November 27, between the County of Orange and the City of Newport Beach, provid.n„ for street sweeping at the Orange County Airport. COUNTY AIRPORT THIS AGREEMENT, mncle and entered into this 1st day of October, 1973, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter, referred to as "City ", and the COUNTY OF ORANGE, a body corporate and politic, hereafter referred to as "County" 1.7 I T N E S S E T H: WHEREAS, the County requires certain street sweeping services at the Orange County Airport; and WHEREAS, the City presently has the required personnel and equipment and does sweep streets in the vicinity of the Orange County Airport; and WHEREAS, the County desires to contract with the City for such street sweeping services; and WHEREAS, the provisions of Title 1, Division 7, Chapter 5, Article 1 of the California Government Code, entitled "Joint Exercise of Powers Agreements," authorize two or more public agencies to jointly exercise any power common to the contracting parties; NOW, THEREFORE, the parties agree as follows: 1. The City agrees to furnish street sweeping services to the County by sweeping once a week approximately four curb miles of roadway along Airport Way North, Loop Road, and Airport Way South. 2. The scheduling of the service to be provided shall be agreed upon by the City General Services Director and the County Director of Aviation, who are hereby designated the administrators of this Agreement by the City and County, respectively. 3. The County agrees to pay the City for the services pro- vided at the rate of three dollars and seven cents ($3.07) per curb mile per sweeping. 4. The County Auditor - Controller shall nay the City for i - i I I services performed within thirty (30) days following receipt of a I 2'. written invoice by the County. i 3� 5. This Agreement shall remain in effect until terminated 4 by either party following thirty (30) days' written notice. 51 6. The County by entering into this Agreement assumes no i 61 liability for the payment of salary, wages, retirement benefits, work- 7 men's compensation or any other employee benefits to any officer, I g employee or agent of the City engaged in providing services to County 9i pursuant to this Agreement. 10i 7. County agrees to defend, hold harmless and indemnify City 11 against any claim, lawsuit or judgment for damages arising out of City's 12 performance of the services provided for in this Agreement regardless i 13i of responsibility for negligence. Box 687 Santa Ana, CA 92702 i Enclosed is a copy of Resolution No. 8129, a resolution of the City Council of Newport Beach authorizing the execu- tion of a joint exercise of powers agreement between the City of Newport Beach and the County of Orange for street sweeping at the Orange County Airport. The new agreement is being forwarded to you by our General Services Director. Laura Lagios City Clerk LL:swk enc. 11 O 121973 y. ..i,•� pc FrA': to 0 RESOLUTION N0. 8 1 A RESOLUTION OF THE CITY COUNCIL OF TEE CITY OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF A JOIN ^1 EXERCISE OF POWERS AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH AND THE COUNTY OF ORANGE FOR STREET SsiEPING AT THE ORANGE COUNTY AIRPORT WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain agreement between the City of Newport Beach and the County of Orange to provide for street sweeping services at the Orange County Airport, which agreement supersedes the agreement formerly entered into between the parties and authorized by Resolution 7880 dated November 20, 1972; and WHEREAS, the City Council has considered the terms and conditions of said joint exercise of powers agreement and found them to be fair and equitable and in the best interests of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said joint exercise of powers agreement for the street sweeping services above described is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach; BE IT FURTHER RESOLVED that the former agreement between the County of Orange and the City of Newport Beach for street sweeping services at the Orange County Airport, authorized by Resolution 7880, dated November 20, 1972, is hereby terminated by reason of execution of said new agreement, and the City Clerk is directed to notify the County of Orange, in writing, of such termination.
