As I mentioned on the phone, we are now reaching the point where the
1973 -74 budget is becoming firm and a review of the dollars available
for cooperative projects indicates that there will be no additional funds
available for night tennis court lighting at Newport Harbor High School.
However, we will have the four that we have lit this year. There will be
a sum of $13,000 available on a matching basis to do four courts at Corona
del Mar High School.
In response to your earlier question, we had signed an earlier letter indicating
the availability of up to $9,000 for funding of the four courts at Newport
Harbor High School. Engineering studies indicate that this should be more
realistically $13,000. So, please be advised that the district will share
cooperatively up to $13,000 for the night lighting of the courts at Newport
Harbor High School.

JOINT POWERS AGREEMENT

2 Pursuant to Title I, Division 7, Chapter 5, of the Government Code of
3 the State of California (Sections 6500 through 6513), this Joint Powers Agreement

5 and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter
6 referred to as "CITY" and the NEWPORT -MESA UNIFIED SCHOOL DISTRICT
7 I hereinafter referred to as "DISTRICT;"
8 WITNESSETH
9 WHEREAS, it has,been determined that there is a need for more lighted
10 j tennis courts in the City of Newport Beach; and
11 j WHEREAS, Newport Harbor High School has been selected as the site for
12 I` the lighting of four tennis courts; and
13 WHEREAS, CITY and DISTRICT have agreed to each contributing one -half
14 of the cost of the lighting facilities up to a total of $9,000.00 contribution by
15 each party; and
16 WHEREAS, it is agreed that the CITY and DISTRICT will share the use of
17 the lighted tennis courts;
18 . NOW, THEREFORE, in consideration of these premises it is hereby agreed
19 by and between the parties hereto as follows:
20 I 1. CITY agrees to prepare all plans and specifications and to award the
21 contract for the installation of the lighting facilities on the four tennis courts.
22 2. DISTRICT agrees to grant permission to CITY and its employees or
23 agents to enter upon the grounds of Newport Harbor High School for the purpose
24 of installing the lighting facilities on the tennis courts.
25 3. DISTRICT agrees to reimburse CITY for one -half of the construction �-
28 cost up to a total of $9,000.00. /�
27 4. DISTRICT agrees to maintain all facilities after installation, including, ry
28 but not limited to, poles, light bulbs and other items related to said lighting
29 I facilities.
30 5. It is further agreed by and betwen the parties that DISTRICT will have

administrative control over the scheduling of the use of the lighted tennis courts
and that the general public may use said courts after all legitimate school uses
have been met.
IN WITNESS WHEREOF the parties hereto have executed this agreement as
of the day and year first above written.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION
OF A JOINT POWERS AGREEMENT BETWEEN THE CITY
OF NEWPORT BEACH AND THE NEWPORT -MESA UNIFIED
SCHOOL DISTRICT FOR INSTALLATION OF LIGHTS ON
THE TENNIS COURTS AT NEWPORT HARBOR HIGH SCHOOL
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a Joint Powers agreement between
the City of Newport Beach and the Newport -Mesa Unified School
District for the installation of lights on the tennis courts
at Newport Harbor High School; and
WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair
and equitable;
NOW, THEREFORE, BE IT RESOLVED that said Joint Powers
agreement for the lighting of the tennis courts at Newport Har-
bor High School is approved, and the Mayor and City Clerk are
hereby authorized and directed to execute the same on behalf
of the City of Newport Beach.
