SUBJECT: TRAFFIC SIGNAL INSTALLATION AT WEST COAST HIGHWAY AND
RIVERSIDE AVENUE
RECOMMENDATION:
Adopt a resolution authorizing the Mayor and City Clerk to execute
an agreement with Pacific Marine Yachts, Inc. and Clara Coupland
providing for a contribution to modify the subject signal installa-
tion.
DISCUSSION:
Pacific Marine Yachts, Inc. of 2751 West Coast Highway has requested
that the traffic signal at Coast Highway and Riverside Avenue be modified to
provide signal indications for their drive, which is opposite Riverside Avenue;
and to provide a left turn lane and signal indication from Coast Highway into
their drive.
The State Division of Highways has agreed to include this work in
their contract for modernizing the signal system on Coast Highway at Riverside
and Tustin. The estimated additional cost is $3,500. Pacific Marine has
agreed to pay the additional cost for this installation.

AGREEMENT
THIS AGREEMENT is made and entered into this a 7 T// day of
4 V Vk 1973, by and between the CITY OF NEWPORT BEACH, a munici-
pal corporation, hereinafter designated as "City ", and CLARA S. COUPLAND, a
single woman, hereinafter designated as "Owner" and PACIFIC MARINE YACHTS,
INCORPORATED, a California corporation, hereinafter designated as "Pacific
Marine ";

WHEREAS Owner owns and Pacific Marine leases the property des-
cribed as the Southeasterly 100 feet of the Northwesterly 250 feet of
Lot "H" of Tract 919 as shown on a map recorded in Book 29, Pages 31 thru
34 of Miscellaneous Maps, records of Orange County, California, also known
as 2751 West Coast Highway in Newport Beach and said property is opposite
Riverside Avenue; and
WHEREAS Pacific Marine has requested that City install a left
turn lane in westbound Coast Highway at Riverside Drive and provide the
necessary traffic signal modifications to serve said left turn lane and the
private drive entering the aforementioned property; and
WHEREAS City on July 26, 1971 entered into an agreement with the
State of California Division of Highways, hereinafter designated as "State ",
providing for the rechannelization of Coast Highway between The Arches and
650 feet easterly of Tustin Avenue and the reconstruction of the traffic
control signal system at the intersections of Coast Highway with both
Riverside Avenue and Tustin Avenue; and
WHEREAS State has not yet performed said aforementioned improve-
ments and has indicated to City that said modifications requested by Pacific
Marine can be added to the State's project if a request is received from
City.
NOW, THEREFORE, the parties hereto agree as follows:
PACIFIC MARINE AGREES:
1. To pay to City the cost of installing traffic signal equipment
to provide signal indications for a left turn lane and private drive exit.
Said cost is estimated to be $3500. The final cost to Pacific Marine shall

be calculated as follows: the actual State contract cost for the aforemen-
tioned modifications plus 15% of said cost for State construction engineering
costs plus 10% of the modifications contract costs for City administrative
costs. The estimated cost of $3500 shall be deposited with the City within
15 days after the execution of this agreement. After the City receives and
accepts the final billing from the State, the final cost of Pacific Marine
shall be determined as described above. If the final cost of said modifica-
tions exceeds $3500, City will bill Pacific Marine for the amount due and
Pacific Marine shall reimburse City within 30 days of receipt of billing.
Pacific Marine's total obligation for said modifications shall not exceed
$5000 without prior approval by Pacific Marine.
OWNER AND PACIFIC MARINE AGREE:
To grant to State an easement for the installation and maintenance
of traffic signal detector loops in the aforementioned driveway entrance to
the Pacific Marine property; said easement shall be prepared by the State.
CITY AGREES:
1. To contract with the State to construct a left turn lane in
westbound Coast Highway at Riverside Avenue and install the necessary traffic
signal equipment to serve said left turn lane and the private drive to be
constructed by Pacific Marine.
2. To contract with State to operate and maintain the afore-
mentioned additional traffic signal modification and shall pay State for these
services.
3. To refund to Pacific Marine the difference between the actual
cost and $3500 if final costs of said modifications are less than $3500.
Said refund shall be made within 30 days of the City's receipt and acceptance
of the final billing from the State.
IN WITNESS WHEREOF, the parties hereto have caused this agreement
to be executed as of the day, month, and year first above written.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH AUTHORIZING THE
EXECDTION OF AN AGREEMENT BETWEEN THE
CITY OF NEWPORT BEACH AND PACIFIC MARINE
YACT S, INC. AND CLARA COUPLAID PROVIDING
FOR _. CONTRIBUTION TO MODIFY THE TRAFFIC
SIG].AL INSTALLATION AT WEST COAST HIGHWAY
AND RIVERSIDE AVENUE
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and Pacific Marine Yachts, Inc. and
Clara Coupland providing for a contribution to modify the
traffic signal installation at West Coast Highway and Riverside
Avenue; and
WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair and
equitable;
NOW, THEREFORE, BE IT RESOLVED that said agreement for
the contribution above described is approved, and the Mayor and
City Clerk are hereby authorized and directed to execute the
same on behalf of the City of Newport Beach.
