SUBJECT: ADDITION TO AUTOMOTIVE PARTS WAREHOUSE (CONTRACT 1572) .
RECOMMENDATION:
Adopt a resolution awarding the contract to Consolidated
Construction Corporation, of Orange, in the amount of
$18,313.00; and authorizing the Mayor and City Clerk to
execute the contract.
DISCUSSION:
At 10:30 A.M. on May 2, 1974 the City Clerk opened and read the
single bid submitted for the project.

770 N. Main Street, Orange Calif., 92668
Engineers Estimate $19,000.00
The low bid is 3.6% under the engineer's estimate. The 1973 -74
General Fund budget contains an appropriation of $19,000 for the project.
The project provides for:
(1) 20' x 40' addition to the Automotive Parts Warehouse at
the Corporation Yard.
(2) An office for the equipment maintenance superintendent
converted from existing warehouse office.
The existing shop building is a steel frame industrial building with
metal siding. The addition will be of similar Construction. Buildings of this
type are commonly built of prefabricated parts by franchised builders. Because
of this, the contract is both a design and construction contract under which the
contractor is required to obtain the building permit and use his own construction
system.
The basic plan and specifications were prepared by the City. The pro-
posed building is only a shell. Lighting, heating and shelving will be added at
a later date.
The contractor submitted a list of 5 similar projects of similar
character completed in the last year. The only work for a public agency consisted
of two metal buildings for the Capistrano Unified School District. The School
District advises that the contractor performed well.

RECOMMENDATIONS:
1. Approve the Plans and Specifications.
2. Authorize the City Clerk to advertise for bids to be
received and opened at 10:30 a.m., May 7, 1974.
DISCUSSION:
This project provides for (1) a 20' x 40' addition to the
automotive parts warehouse at the corporation yard and (2) an office for
the equipment maintenance superintendent.
The 1973 -74 General Fund budget includes $19,000 for the project.
The existing shop building is a steel frame industrial building

Bids must be submitted on Me proposal form attachk
with the contract documents ftnished by the Public Works
Department. The additional copy of the proposal form is to
be retained by the bidder for ids records.
Each bid must be accompanied by cash, carlifled check
or Bidder's Bond, made payable to the city of Newport
Beach, for an amount equal to it. bad 10 percent of the
amount bid.
The title of the. project and the words "SEALED BID"
shall be clearly marked on the outside of .the envelope con-
tabling the bid.
The contract documents that mud be completed, uscuted,
and returned In the sealed bid are:
A. Proposal
B. Designation of Sdmontractors
C. Bidder's Bond
D. Non-collusion Affidavit
E. Statement of Financial Responsibility
F. Technical Ability and EiVerlence References
These documents Mail be affixed with the signature and
titles of the persons signing an behalf of ths bidder. For
corporations, the signatures of the President or Vice Presi-
dent and Secretary or Assistant Secretary an required and
the Corporate Seal shall be affted to all documents requir-
ing signatures. In the can of a Partnership, the signature
of at least one general partner is required. '
No bids Will be accepted from a contractor who has not
been licensed In accordance with the provisions of Chapter
9, Division M of the Business and Professional Code. The
contractor shall state his license number and classification
in the proposal.
One set of plane and contract documents, Including special
provisions. may be obtained at the Public Works Department,
City Hall, Newport Beach, Califtmia, at no cost to licensed
contractors. It is requested that the plus and contract
documents be returned within 2 weft after the bid opening.
The City has adopted the Standard Specifications for Public
Works Construction (1973 Edition) as prepared by the Southern
California Chapters of the American Public Works Associatioi
and the Associated General Contractors of America. Copies
may be Obtained from Building News, Inc., 3055 Overland
Avenue, Los Angeles, California %M, (213) 870-98171.
The City has adopted Standard Special Provisions and Shmi-
ard Drawings. Copies of these are available at the Public
Works Department at a cod of $5.00 per set.
A standard "Certificate of insurance for Contract Work
for City" form has been adopted by the City. This form Is
the only certificate of insuranceacceptable to the City. The
successful low bidder will be required to complete this form
spun award of the contract.
For any required bou* the company Issuing Bid Bonds,
Labor and Material Bonds, and Faithful Performance Bonds
mud be an Insurance company, or surety company licensed
by the State of California. The companies mud also have a
CaTed General Policy Holders Rating. of A or better; and a
Financial Rating d at least AAA as per the latest edition of
god's Key Rating Guide (Property - Llabiftj-

DISCUSSION:
The contract for the design and construction of an addition to
the automotive parts warehouse at the Corporation Yard has been completed
to the satisfaction of the Public Works Department.
The bid price was $18,313.00
The total contract cost 18,313.00
Amount budgeted (Account No. 02- 5295 -026) 19,000.00
The contract date of completion was October 14, 1974. Work was
substantially completed by November 5, 1974. The delay was caused by a
strike of sheet metal workers, but did not seriously inconvenience the
City, as the addition was occupied before being completed.
The design and construction was by Consolidated Construction
Corporation of Orange, California.

NOTICE INVITING BIDS
SEALED BIDS will be received at the office of the City Clerk, City Hall, Newport Beach,
California, until 10:30 A.M. on the 2 day of May , 1974 ,
at which time they will be opened and read, for performing work as follows:
ADDITION TO THE AUTOMOTIVE PARTS WAREHOUSE
CONTRACT NO. 1572
Bids must be submitted on the proposal form attached with the contract documents
furnished by the Public Works Department. The additional copy of the proposal form
is to be retained by the bidder for his records.
Each bid must be accompanied by cash, certified check or Bidder's Bond, made payable
to the City of Newport Beach, for an amount equal to at least 10 percent of the
amount bid.
The title of the project and the words "SEALED BID" shall be clearly marked on the
outside of the envelope containing the bid.
The contract documents that must be completed, executed, and returned in the sealed
bid are:
A. Proposal
B. Designation of Subcontractors
C. Bidder's Bond
D. Non - collusion Affidavit
E. Statement of Financial Responsibility
F. Technical Ability and Experience References
These documents shall be affixed with the signature and titles of the persons signing
on behalf of the bidder. For corporations, the signatures of the President or
Vice President and Secretary or Assistant Secretary are required an the corporate Seal
shall be affixed to all documents requiring signatures. In the case of a Partnership,
the signature of at least one general partner is required.
No bids will be accepted from a contractor who has not been licensed in accordance with
the provisions of Chapter 9, Division III of the Business and Professions' Code. The
contractor shall state his license number and classification in the proposal.
One set of plans and contract documents, including special provisions, may be obtained
at the Public Works Department, City Hall, Newport Beach, California, at no cost to
licensed contractors. It is requested that the plans and contract documents be returned
within 2 weeks after the bid opening.

The City has adopted the Standard 1, ecifications for Public Works Construction
(1973 Edition) as prepare y the out ern a i ornia Chapters of the AmericaF
Public Works Association and the Associated General Contractors of America. Copies
may be obtained from Building News, Inc., 3055 Overland Avenue, Los Angeles,
California 90034, (213) 870 -9871.
The City has adopted Standard Special Provisions and Standard Drawings. Copies of
these are available at the Public Works Department at a cost of $5.00 per set.
A standard "Certificate of Insurance for Contract Work for City" form has been
adopted by the City. This form is the only certificate of insurance acceptable
to the City. The successful low bidder will be required to complete this form
upon award of the contract.
For any required bonds, the company issuing Bid Bonds, Labor and Material Bonds,
and Faithful Performance Bonds must be an insurance company or surety company
licensed by the State of California. The companies must also have a current
General Policy Holders Rating of A or better; and a Financial Rating of at least
AAA as per the latest edition of Best's Key Rating Guide (Property - Liability).
In accordance with the provisions of Article 2, Chapter 1, Part 7 of the California
Labor Code (Sections 1770 et seq.), the City Council of the City of Newport Beach
has ascertained the general prevailing rate of per diem wages in the locality in
which the work is to be performed for each craft, classification, or type of workman
or mechanic needed to execute the contract and has set forth these items in Resolu-
tion No. 8090 adopted September 10, 1973. A copy of said resolution is available
in the office of the City Clerk. All parties to the contract shall be governed by
all provisions of the California Labor Code relating to prevailing wage rates
(Sections 1770 -1781 inclusive).
The City reserves the right to reject any or all bids and to waive any informality
in such bids.

All bids are to be computed on the basis of the given estimated quantities of work,
as indicated in this Proposal, times the unit price as submitted by the bidder. In case
of a discrepancy between words and figures, the words shall prevail. In case of an error
in the extension of a unit price, the corrected extension shall be calculated and the bids
will be computed as indicated above and compared on the basis of the corrected totals.
The estimated quantities of work indicated in this Proposal are approximate only,
being given solely as d basis for comparison of bids.
The undersigned has checked carefully all of the above figures and understands that
the City will not be responsible for any errors or u;tisssu;,3 on the part of the under-
signed in making up this bid.
The undersigned agrees that in case of default in executing the required contract
with necessary bonds within ten (10) days, not including Saturday, Sunday and Federal
Holidays, after having received notice that the contract is ready for signature, the
proceeds of check or bond accompanying this bid shall become the property of the City
of Newport Beach.

CONTRACT
THIS AGREEMENT, made and entered into this Alf—day of "nAf4 19?2IL,
by and between the CITY OF NEWPORT BEACH, California, hereinafter designated as the
City, party of the first part, and Consolidated Construction Corporation
hereinafter designated as the Contractor, party of the second part.
WITNESSETH: That the parties hereto do mutually agree as follows:
1. For and in consideration of the payments and agreements hereinafter mentioned
to be made and performed by the City, the Contractor agrees with the City to furnish all
materials and labor for the construction of
Addition to the Automotive Parts Warehouse - Contract.No. 1572
and to perform and complete in a good and workmanlike manner all the work pertaining
thereto shown on the Plans and Specifications therefor; to furnish at his own proper
cost and expense all tools, equipment, labor, and materials necessary therefor, (Except
such materials, if any, as in the said Specifications are stipulated to be furnished by
the City), and to do everything required by this Agreement and the said Plans and
Specifications.
2. For furnishing all said materials and labor, tools and equipment, and doing
all the work contemplated and embraced in this Agreement, also for all loss and damage
arising out of the nature of the work aforesaid, or from the action of the elements,
or from any unforeseen difficulties which may arise or be encountered in the prosecu-
tion of the work until its acceptance by the City, and for all risks of every description
connected with the work; also, for all expenses incurred by or in consequence of the
suspension or discontinuance of work, except such as in said Specifications are expressly
stipulated tube borne by the City ;`and for well and faithfully completing the work
and the whole thereof, in the manner shown and described in the said Plans and
Specifications, the City will pay and the Contractor shall receive in'.full compensation
therefore the lump sum price, or if the bid is on the unit price basis, the total price
for the several items furnished pursuant to the Specifications, named in the bidding
sheet of the Proposal, as the case May be.
3. The City hereby promises and agrees with the said Contractor to employ, and
does hereby employ the said Contractor to provide the materials and to do the work
according to the terms and conditions herein contained.and referred to for the price
aforesaid, and hereby contracts to pay the same at the time, in the manner, and upon
the conditions set forth in the Specifications; and the said parties for themselves,
their heirs, executors, administrators, successors and assigns, do hereby agree to
the full performance of the covenants herein contained.
4. The Notice to Bidders, Instructions to Bidders, Contractor's Proposal, and the
Plans and Specifications, and all amendments thereof, when approved by the parties
hereto, or when required by the City in accordance with the provisions of the Plans and
Specifications, are hereby incorporated in and made part of this Agreement.

5. Pursuant to the Labor Code of the State of California, the City Council has
ascertained the general prevailing rates of per diem wages for each craft or type of
workman needed to execute the contract and a schedule containing such information is
included in the Notice Inviting Bids and is incorporated by reference herein.
6. The Contractor shall assume the defense of and indemnify and save harmless the
City, the Director of Public Works, and their officers and employees, from all claims,
loss, damage, injury, and liability of every kind, nature, and description, directly or
indirectly arising from the performance of the contract or work, regardless of responsi-
bility for negligence; and from any and all claims, loss, damage, injury, and liability,
howsoever the same may be caused, resulting directly or indirectly from the nature of
the work covered by the contract, regardless of responsibility for negligence.

SCOPE OF WORK
SP 1 of 4
The work to be done under this contract consists of preparing calculations,
working plans, specifications; obtaining a building permit; and constructing:
(A) A 20' x 40' steel frame and metal siding industrial -type building
addition to an existing shop building of similar construction at the
City Corporation Yard, 592 Superior Avenue, Newport Beach, California.
(B) A partition in the existing automotive parts warehouse.
The building addition must meet the requirements of the Uniform Building Code,
1970 Edition, as modified by the Newport Beach Municipal Code.
The existing building has a steel frame with corrugated metal siding and roofing.
The proposed addition must resemble the existing building, and be attached to it
in such a manner as not to transfer any additional vertical or lateral loads to
the existing structure.
No electrical, plumbing, or heating equipment will be installed under this con-
tract.
All building permit fees and other fees normally charged by the City will be
waived; except that each contractor and subcontractor must have a valid City
business license.
No permit is required from the South Coast Regional Conservation Commission.
COMPLETION OF THE WORK
The contractor shall complete all work within 135 calendar days after execution
of the contract by the City.
CONTROL OF THE WORK
The work shall be done under the control of the Public Works Director of the City.
A. Standard Specifications
Except as hereinafter provided, the provisions of the 1973 edition of
the "Standard Specifications for Public Works Construction ", prepared
and promulgated by the Southern California Chapters of the American

Public Works Association and the Associated General Contractors of
America, are adopted as the Standard Specifications for the City of
Newport Beach.
1. For legal and contractual relationships the Standard Specifica-
tions shall govern.
2. For building requirements, the Building Code shall govern.
IV. INSURANCE
A. Contractor's Liability Insurance
The
contractor shall obtain, pay for, and maintain liability insurance in
accordance with the requirements set forth on the "Certificate of
Insurance for Contract Work for City" which is attached to the Notice
Inviting Bids, and which is hereby incorporated and made a part of this
contract.
The limits of liability listed above supersede the limits of liability
listed in Section 7 -3 of the Standard Specifications.
B. Workman's Compensation Insurance
The
contractor shall provide Workman's Compensation Insurance, including
Employer's Liability, of not less than $100,000 covering all persons
employed by the contractor.
C. Delivery to Owner
Two (2) certified copies of above insurance policies or certificates of
insurance shall be delivered, one (1) to the Owner and one (1) to the
Architect, prior to the commencement of work, and shall not be cancelled
except upon not less than fifteen (15) days written notice to the Owner.
V. AWARD AND EXECUTION OF THE CONTRACT
A. Award of Contract
The award of the contract, if it is awarded, will be to the lowest respon-
sible bidder whose proposal complies with all requirements described. The
award, if made, will be made within 30 days after the opening of the bids.
B. Execution of Contract
The contract shall be signed by the successful bidder and returned, together
with the contract bonds, within 10 days, not including Sundays, after the
bidder has received notice that the contract has been awarded. No proposal
shall be considered binding upon the City until the execution of the contract
by the City.
The date of the contract shall be the date that the contract is executed by
the City.

VI. TESTS AND INSPECTIONS
a. Initial tests required by contract documents and retesting if re-
quired will be paid for by the contractor; except that testing of
concrete used in foundations and the floor slab will be paid for by
the owner.
b. The cost of tests or inspections ordered by the owner for the
purpose of determining the existence of faulty materials or faulty
workmanship shall be paid for by the contractor, except when the
tests or inspections determine that faulty materials or faulty
workmanship does not exist, in which case the owner will pay for
the tests or inspections.
c. Local, legally constituted public authorities having jurisdiction
over this construction, and the owner shall be the only persons
empowered to direct tests to determine compliance or non - compliance
with requirements of the work.
VII. GENERAL REQUIREMENTS
A. Utilities
Water and power for the use of the contractor during construction are
available on the site and will be paid for by the owner.
B. Sanitary Facilities
Public toilets are available on the site.
C. Protection
It is necessary that the facility continue in operation during construction.
Contractor shall provide weather and security protection for building areas
left open by demolition. Contractor shall control dust producing operations
by wetting, sprinklering or separating areas by use of plastic sheeting.
Trash shall not be permitted to accumulate and shall be removed from the
site at least once a week and where in or adjacent to operational areas at
the end of each day. Barriers shall be erected to protect the owner's
employees and the public from building operations.
There are underground utilities, these will be located by the owner and
shall be protected by the contractor in any digging or cutting operations.
D. Parking
Contractor's employees shall either park off the site or where directed by
the owner.
E. Schedule
Contractor shall provide owner with a construction schedule which shall be
kept up to date and shall advise owner of time and place that construction
will take place which may interfere with owner's operations.

F. Shop Drawings
Contractor shall submit shop drawings in 3 copies. Submittals shall be
made in sufficient time so as not to cause delay in operations. Contractor
shall check and verify all field dimensions. Drawings shall clearly indicate
by noting and by heavy line any feature that deviates from the original.
G. Telephone
Contractor at his option may install a job telephone or use existing pay
telephone. Other telephones shall not be used.

California 90034, (213) 870 -9871.
The City has adopted Standard Special Provisions and Standard Drawings. Copies of
these are available at the Public Works Department at a cost of $5.00 per set.
A standard "Certificate of Insurance for Contract Work for City" form has been
adopted by the City. This form is the only certificate of insurance acceptable
to the City. The successful low bidder will be required to complete this form
upon award of the contract.
For any required bonds, the company issuing Bid Bonds, Labor and Material Bonds,
and Faithful Performance Bonds must be an insurance company or surety company
licensed by the State of California. The companies must also have a current
General Policy Holders Rating of A or better; and a Financial Rating of at least
AAA as per the latest edition of Best's Key Rating Guide (Property - Liability).
In accordance with the provisions of Article 2, Chapter 1, Part 7 of the California
Labor Code (Sections 1770 et seq.), the City Council of the City of Newport Beach
has ascertained the general prevailing rate of per diem wages in the locality in
which the work is to be performed for each craft, classification, or type of workman
or mechanic needed to execute the contract and has set forth these items in Resolu-
tion No. 8090 adopted September 10, 1973. A copy of said resolution is available
in the office of the City Clerk. All parties to the contract shall be governed by
all provisions of'the California Labor Code relating to prevailing wage rates
(Sections 1770 -1781 inclusive).
The City reserves the right to reject any or all bids and to waive any informality
in such bids.

All bids are to be computed on the basis of the given estimated quantities of work,
as indicated in this Proposal, times the unit price as submitted by the bidder. In case
of a discrepancy between words and figures, the words shall prevail. In case of an error
in the extension of a unit price, the corrected extension shall be calculated and the bids
will be computed as indicated above and compared on the basis of the corrected totals.
The estimated quantities of work indicated in this Proposal are approximate only,
being given solely as a basis for comparison of bids.
The undersigned has checked carefully all of the above figures and understands that
the City will not be responsible for.any errors or omissions on the part of the under-

V. AWARD AND EXECUTION OF THE CONTRACT
A. Award of Contract
The award of the contract, if it is awarded, will be to the lowest respon-
sible bidder whose proposal complies with all requirements described. The
award, if made, will be made within 30 days after the opening of the bids.
B. Execution of Contract
The contract shall be signed by the successful bidder and returned, together
with the contract bonds, within 10 days, not including Sundays, after the
bidder has received notice that the contract has been awarded. No proposal
shall be considered binding upon the City until the execution of the contract
by the City.
The date of the contract shall be the date that the contract is executed by
the City.

VI. TESTS AND INSPECTIONS
a. Initial tests required by contract documents and retesting if re-
quired will be paid for by the contractor; except that testing of
concrete used in foundations and the floor slab will be paid for by
the owner.
b. The cost of tests or inspections ordered by the owner for the
purpose of determining the existence of faulty materials or faulty
workmanship shall be paid for by the contractor, except when the
tests or inspections determine that faulty materials or faulty
workmanship does not exist, in which case the owner will pay for
the tests or inspections.
c. Local, legally constituted public authorities having jurisdiction
over this construction, and the owner shall be the only persons
empowered to direct tests to determine compliance or non - compliance
with requirements of the work.
VII. GENERAL REQUIREMENTS
A. Utilities
Water and power for the use of the contractor during construction are
available on the site and will be paid for by the owner.
B. Sanitary Facilities
Public toilets are available on the site.
C. Protection
It is necessary that the facility continue in operation during construction.
Contractor shall provide weather and security protection for building areas
left open by demolition. Contractor shall control dust producing operations
by wetting, sprinklering or separating areas by use of plastic sheeting.
Trash shall not be permitted to accumulate and shall be removed from the
site at least once a week and where in or adjacent to operational areas at
the end of each day. Barriers shall be erected to protect the owner's
employees and the public from building operations.
There are underground utilities, these will be located by the owner and
shall be protected by the contractor in any digging or cutting operations.
D. Parking
Contractor's employees shall either park off the site or where directed by
the owner.
E. Schedule
Contractor shall provide owner with a construction schedule which shall be
kept up to date and shall advise owner of time and place that construction
will take place which may interfere with owner's operations.

F. Shop Drawings

Contractor shall submit shop drawings in 3 copies. Submittals shall be
made in sufficient time so as not to cause delay in operations. Contractor
shall check and verify all field dimensions. Drawings shall clearly indicate
by noting and by heavy line any feature that deviates from the original.
G. Telephone
Contractor at his option may install a job telephone or use existing pay
telephone. Other telephones shall not be used.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AWARDING A CONTRACT FOR
CONSTRUCTION OF ADDITION TO THE AUTOMOTIVE
PARTS WAREHOUSE, CONTRACT NO. 1572
WHEREAS, pursuant to the notice inviting bids for
work in connection with the construction of the addition to
the automotive parts warehouse, in accordance with the plans
and specifications heretofore adopted, bids were received on
the 2nd day of May, 1974, and publicly opened and declared;
and
WHEREAS, it appears that the lowest responsible
bidder therefor is Consolidated Construction Corporation of
Orange;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that the bid of Consolidated
Construction Corporation for the work in the amount of $18,313.00
be accepted, and that the contract for the described work be
awarded to said bidder;
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are hereby authorized and directed to execute a contract in
accordance with the specifications, bid and this award on
behalf of the City of Newport Beach, and that the City Clerk
be directed to furnish an executed copy to the successful
bidder.
