NICOLL, Superintendent As I mentioned on the phone, we are now reaching the point where the 1973 -74 budget is becoming firm and a review of the dollars available for cooperative projects indicates that there will be no additional funds available for night tennis court lighting at Newport Harbor High School. However, we will have the four that we have lit this year. There will be a sum of $13,000 available on a matching basis to do four courts at Corona del Mar High School. In response to your earlier question, we had signed an earlier letter indicating the availability of up to $9,000 for funding of the four courts at Newport Harbor High School. Engineering studies indicate that this should be more realistically $13,000. So, please be advised that the district will share cooperatively up to $13,000 for the night lighting of the courts at Newport Harbor High School. NOW, THEREFORE, in consideration of these premises it is hereby agreed 19 by and between the parties hereto as follows: 20 I 1. CITY agrees to prepare all plans and specifications and to award the 21 contract for the installation of the lighting facilities on the four tennis courts. 22 2. DISTRICT agrees to grant permission to CITY and its employees or 23 agents to enter upon the grounds of Newport Harbor High School for the purpose 24 of installing the lighting facilities on the tennis courts. 25 3. DISTRICT agrees to reimburse CITY for one -half of the construction �- 28 cost up to a total of $9,000.00. /� 27 4. DISTRICT agrees to maintain all facilities after installation, including, ry 28 but not limited to, poles, light bulbs and other items related to said lighting 29 I facilities. 30 5. APPROVED AS TO FORM: Z4 / ' City Attorney ATTEST: City Clerk CITY OF NEWPORT BEAC corporation NEWPORT -MESA UNIFIED SCHOOL DISTRICT ByIL -2- M President, Board of Education Vice PresidenVtlerk, Board of Education RESOLUTION NO. 7946 r_1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF A JOINT POWERS AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH AND THE NEWPORT -MESA UNIFIED SCHOOL DISTRICT FOR INSTALLATION OF LIGHTS ON THE TENNIS COURTS AT NEWPORT HARBOR HIGH SCHOOL WHEREAS, there has been presented to the City Council of the City of Newport Beach a Joint Powers agreement between the City of Newport Beach and the Newport -Mesa Unified School District for the installation of lights on the tennis courts at Newport Harbor High School; and WHEREAS, the City Council has considered the terms and conditions of said agreement and found them to be fair and equitable; NOW, THEREFORE, BE IT RESOLVED that said Joint Powers agreement for the lighting of the tennis courts at Newport Har- bor High School is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach.
