AGREEMENT FOR PROFESSIONAL_ENGINEERING SERVICES
Study of Bicycle Lane Additions to the Arches
and Lido Isle Bridges
THIS AGREEMENT is made and entered into this Z% rif day of
1973, by and between the CITY OF NEWPORT BEACH, a municipal
corporation, hereinafter referred to as "CITY" and the firm of LAMPMAN AND
ASSOCIATES, Governmental Consultants, Consulting Civil Engineers, a California
corporation, hereinafter referred to as "ENGINEER ";
WITHESSETH
WHEREAS, CITY intends to study the feasibility of adding exclusive
bicycle lanes to The Arches Bridge crossing the West Newport Channel and Coast
Highway, and to the Lido Isle Bridge crossing the West Lido Channel, in the
City of Newport Beach; and
WHEREAS, engineering services are necessary to prepare the study; and
WHEREAS, ENGINEER has submitted a proposal to perform the "Study of
Bicycle Lane Additions to the Arches and Lido Isle Bridges "; and
WHEREAS, CITY desires to accept ENGINEER'S proposal;
NOW THEREFORE, the parties hereto agree as follows:
1. GENERAL
CITY engages ENGINEER to furnish the services hereinafter speci-
fied for the compensation herein stipulated, and ENGINEER agrees
to perform such services upon said terms.
2. DUTIES OF ENGINEER
The ENGINEER shall:
(a) Investigate the feasibility of adding bicycle lanes to the
Lido Isle Bridge; and to the Arches Bridges over the West Newport
Channel and Coast Highway, or the construction of a separate
bicycle bridge over Coast Highway.
(b) Develop alternative schemes for the installation of such
facilities.
(c) Investigate various means of gaining bicycle access from
approach roadways to The Arches and Lido Isle Bridges and from
intersecting roadways southerly and northerly of The Arches Bridge.

(d) Prepare cost estimates for feasible alternatives.
(e) Prepare schematic plans and renderings of feasible altern-
tives suitable for exhibition at public meetings.
(f) Coordinate and consult with the CITY's staff and the CITY's
Bicycle Trails Committee at the CITY's request from time to time
during study preparations.
(g) Prepare a report on the various alternatives to include
schematic plans and a recommendation regarding implementation
of the selected alternative. It is the CITY's intention that
this report be as concise in presentation as possible. Background
information and calculations shall be presented in appendix form
under separate cover.
3. DUTIES OF CITY
CITY agrees to provide ENGINEER the following:
(a) Available topographic information, bridge as -built plans,
aerial photographs, street improvement plans, and profiles, and
any other data mutually agreed to be beneficial to the study by
the parties hereto.
(b) Supplemental field survey information'to clarify or extend
the limits of available topographic information outlined in sub-
section 3(a) above
(c) Consultation with the ENGINEER as required to accomplish the
study.
4. COMPLETION OF SERVICES
ENGINEER agrees to complete all of the services specified herein
by March 1, 1974,
5. PAYMENT BY CITY
CITY agrees to pay ENGINEER for all services called for under the
provisions of this AGREEMENT on the basis of the hourly rate
schedule set forth below.

The total fee shall not exceed $9,200.00 unless the scope of
services is modified; in which case the maximum allowable fee
may be revised as set forth in paragraph 7 below. Compensation
for out -of- pocket expenses and extra work shall be as provided
for in paragraphs 5(2)(c) and 6 below.
(1) Hourly rates for professional and technical personnel shall
shall be as follows:
Professional Engineers $36.00 /hr.
Technicians
Clerical
$24.00 /hr.
$12.00 /hr.
(2) The contract amount shall be paid to ENGINEER as follows:
(a) Monthly partial payments shall be based on the amount
earned each month, as determined by the fee schedule. The
sum of the monthly partial payments shall not exceed ninety
(90) percent of the maximum fee.
(b). Balance of the total amount earned to be paid upon com-
pletion of work specified in Section 2, (Duties of Engineer)
set forth above.
(c) In addition, CITY agrees to reimburse ENGINEER for the
actual cost of reproduction (blue printing, copying, print-
ing, etc.) of copies of said study and exhibits thereto, and
other related costs authorized by the Public Works Director
and advanced by ENGINEER.
6. ADDITIONAL WORK
Should ENGINEER complete any additional work not outlined in this
AGREEMENT, but authorized by CITY, such as attendance at formal
public hearings and revisions to the completed study, the extra
work will be done on an hourly basis in accordance with the hourly
rate standard fee schedule set forth in Section 5 above.
7. STUDY SCOPE REVISIONS
The scope of the study may be changed and the maximum fee revised
upon prior written approval of the Public Works Director if the

increase in said fee does not exceed Nine Hundred Dollars
($900.00). If revisions to the scope of the study would
result in an increase in the maximum fee exceeding $900.00,
an amendment to this agreement providing for such revisions
shall be processed and executed by the parties hereto.
8. ENGINEER IN CHARGE
Arthur E. Goulet, RCE No. 14305, shall be Engineer in charge
of this study.
9. RIGHT OF TERMINATION
CITY reserves the right to terminate this agreement at any
time by giving ENGINEER three (3) days prior written notice;
notice shall be deemed served upon deposit in the United States
mail, postage prepaid, addressed to any of ENGINEERS' business
offices. In the event of termination due to fault of ENGINEER,
CITY shall be relieved of any obligation to compensate ENGINEER.
If this agreement is terminated for any reason other than fault
of ENGINEER, CITY agrees to compensate ENGINEER for the actual
services performed up to the effective date of the notice of
termination, on the basis of the fee schedule contained herein.
10. OWNERSHIP OF STUDY DOCUMENTS
Original drawings, notes, maps, and other documents contained
in this study shall become the property of the CITY and may be
reproduced as deemed necessary by the Public Works Director.
11. ASSIGNMENT
This agreement or any portion thereof shall not be assigned
without the written consent of the CITY.
12. HOLD HARMLESS
ENGINEER shall assume the defense of and indemnify and save
harmless the CITY, and its officers and employees, from all
claims, loss, damage, injury and liability directly arising
from any errors, omissions, or negligence in ENGINEERS' perform-
ance of this agreement or from the engineering work and services
herein provided.

OF NETvPORT BEACH AUTHORIZING THE EXECUTION OF
AN ENGINEERING SERVICES AGREE1,1ENT BETWEEN THE
CITY OF NEWPORT BEACH AND LAM_IPMAN & ASSOCIATES
FOR BICYCLE CROSSINGS AT LIDO ISLE BRIDGE, TIM
ARCHES, AND WEST NEWPORT LIBRARY
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain engineering services
agreement between the City of Newport Beach and Lampman &
Associates, for bicycle crossings at Lido Isle Bridge, The
Arches, and the West Newport Library; and
WHEREAS, the City Council has considered the terms
and conditions of said engineering services agreement and found
them to be fair and equitable, and in the best interests of
the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said engineering services
agreement above described is approved, and the Mayor and City
Clerk are hereby authorized and directed to execute the same on
behalf of the City of Newport Beach.
