforts.

the COUNTY OF ORANGE, hereafter referred to as "COUNTY," and the cities

within Orange County which are signatories hereto, hereafter referred to

as "CITY" or "CITIES,"

W I T N E S S E T H:

WHEREAS, it is the intent of the parties hereto to coordinate their
12
efforts and resources for the purpose of preserving the safety of persons
13
and property during conditions of extreme peril caused by such factors
14
as enemy attack, air pollution, fire, flood, storm, epidemic, riot or

earthquake, hereafter referred to as "disasters ";

NOW, THEREFORE, the parties hereto agree as follows:

A. EXISTING AGREEMENTS: Nothing contained in this Agreement shall

be construed as repealing or modifying any existing agreements, including

mutual aid agreements.

B. COUNTY SERVICES: COUNTY will provide the following services to
21
CITIES:

1. Aid, assist and advise each CITY in the preparation and
23
aevelopment of a disaster plan for that CITY.
24
2. Prepare and develop a disaster plan which shall provide for
25
the needs of CITIES and of the unincorporated areas of the
26.
COUNTY, and will take into account and be coordinated with
27
the needs of CITIES in the event of a major disaster.
28
3. Aid, assist and advise CITIES with the training of public

employees for the CITY disaster organizations.

4. Establish a disaster, program in each of the following areas:

Said program shall provide for the furnishing of the above -
listed services by COUNTY to each CITY upon request in the
event of a disaster.
5. Develop and keep current on a Countywide basis an inventory
of all the equipment and supplies available now in the
County for use in the event of an emergency.
6. Provide technical assistance in obtaining any federal or
State funds which may become available to CITIES for disast
purposes.
7. Provide technical assistance in the acquisition by CITIES
of surplus and excess property.
8. In the event of a disaster confined to one CITY, COUNTY
will, if requested, offer assistance within the limits of
its Emergency Services Organization and will, if requested,
coordinate assistance furnished by other CITIES in accord-
ance with mutual aid agreements. Notwithstanding the above,!,
fire and law enforcement assistance shall be provided by
COUNTY pursuant to any applicable mutual aid agreements.
9. In the event of a disaster within the County affecting an .
area greater than any one City, COUNTY shall, if requested,
offer assistance within the limits of its Emergency Services
Organization and shall, if requested, direct and coor-
dinate the assistance furnished by other CITIES, as
required. Notwithstanding the above, fire and law enforce-
ment assistance shall be provided by COUNTY pursuant to
any applicable mutual aid agreements.

C. THE CITIES SHALL:

1. Accept primary responsibility for the development within

each CITY of a disaster plan which shall be compatible
4
with, and complementary to, the Countywide disaster plan.

2. Assure training within their respective CITIES.

D. LOCAL AUTHORITY: In the event of an actual or threatened
7
disaster, COUNTY and each CITY shall retain the authority provided
8
for by law respecting its jurisdiction.
9
E. COORDINATION: It shall be the responsibility of the Executive
10
Officer of the Orange County Office of Emergency Services to coordinate
11
the efforts of the parties to this Agreement for the accomplishment of
12
its purposes.

F. ORGANIZATION: There is hereby established the Orange County -
14
Cities Disaster Organization, hereafter referred to as 'Organization."

1. Membership in the Organization shall consist of COUNTY

2. The Chairman of the Board of Supervisors shall be the
19
COUNTY representative member.

3. A representative from each CITY, who may be the mayor, a
21
councilman, or the city manager, shall be the representative
22
member for his City. CITY representatives shall be
23
appointed by each City Council.

4. Officers of the Organization shall be: President, First
25
Vice President, Second Vice President, and Secretary.
26
5. The President shall be the Chairman of the Board of
27
Supervisors, the Secretary shall be the Executive Officer
28
of the Orange County Office of Emergency Services, and the
29
First and Second Vice Presidents shall be elected by a
30
majority of the members.

6. Each member shall have one vote.

7. It shall be the duty of.the Organization to review and
recommend for submission to the Orange County Board of
Supervisors through the Orange County Emergency Services
Council, and to all contracting CITIES, disaster - mutual
aid plans and agreements, and such ordinances, resolutions,
rules and regulations as are necessary to implement such
plans and agreements.
8. The Organization shall recommend a budget for the operations
of the Orange County Office of Emergency Services to the
Board of Supervisors, to accomplish the purposes of this
Agreement.
9. The Organization shall meet upon call of the Chairman or,
in his absence from the County or inability to call such a
meeting, upon the call of the First Vice President.
G. COUNCIL: The Unified Orange County- Cities Disaster Council,
hereafter referred to as "Council," is hereby created and designated
as the advisory body of the Organization.
1. The Council shall consist of the following voting members:
a. The Chairman of the Orange County Emergency Services
Council who shall be Chairman,
b. The Executive Officer of the Office of Emergency
Services who shall be Secretary,
c. Five members elected by the Organization from among
its members.
2. The membership of the Council shall elect a Vice Chairman.
3. It shall be the duty of the Council to study, develop,
review and recommend to the Organization plans, agreements,
legislation, rules and regulations, budgets and other
matters necessary to implement the intent of this Agreement.
The Council shall meet upon call of the Chairman or, in his
absence from the County or inability to call such a meeting,
upon the call of the Vice Chairman.

H. FINANCES:
1. Each CITY shall pay to COUNTY its share, as determined
below, of the County's costs of operating the Orange County
Office of Emergency Services, excluding equipment costs of
the Orange County Emergency Operations Center.
2. The share of such costs payable by each CITY shall be
computed as follows:
a. One quarter shall be prorated among all the cities
in the County, including cities in the County not
parties hereto, on the basis of assessed valuation as
set forth in the last equalized roll for the fiscal
year in which the costs are incurred, as defined in
Section 2052 of the Revenue and Taxation Code;
b. One quarter shall be prorated among all cities in the
County on the basis of population as determined by the
latest available estimates from the State Department
of Finance.
3. Each year the Organization shall recommend to COUNTY a pro-
posed budget for the Orange County Office of Emergency
Services. On or before May 15, the Organization shall notify
each CITY of the proposed budget for the following fiscal
year and its estimated share thereof. Payments shall be
made by CITIES to COUNTY following the fiscal year during
which the costs are incurred.
4. On or before July 15 of each year, the Executive Officer of
the Orange County Office of Emergency Services shall notify
each CITY of the actual costs incurred by COUNTY during the
previous fiscal year and CITY's share thereof. Payment
thereof shall be made to COUNTY within forty -five (45) days.
Each CITY shall be entitled to credit for any unencumbered
balance in COUNTY's budget for the Orange County Office of
Emergency Services, derived from budget savings or revenue

from State or federal funds, at the rate of its contribution
to said budget. It is understood that CITIES shall not be
liable for payment of costs incurred by COUNTY in excess of
the proposed budget previously recommended by Organization.
5. The proposed budget for fiscal year 1972 -1973 shall be the
final budget adopted by the Board of Supervisors. CITIES
shall be liable pursuant to this Agreement for those
expenditures in fiscal year 1972 -1973 incurred after the
effective date of this Agreement.
I. EFFECTIVE DATE: This Agreement shall take effect when executed
by COUNTY and a majority of the Cities in Orange County. Thereafter, any
City in Orange County may become a party hereto by executing this
Agreement.
J. WITHDRA14AL: Any party may withdraw from this Agreement by
written notice to the President of the Organization. Said notice shall
be given on or before May 30 of any year, effective June 30 of said
year. A withdrawing member shall not be liable for costs incurred
pursuant to this Agreement during the following fiscal years.

OFFICE OF EMERGENCY
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and the County of Orange and other cities
in Orange County for establishing an Office of Emergency Ser-
vices; and
WHEREAS, said Office of Emergency Services will pro-
vide the
coordination and guidance
needed
to insure
adequate
emergency
planning throughout the
County;
and
WHEREAS, the City Council has considered the terms
and conditions of said 'agreement and found them to be fair
and equitable;
NOW, THEREFORE, BE IT RESOLVED that said agreement
establishing an Office of Emergency Services is approved, and
the Mayor and City Clerk are hereby authorized and directed
to execute the same on behalf of the City of Newport Beach.
