AGREEMENT FOR ENGINEERING SERVICES
Design of Water Transmission Main
to Provide Water Service to Old City
Dump Site)
THIS AGREEMENT is made and entered into this y 7
day of y >4 jq n H , 1973, by and between the CITY OF
NEWPORT BEACH, a municipal corporation, hereinafter referred
to as "CITY ", and SHUIRMAN- SIMPSON, Consulting Civil Engineers,
hereinafter referred to as "ENGINEER ":
W I T N E S S E T H
WHEREAS, CITY intends to provide water service to the
old city dump site located at 19th Street and Whittier Avenue
in the City of Newport Beach; and
WHEREAS, said water service will require the design
and construction of a water transmission main from the 16th Street
reservoir to the site; and
WHEREAS, engineering services are necessary to design
and prepare plans and specifications for said transmission main;

WHEREAS, ENGINEER has submitted a proposal to CITY to
design and prepare plans and specifications for the proposed
transmission main which proposal CITY desires to accept;
NOW, THEREFORE, IN CONSIDERATION of these premises, the
parties hereto agree as follows:
1. GENERAL
A. CITY engages ENGINEER to perform the services
hereinafter described for the compensation herein stated.
B. ENGINEER agrees to perform said services upon
the terms hereinafter set forth.

2. SERVICES TO BE PERFORMED BY ENGINEER
ENGINEER hereby agrees to perform the following
A. Coordination with the City of Costa Mesa, as
required, to obtain existing information and
data and the necessary approvals and City
permits required for the project.
B. Preparation of plan and profile sheets, detail
sheets as required, and the specifications.
C. All field survey work necessary to complete
Item B. Traverse control will be referenced
for use in future construction staking.
D. Coordination with private and public utilities,
as required, to identify and locate any exis-
ting utilities which might be affected by the
project.
E_ Review of any required stop drawings.
F. Consultantion, as needed, during construction.
3. DUTIES OF CITY
CITY hereby agrees to supply ENGINEER with the
following information and material:
A. Consultation, as needed, to accomplish the
project.
B. Standards sheets for preparation of plans.
C. Any soils data required for design of the
project.
4. OWNERSHIP OF PROJECT DOCUMENTS
Original drawings, reports, notes, maps, and other
documents shall become the property of the CITY and may be repro-
duced as deemed necessary by the Public Works Director.
5. ENGINEER IN CHARGE
Donald C. Simpson, RCE No. 10595, shall be the
Engineer in charge of the project design.
6. RIGHT OF TERMINATION
CITY reserves the right to terminate this agreement
at any time by giving ENGINEER three (3) days= prior written
notice; notice shall be deemed served upon deposit in the United
States mail, postage prepaid, addressed to any of ENGINEER's

business offices. In the event of termination due to fault of
ENGINEER, CITY shall be relieved Rfiany obligation to compensate
ENGINEER. If this Agreement it "terminated for any reason other
than fault of ENGINEER, CITY agrees to compensate ENGINEER for
the actual services performed up to the effective date of the
notice of termination, on the basis of the fee schedule contained
herein.
7. COMPLETION OF PRELIMINARY DESIGN
ENGINEER agrees to complete the plans and specifications
for the project on or before April 30, 1973.
S. FEE SCHEDULE AND PAYMENT
A. In consideration of the performance of the
above described engineering services, CITY hereby agrees to pay
ENGINEER an amount based upon the hourly rate schedule set
forth below. In no event shall said amount be greater than
Nine Thousand Dollars ($9,000.00):
(1) Hourly Rate for Office Personnel shall be
2.25 Times the Following Salary Cost:
Principal $ 15.50/hr.
Project Designer 9.40 /hr.
Designers & Draftsmen 7.20-8.40/hr-
Jr. Draftsmen 4.00- 4.80/hr.
Typist 4.50/hr
(2) Hourly Rate for Field Surveys:
3 Man Crew
2 Man Crew
56.00 /hr.
42.00 /hr.
(3) The contract amount shall be paid to
ENGINEER as follows:
a. Monthly partial payments shall be based
on the amount earned in each month, as determined by
the fee schedule. The sum of the monthly partial
payments shall not exceed ninety percent (90%) of
the maximum fee.
b. Balance of the total amount earned to
be paid upon acceptance, by the City Council, of the
construction work on the water transmission main, but,
in any event, it shall be paid not later than twelve
(12) months after signing of the plans by the Public
Works Director.

c.. In addition, CITY agrees to reimburse
ENGINEER for the actual cost of reproduction of copies
of said plans, and related documents, as well as filing
fees, checking feeart cost of aerial topographic mapping,
and other related costs authorized by the Public Works
Director and advanced by ENGINEER.
9. AMENDMENTS
The scope of the services to be furnished by ENGINEER
may be changed and the maximum fee revised upon prior written
approval of the Public Works Director if the increase in the
maximum fee does not exceed $900.00. If revisions to the scope
of the services would result in an increase in the maximum fee
exceeding $900.00, an amendment to this Agreement providing for
such revisions shall be processed and executed by the parties
hereto.
10. HOLD HARMLESS
ENGINEER shall indemnify and hold harmless CITY,
and its officers and employees, from any damage or liability
arising from any errors, omissions, or negligence in ENGINEER's
performance of this Agreement, or in the engineering work and
services herein provided.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION
OF AN ENGINEERING SERVICES AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND SHUIRMAN- SIMPSON,
CONSULTING CIVIL ENGINEERS, FOR DESIGN OF WATER
TRANSMISSION 14AIN TO PROVIDE WATER SERVICE TO
OLD CITY DUMP SITE
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain engineering services
agreement between the City of Newport Beach and Shuirman-
Simpson, Consulting Civil Engineers, for design of water
transmission main to provide water service to old City dump
site; and
WHEREAS, the City Council has considered the terms
and conditions of said engineering services agreement and found
them to be fair and equitable;
NOW, THEREFORE, BE IT RESOLVED that said agreement
for the engineering services above described is approved, and
the Mayor and City Clerk are hereby authorized and directed to
execute the same on behalf of the City of Newport Beach.
