of Costa Mesa and the City of Newport Beach, for a traffic sig-
nal at Placentia Avenue and West 16th Street.
Please have the copies of the agreement executed by the
Mayor and City Clerk and return one copy to me for the central
file.

A G R E E M E N T
THIS Agreement made and entered into this
day of jay„ ��rhJ 1973, by and between the City of
Costa Mes , a municipal corporation, hereinafter called "COSTA
MESA" and the City of Newport Beach, a municipal corporation,
hereinafter called "NEWPORT BEACH."
W I T N E S S E T H
WHEREAS, the safety of motoring and pedestrian traffic
at the intersection of Placentia Avenue and West 16th Street
requires the installation of traffic - actuated control signals
and safety lighting at said intersection; and
WHEREAS, portions of said intersection are within the
City boundaries of the City of Newport Beach and the City of
Costa Mesa; and
WHEREAS, it is the desire of the parties hereto to
set out their respective rights and obligations concerning the
improvment of said intersection.
NOW, THEREFORE, for and in consideration of the cove-
nants contained, performed, and to be performed, the parties
hereto agree as follows:
1. NEWPORT BEACH and COSTA MESA agree to share the
cost of construction of the traffic - actuated signal and safety
lighting system, at the intersection of Placentia Avenue and West
16th Street. COSTA MESA shall, initially, bear the total cost of
construction. NEWPORT BEACH shall, upon receipt of proper demand
reimburse COSTA MESA in an amount equal to twenty -five percent
(25 %) of the total cost of construction. NEWPORT BEACH'S share
of said cost is estimated to be Ten Thousand Dollars ($1. 000.00).
Each party's share of the total cost is equal to the percenta-e
cF legs under its jurisdiction entering the intersection.
2. The total cost for constructing %he project shall
include the actual cost of the construction contract, c3nstruc-
tion engineering, inspection_ and administration as set out in
the final accounting.
3. After completion of the project, the traffic sig-
nals and lighting shall be maintained or modified by COSTA MESA.
4. Any modification to the traffic signal system
shall first be approved by NEWPORT BEACH.
5. Upon annual submission by COSTA MESA maintenance,
modification and energy costs, NEWPORT BEACH shall pay to COSTA
MESA its proper share of said costs which shall be in the same
ratio to the total costs as the number of legs under NEWPORT
BEACH'S jurisdiction entering the intersection are to the total
number of legs entering the intersection, said ratio presently
being twenty -five percent (25 %).
IN WITNESS WHEREOF we have placed our hands and seals
on the day and year first above written.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION
OF A COOPERATIVE FINANCING AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND THE CITY OF
COSTA MESA FOR TRAFFIC SIGNAL INSTALLATION
AT PLACENTIA AVENUE AND 16TH STREET
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain financing agreement be-
tween the City of Newport Beach and the City of Costa Mesa for
traffic signal installation at Placentia Avenue and 16th Street;
and
WHEREAS, the City Council has considered the terms
and conditions of said cooperative financing agreement and has
found them to be fair and equitable;
NOW, THEREFORE, BE IT RESOLVED that the cooperative
financing agreement for the services above described is approved,
and the Mayor and City Clerk are hereby authorized and directed
to execute the same on behalf of the City of Newport Beach.
