SUBJECT: IMPROVEMENTS FOR THE IRVINE -DOVER DRIVE -19TH STREET
INTERSECTION
RECOMMENDATIONS:
Adopt a resolution authorizing the Mayor and City Clerk to execute
a cooperative agreement with the Orange County Flood Control Dis-
trict ( OCFCD) and the City of Costa Mesa which provides for OCFCD
to contribute $60,000 toward the construction of the subject im-
provements.
2. Approve the plans and specifications for the subject improvements.
DISCUSSION:
The City has requested OCFCD, through the City Engineers Flood Control
Advisory Committee, to participate in the construction of storm drain improve-
ments at the upstream terminus of the East Costa Mesa Channel at the intersection
of Irvine Avenue -Dover Drive -19th Street. Both Newport Beach and Costa Mesa have
planned major drainage facilities running northerly and southerly in Irvine
Avenue and westerly in 19th Street.
The Flood Control District has agreed to contribute $60,000 toward the
construction of the main line facilities shown on the attached Exhibit A.
On June 24, 1974, the City Council authorized the execution of an
agreement with Costa Mesa providing for Costa Mesa to administer the construc-
tion of the subject improvements, and setting up the cooperative financing of
the project. The $60,000 OCFCD contribution was anticipated in this agreement.
The agreement between OCFCD, Costa Mesa, and Newport Beach provides
for OCFCD to pay to Costa Mesa $60,000 to be used for the construction of the
main line storm drain improvements shown on the attached exhibit. They will
also assume the maintenance of these facilities. Costa Mesa agrees to be the
lead agency, administer the construction contract, provide inspection, and main-
tain storm drain connector pipes, catch basins and other surface improvements
within their city boundaries. Newport Beach agrees to maintain the storm drain
connector pipes, catch basins and other surface improvements within its city
boundaries.

The plans for the subject improvements were prepared by VTN Consolidated,
Inc. and Herman Kimmel & Associates under contracts to Newport Beach. Specifica-
tions for the project have been prepared by Costa Mesa.
The City of Costa Mesa plans to advertise for bids to construct the
subject improvements in mid - August and begin construction of the contract in
late September.

RECOMMENDATION:
Adopt a resolution authorizing the Mayor and City Clerk to
execute a cooperative financing, agreement with the City of
Costa Mesa for the construction of the subject improvements.
DISCUSSION:
The 1973 -4 budget includes a project for the installation of a
traffic signal and the construction of roadway and storm drainage improve-
ments at the intersection of Dover Drive - Irvine Avenue -19th Street. Included
with the intersection improvements is the covering of a portion of the flood
control channel and the construction of a cul de sac for the northerly side
of Dover Drive.
Three major storm drain systems are master planned to enter the
flood control channel at Dover Drive and Irvine Avenue. They are:
1. Irvine- Baycrest storm drain, which runs in Irvine Avenue
Median northeasterly to Baycrest Road.
2. 19th Street storm drain which runs northwesterly up 19th
Street.
3. 18th Street Storm drain which runs southwesterly in Irvine
Avenue to l8th Street then northwesterly up 18th Street.
The City of Costa Mesa plans to construct the 18th Street storm
drain this summer. Newport Beach's proposed plans included the construction
of the three storm drain facilities within the limits of the intersection.
This will insure that roadway improvements and the traffic signal installation
will not be disturbed by future storm drain construction. The Orange County
Flood Control District has proposed to budget $60,000 toward the construction
of these major storm drains in their 1974 -5 budget.
Due to the close coordination required between the Costa Mesa
storm drain project and the Newport Beach project, it is proposed to combine
the projects into one construction contract administered by Costa Mesa.
The subject agreement provides for the City of Costa Mesa to admin-
ister the construction contract for the roadway, storm drain and traffic signal

The 1973 -4 budget provides gas tax funds in the amount of $57,700
for this project. A budget amendment in the amount of $40,100 is required.
This budget amendment was anticipated in the preparation of the 1974 -5 budget
estimates and will not affect the projected program for 1974 -5.
A budget amendment deleting $60,000 from the Gas Tax Contributions
Fund is also required since Costa Mesa will be administering this project.
Costa Mesa proposes to advertise for bids to construct this project
in late July or early August. The roadway and storm drain improvements should
be completed by December, 1974 and the traffic signal completed by February
1975.

SUBJECT: ENGINEERING SERVICES AGREEMENT FOR THE DESIGN OF IMPROVEMENTS
AT THE INTERSECTION OF DOVER DRIVE - 19TH STREET AND IRVINE
AVENUE
RECOMMENDATION:
Adopt a resolution authorizing the Mayor and City Clerk to
execute an engineering services agreement with VTN, Orange
County, for the design of the subject improvements.
DISCUSSION:
On May 29, 1973, the Council authorized the closure of the northerly
side of Dover Drive at Irvine Avenue
The subject engineering services agreement will provide for the pre-
paration of a project report and the design of intersection improvements and
storm drain facilities in the Dover Drive -19th Street - Irvine Avenue intersection
Included is the preliminary design of a storm drain in Irvine Avenue from Dover
Drive to Baycrest Road.
The consultant will coordinate with the agencies having facilities in
the intersection and determine the feasible location for the necessary storm
drains. Some of the agencies having major facilities in the intersection are:
1. Orange County Sanitation District #6
2. Costa Mesa Sanitary District
3. Costa Mesa County Water District
4. Southern California Gas Company
5. Orange County Flood Control District
6. City of Newport Beach Water Department
The Orange County Flood Control District will also be consulted con-
cerning the covering of a portion of their drainage channel.
The firm of VTN, Orange County, is well qualified to perform the work.
Compensation is based on standard hourly rates with a specified maxi-
mum fee of $15,900.
Funds were budgeted in the 1972 -73 fiscal year for the preparation
of plans and specifications to improve this intersection. The money will come
from the Gas Tax Fund.

AGREEMENT
THIS AGREEMENT is made and entered into this /G zA day of
_ , 1974, by and between the CITY OF COSTA MESA, a muni-
cipa core ration, he rein referred to as "COSTA MESA ", and the CITY OF NEWPORT
BEACH, a municipal corporation, herein referred to as "NEWPORT BEACH ".
WITNESSETH
WHEREAS, the intersection of Irvine Avenue and Dover Drive - 19th
Street lies partially in NEWPORT BEACH and partially in COSTA MESA with the
city boundary running approximately along the centerline of Irvine Avenue; and
WHEREAS, NEWPORT BEACH and COSTA MESA mutually wish to improve said
intersection by the installation of storm drainage and roadway improvements and
the installation of a traffic signal; and
WHEREAS, the Orange County Flood Control District, subject to the
approval of the item in the Orange County Fiscal Year 1974 -5 budget, has agreed
to contribute $60,000 toward the construction of regional storm drainage improve -
meats in the aforementioned intersection; and
WHEREAS, NEWPORT BEACH has prepared Plan No. R- 5237 -S, Sheets 2 thru 6,
detailing the construction of said improvements; and
WHEREAS, COSTA MESA desires to construct a storm drain in Irvine Avenue
and l8th Street to join the aforementioned storm drainage improvements; and
WHEREAS, it will be to the mutual benefit of both NEWPORT BEACH and
COSTA MESA to construct the aforementioned improvements under one contract; and
WHEREAS, NEWPORT BEACH and COSTA MESA desire to set forth their respec-
tive rights and obligations concerning the storm drainage, street and traffic
signal improvements.
NOW, THEREFORE, IN CONSIDERATION OF THE FOREGOING, IT IS AGREED AS FOLLOWS:
1. NEWPORT BEACH SHALL:
a. Provide plans and cost estimates suitable for obtaining bids
for the construction of storm drainage, street and traffic
signal improvements in the intersection of Irvine Avenue with
Dover Drive - 19th Street. Plans shall be reviewed and
approved by COSTA MESA as to portions within the COSTA MESA
boundaries.
b. Reimburse COSTA MESA for NEWPORT BEACH'S share of the project
construction costs as more s,.r.- ;fically set forth in paragraph
3a. Payments to COSTA MESA shall be based on progress
payments made to the contractor and shall be made within
thirty days after the receipt of an itemized statement
from COSTA MESA.
c. Obtain the required Orange County Flood Control District
(hereinafter referred to as OCFCD) permit for improvements
in and adjacent to the East Costa Mesa Flood Control
Channel.
2. COSTA MESA SHALL:
a. Combine the aforementioned intersection plans provided by
NEWPORT BEACH with the COSTA MESA plans for the Irvine
Avenue - 18th Street storm drain to form a single construc-
tion contract.
b. Contract for and supervise the construction of said improve-
ments in both cities.
c. Allow NEWPORT BEACH credit in the billing for construction
costs in an amount equal to COSTA MESA'S share of the engineer-
ing design costs for the preparation of the plans provided by
NEWPORT BEACH. The COSTA MESA share is further described in
paragraph No. 3c.
3. IT IS MUTUALLY AGREED THAT:
a. The respective shares of the construction costs shall be
calculated as follows:
A = The cost of constructing the roadway and storm drain
improvements shown on NEWPORT BEACH Plan R- 5237 -S, Sheets
2 thru 6.
B = Total construction contract cost of the traffic signal
installation at Irvine Avenue and Dover Drive - 19th Street.
NEWPORT BEACH SHARE = 65% (A- $60,000) + 50% B
COSTA MESA SHARE = 35% (A- $60,000) + 50% B
b. Based on a cost estimate of $172,000 for A, $50,000 for B
and a $60,000 contribution to the project from OCFCD, the
NEWPORT BEACH share is $97,800 and the COSTA MESA share is
$64,200.
c. The costs to NEWPORT BEACH for retaining consultants to
prepare the plans were $17,211 for storm drain and roadway
plans and $2300 for traffic signal plans. The COSTA MESA

share of these costs shall be 40 of $1?,211 = $6884.40
Plus 50; of 2300 = $1150 for a total share of $8034.40.
NEWPORT BEACH shall furnish to COSTA MESA an itemized
statement and copies of paid invoices to substantiate con-
sultants charges.
The field inspection costs for each agency shall be calcu-
lated at the termination of the construction contract and
shall be based on the actual payroll costs plus thirty
percent (30 %). These costs shall be shared 60% for Newport
Beach and 40% for Costa Mesa and credit given to the appropriate
agency in the final project billing.
A contract for the construction of the aforementioned improve-
ments shall not be awarded until OCFCD approves their $60,000
contribution.
During construction COSTA MESA shall assign a qualified inspector,
who shall be charged with overall contract administration and who
shall assure that construction is accomplished in accordance with
the plans and specifications. NEWPORT BEACH shall assign a
qualified 'inspector to periodically review work within NEWPORT
BEACH and consult with the COSTA MESA inspector. COSTA MESA'S
inspector shall be in charge of the construction contract, and
any changes requested by the NEWPORT BEACH inspector shall be
made to the COSTA MESA inspector.
Each city shall be responsible for maintaining the roadway and
storm drain improvements that lie: in their city. [NEWPORT BEACH
shall be responsible for the operation and maintenance of the
traffic: signal installation at the Irvine Avenue and Dover Drive -
'19th Street intersection. COSTA MESA agrees to reimburse
NEWPORT BEACH for 50% of the maintenance costs within 30 days of
receipt of an itemized statement of these costs.
That NEWPORT BEACH shall indemnify and hold COSTA MESA harmless
from any liability imposed as a result of any alleged negligence
by NEWPORT BEACH or its agents arising out of NEWPORT BEACH'S
performance of this agreement.
That COSTA MESA shall indemnify and hold NEWPORT BEACH harmless
from any liability imposed as a result of any alleged negligence
by COSTA MESA or its agents arising out of COSTA MESA'S perfor-
mance of this agreement.

IMPROVEMENTS
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain cooperative financing
agreement between the City of Newport Beach and the City of
Costa Mesa for the construction of Dover Drive -- Irvine Avenue --
19th Street Intersection improvements; and
WHEREAS, the City Council has considered the terms and
conditions of said cooperative financing agreement and found them
to be fair and equitable, and in the best interests of the
City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said cooperative financing agreement
above - described is approved, and the Mayor and City Clerk are
hereby authorized and directed to execute the same on behalf of
the City of Newport Beach.
