SUBJECT: TRAFFIC SIGNAL MODIFICATION AT WEST COAST HIGHWAY AND
ORANGE STREET
RECOMMENDATION:
Adopt a resolution authorizing the Mayor and the City Clerk to execute
a cooperative financing agreement with the State Division of Highways
for the subject project.
DISCUSSION:
The State proposes to install separate left turn phases on Coast Highway
at Orange. The existing signal standards, heads and controller will be replaced
with new equipment. The additional phasing is justified on the basis of both
volumes and accidents. Fourteen left turning accidents have occurred in the last
three years.
The existing equipment is badly corroded and in need of replacement.
The estimated construction cost of the project is $38,000.00. The
estimated cost of the City's share is $19,000.00. The actual amount of the City's
share of the construction cost will be determined after completion of the work
and will be in the relationship of the number of legs of the intersection under
City jurisdiction (2) to the total number of legs (4) in the intersection.
Sufficient funds for the City's share of the construction cost are in
the unappropriated surplus for the gas tax fund. A budget amendment has been
prepared for Council consideration.

hereinafter referred to as
"STATE"
Fi$, STATE and. contemplate modification

inte f4 of Orange-Street with State Highway Route 001,
(Pacific Oast Highway); %ai of which is. situated within
the city of Newport Beach, and desire to specify herein
the terms and conditions under.pliich said system is to be
modified,:financed and maintarfied.
NOW, THEREFORE, in consideration of the covomants
and conditions herein contained, the parties hereto agree
as follows:
SECTIfS6t:..I
STATE AGREES:
(1) To modifv the traffic control signal system
and safety lighting, hereinbefore mentioned, through
construction by contract with construction contractor
licensed by the State of California, said contract to be
carried out in accordance with provisions of the State
Contract Act, Chapter 3, Part 5, Division 3, Title 2 of
the Government Code, and work completed in conformity with
plans and specifications of STATE.

(2) To bear the entire'expenso.09:prepnration of
plans .and specifications, and 31!OROIR share of construction'.`

(3) To maintain and operate the entire traffic
control signal system and safety lighting as modified.
SECTION II
CITY AGREES:
(1) To deposit with STATE within 30 days of
receipt of billing therefor (which billing will be forwarded
immediately following STATE's bid advertising date of a

construction contract for the aforesaid modification), the
amount of $19,000, which figure represents CITY'S estimated
share'.oi _Oonstruetion engineering costs and construction costa
required fief,,complete the modification referred to herein.
The actual amount of CITY'S share of construction
engineering costs (including all direct and indirect costs)
shall be 18.7 percent of CITY'S share of construction costs.
The actual amount of CITY'S share of construction costs will
be determined after completion of work and a financial settle-
ment made upon final accounting of costs; said share will be
a sum bearing the same proportion to the total cost of modi-
fication of the traffic control signal system and safety
lighting as the number of legs of highways under jurisdiction
of CITY at the intersection involved bears to the total
number of legs of highways at such intersection.
(2) To reimburse STATE for CITY'S proportionate
share of the cost of maintenance and operation.of said traffic
control signal system and safety lighting, such share to be
determined in the manner provided in that Agreement for
maintenance of State highways within the CITY which is in

It is mutually understood and agreed:
(1) That obligations of STATE under terms of this
Agreement are subject to the allocation of .fonds by the
California Highway Commission.
(2) That neither STATE nor any officer or employee
thereof shall be responsible for any damage or liability
occurring by reason of anything done or omitted to be done.

Section 895.4, CITY shall fully indemnify and hold STATE
harmless from any liability imposed for injury (as defined

to CITY under this Agreement.
(4) That, should any portion of the project be
financed with Federal Funds or State Gas Tax Funds all
applicable procedures and policies relating to the use of
such funds shall apply notwithstanding other provisions of
this Agreement.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION
OF A COOPERATIVE FINANCING AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND THE STATE OF
CALIFORNIA DIVISION OF HIGHWAYS FOR TRAFFIC
SIGNAL MODIFICATION AT WEST COAST HIGHWAY
AND ORANGE STREET
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a cooperative financing agreement
between the City of Newport Beach and the State of California
Division of Highways for traffic signal modification at West
Coast Highway and Orange Street; and
WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair
and equitable;
NOW, THEREFORE, BE IT RESOLVED that said cooperative
financing agreement for traffic signal modification at West
Coast Highway and Orange Street is approved, and the Mayor and
City Clerk are hereby authorized and directed to execute the
same on behalf of the City of Newport Beach.
