DISCUSSION: As one of the conditions for approval of the construction of the Lido Condominium, 601 Park Lido Drive, the developer was required to completely relandscape two - thirds of the existing park facility. As part of this program, the City of Newport Beach appropriated funds to redevelop the other one -third of the Park so that the total Park could be rejuvenated under one contract. In November, 1973 the City entered into an agreement with the Everman Con- struction Company for them to provide plans and specifications for the project and to award the contract for construction. Plaza Landscaping of the City of Orange was the successful bidder. Estimated cost of the project was $21,000 with the City's anticipated share to be $7,000. Total expenditures for the project were $14,500 and the City's share was $4,834. The project has now been completed and the 30 -day maintenance period, that was a condition of the landscape contract, has terminated. The City of Newport Beach in a final walk -thru on February 1, 1974 approved the installation and accepted the site for maintenance. The City was not the contractor on this project and holds no bonds that need to be released. However, since City expenditures were involved, the City Council is being notified of the completion of the project. H Calvin C. (2) Authorize the expenditure of up to $7,000 for the City's share in the project. DISCUSSION: As one of the conditions of a use permit to construct the high rise building adjacent to Lido Park, the developer is responsible for the reconstruction of two- thirds of the park. The reconstruction would include grading, removal of some trees, the installation of trees and other plant material and the installation of an automatic sprinkler system. Since the Everman Construction Company will be redeveloping two - thirds of the park, and the remaining one -third also needs re- development, it would be to the advantage of the City to participate in a total redevelopment program with the Everman Construction Company. They will provide the landscape plans and specifications which will be approved by the City of Newport Beach, and they will award one contract for the entire park project. The City will reimburse the Everman Construction Company for one third of the cost involved, up to a maximum of $7,000. Funds are budgeted in the current fiscal year for this project. REIMBURSEMENT AGREEMENT THIS AGREEMENT is made and entered into this day of November) , 1973, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as "CITY," and the EVERMAN CONSTRUCTION COMPANY, hereinafter re- ferred to as " EVERMAN." W I T N E S S E T H: WHEREAS, a condition attached to the approval of Use Permit No. 1482 requires EVERMAN to redevelop two- thirds of Lido Park located in the City of Newport Beach; and WHEREAS, CITY has determined that it is desirable to redevelop the remaining one -third of said park; and WHEREAS, it would be economically advantageous to CITY to develop the remaining one -third of said park in con- junction with the redevelopment undertaken by EVERMAN. NOW, THEREFORE, IN CONSIDERATION of the foregoing premises, the parties hereto agree as follows: 1. EVERMAN shall: (a) provide architectural services, plans and specifications for the development of the entire Lido Park; (b) advertise for bids and select a contractor for said project; and (c) advance all development costs for said project. 2. CITY shall reimburse EVERMAN for one -third of the redevelopment costs. CITY's share shall not exceed Seven Thou- sand Dollars ($7,000.). 3. It is further mutually agreed by and between the parties that EVERMAN shall indemnify and hold CITY harmless from any liability imposed as a result of any alleged negligence by EVERMAN or its agents arising out of EVERMAN's performance in the construction work provided for in this Agreement. -1- • 0 4. This Agreement may be modified, altered or amended provided that a written document setting forth such modifications, alterations or amendments be executed by the parties hereto. DRB dm 10/29/73 i -7-7 0 0 RESOLUTION NO. 8 115 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF A REIMBURSEMENT AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH AND EVERMAN CONSTRUCTION COMPANY PROVIDING FOR THE DEVELOPMENT OF LIDO PARK WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain reimbursement agreement between the City of Newport Beach and Everman Construction Company which provides for the development of Lido Park; and WHEREAS, the City Council has considered the terms and conditions of said reimbursement agreement and found them to be fair and equitable, and in the best interests of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said reimbursement agreement above described is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach.
