Santa Ana and Newport Beach have previously entered:into an informal agreement, about November 11070, under the terms of which the _r_arties agreed to participate with other cities within Orange County and with various County of Orange agencies to form a Narcotics Task Force. B. In order to provide essential timely, expeditious, and continually available support to the Task Force members and interface with other law enforcement agencies in the area of narcotic oriented intelligence collection, analyzation and distributions a Coordinator's Office will be established and will be located within the Santa Ana Police Department Building. C. This contract will become operative, if and when the U.S. Department of Justice. Law Enforcement Assistance Administration agrees to fund said program. D. The application for U.S. Department of Justice Law Enforcement Assistance Grant Discretionary Funds which was the subject of Santa Ana City Council Resolution n73 -38 dated April 16, 1973 is hereby incorporated by reference as part of this contract. NOW, THEREFORE, in consideration of the benefits to be derived from establishment of the above referred to Coordinator's Office, by each party, the parties hereto agree as follows: A. The Director of Finance for the City of Santa Ana, as Financial Officer, shall upon award of a Grant resulting from said application, simultaneously estallish a special trust fund designated for Narcotics Task Force Hard Cash Matching Funds. Said trust fund shall be in the amount of $17,334 and shall h-_ disbursed in a manner consistent with the grant conditions. Santa Ana Chief of Police, as Project Director shall order and provide project direction and make payment on behalf of Newport Beach for services provided on aforesaid grant that are required in establishing the Coordinator's Office. C. Newport Beach agrees to deposit with Santa Ana $649 within 90 days, to be Newport Beach's pro -rato share of the Narcotics Task Force Hard Cash Matching Funds. The above funds to be immediately returned to Newport Beach if said grant is not awarded. D• Newport Beach agrees to fulfill all duties as specified and- .-incorporated:by reference application. E. The Project Director and Financial Officer shall receive and disburse project funds through the above two trust accounts in accordance with all legal requirements for the accounting of funds under the Omnibus Crime Control Act and Safe Streets Act of 1968 and any amendments thereof. F. The Project Director shall direct-the Financial Officer to reimburse Newport Beach for any portion of its contribution remaining unexpended at the completion of the project. S 0 2 S f A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF N- ,--PORT BEACH AUTHORIZING THE EXECUTION OF A CONTRACT BETWEEN THE CITY OF NEWPORT BEACH AND THE CITY OF SANTA ANA AGREEING TO PART=CIPATE IN THE LEAA FEDERAL GRANT TO THE ORANGE COUNTY NARCOTIC TASK FORCE WHER° =S, there has been presented to the City Council of the City of `:ewport Beach a certain contract between the City of Newport Beach and the City of Santa Ana wherein the City of Santa Ana is named as the sponsoring city to receive and disburse certain federal grant funds offered to the Orange County Narcotic Task Force by the Law Enforcement Assistance Administration ;LEAA); and WHERE-IS, in order to receive said federal grant monies, the cities of Orange County, all of whom are members of the Narcotic Task Force, must agree to contribute certain matching funds based on population; and WHERE=S, the City of Newport Beach's population per- centage share would be the sum of $649; and WHERE-zS, the City Council believes that it would be in the best interest of the citizens of the City of Newport Beach to agree to share in the matching funds in order to receive said federal grant which will aid in the investigation, apprehension and conviction of major narcotics violators; NOW, ' HEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach hereby agrees to contribute $649 as its share of the matching funds to the LEAA grant to the Orange County Narcotic Task Force. -1- BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby autosized and directed to execute the contract between the Cit-_ of Newport Beach and the City of Santa Ana to participate in the LEAA Federal Grant to the Orange County Narcotic Task =orce.
