Subject: Agent between the cities of Newport Beach
and Laguna Beach to share the use of Data
Processing Facilities
Enclosed is a fully executed cony of subject agreement.
The City Consicil of Newport Beach authorized the execution
of this agent on September 24 by the adoption of
Resolution No. 8100.

A G R E E M E N T
THIS AGREEMENT is made and entered into this r
day of Ec.;c r r2 1973, by and between the CITY OF NEW —PORT
BEACH, a municipal corporation, hereinafter referred to as
"NEWPORT BEACH" and the CITY OF LAGUNA BEACH, a municipal cor-
poration, hereinafter referred to as " LAGUNA BEACH."
W I T N E S S E T H:
WHEREAS, Newport Beach is capable and willing to
perform certain data processing services, and
WHEREAS, Laguna Beach and Newport Beach desire to
share the use of such capabilities, and data processing facili-
ties;
WHEREAS, it is recognized that the sharing of the use
of such data processing facilities will be advantageous to both
parties to this Agreement.
NOW, THEREFORE, in consideration of the mutual covenants,
conditions, agreements and stipulations hereinafter expressed,
the parties hereto hereby agree as follows:
1. Newport Beach shall perform data processing ser-
vices as requested by Laguna Beach. Said services shall be con-
ducted at such times and in the manner deemed appropriate by
Newport Beach.
2. Laguna Beach will furnish pickup and delivery for
all materials used by it in connection with this activity.
3. Laguna Beach will pay to Newport Beach the following
charges as incurred:
A. Key punching
B. Computer operator
C. Computer meter hours
$5.00 /hour
5.50 /hour
25.00 /hour (at Costa
Mesa)
D. Newport Beach shall be reimbursed by Laguna
Beach for all other expenses incurred in the

performance of data processing services
requested by Laguna Beach pursuant to this
contract.
4. Newport Beach will furnish to Laguna Beach non-
chargeable NCR prepackaged computer programs when available.
5. It is intended by the parties that this agreement
shall be terminated at such time in the future as Newport Beach
acquires an in -house computer system.
6. The term of this contract shall be for one month
and shall continue for successive periods of one month each un-
less the legislative body of either party hereto votes to ter-
minate the contract. Notice of termination shall be provided
to the other party in writing at least 30 days prior to the
date of termination.
7. This agreement shall take effect and shall become
operative when executed by the parties hereto. The charges
set forth in Paragraph 3 shall become due and payable when
development /operating computer time is made available to Laguna
Beach.
8. Laguna Beach will be billed monthly and amount will
be due and payable within thirty (30) days.
IN WITNESS WHEREOF, the parties hereto have set their
hands the day and year as is first above written.

RESOLUTION NO. 8 106
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
AN AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH
AND THE CITY OF LAGUNA BEACH TO SHARE THE USE
OF DATA PROCESSING FACILITIES
WHEREAS, there has been presented to the City Council
of theCity of Newport Beach a certain contract between the City
of Newport Beach and the City of Laguna Beach to share the use
of data processing facilities; and
WHEREAS, the City Council has considered the terms and
conditions of said contract and found them to be fair and
equitable;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said contract above described is
approved, and the Mayor and City Clerk are hereby authorized and
directed to execute the same on behalf of the City of Newport
Beach.
