Enclosed are two fully executed copies of subject agreement in
connection with properties:>within the noise impact area of
Orange County Airport. Please transmit one copy to Mawhinney
and Long and retain one for your files.

A G R E E M E N T
(Appraisal Services)
THIS AGREEMENT, made and entered into this J!J if{
day of -gFP7.Z-1, , 1973, by and between the CITY OF
NEWPORT BEACH, a municipal corporation, hereinafter referred
to as CITY, and MAWHINNEY AND LONG, real estate appraisers,
hereinafter referred to as APPRAISERS.
W I T N E S S E T H
WHEREAS, CITY has determined that it is desirable
and necessary to have certain appraisals of specific parcels
affected by jet aircraft overflights prepared; and
WHEREAS, these appraisals will aid the CITY in its
proposed lawsuit against the Orange County Airport; and
WHEREAS, APPRAISERS are qualified to undertake and
complete such appraisals.
NOW, THEREFORE, THE CITY and APPRAISERS, in consider-
ation of the mutual covenants and agreements hereinafter con-
tained, do hereby agree, each with the other, as follows:
1. APPRAISERS will prepare complete reports on ten
(10) residential properties located within the jet aircraft
noise impact area emanating from Orange County Airport.
2. The ten (10) properties are to be selected by
APPRAISERS as representative of property economically affected
by the noise associated with low flying jet aircraft.
3. The reports and twelve (12) copies are to be
completed and submitted to CITY on or before November 19, 1973.

4. Upon submission of the reports, CITY will pay
APPRAISERS the sum of $7,500.00 which will consitiute the total
fee for their services.
IN WITNESS WHEREOF, the parties hereto have caused
this Agreement to be executed on the date first above written.

WHEREAS, ther�, has been presented to the CiCv Cninci1
D , f the C'cy of Newport Baacn a certain agreement between the
City of Newport Beach and Mawhinney and Long, Real Estate Ap-
praisers, for appraisal services on ten residential properties
located within the noise impact area of Orange County Airport;
and
WHEREAS, the City Council has considered the terms and
conditions of said agreement and found them to be fair and
equitable;
NOW, THEREFORE, BE IT RESOLVED that said agreement for
the services above described is approved, and the Mayor and City
Clerk are hereby authorized and directed to execute the same on
behalf of the City of Newport Beach.
