WYLIE CARLYLE, Zu a,uiilj i'le aider THIS agreement made and entered into this Ze, 7 -/-/- day of 1 1973, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter referred to as "CITY", and LOS ANGELES FEDERAL SAVINGS AND LOAN ASSOCIATION, a federally chartered corporation, hereinafter referred to as "ASSOCIATION". W I T N E S S E T H: WHEREAS, ASSOCIATION is the owner of that real property located at the northwest corner of Newport Boulevard and 32nd Street in the City of Newport Beach, County of Orange, State of California., described as follows: and Parcels 1 and 2 as shown on the parcel map filed November 27, 1973, in Book 57, Page 4 of Parcel Maps, County of Orange, State of California: WHEREAS, ASSOCIATION proposes to operate a savings and loan office on Parcel 2 of said property; and WHEREAS, there are presently no parking spaces existing on that parcel of property; and WHEREAS, Section 20.38.040 of the Newport Beach Municipal Code provides for off-street parking on a. separate lot provided certain conditions are satisfied; and WHEREAS, ASSOCIATION proposes to provide the required parking for the savings and loan office on Parcel 1 of the above-described real property which ASSOCIATION owns; and WHEREAS, at its meeting of January 18, 1973, the Planning Commission of the City of Newport Beach approved Use Permit No. 1747 which would allow property in a residen- tially zoned area to be used for parking in conjunction with the savings and loan office on condition that the City Council approve an off-site parking agreement® NOW, THEREFORE, in consideration of the approval by CITY of the ASSOCIATION'S intended use of the off-site parking lot to provide the required parking spaces for the proposed savings and loan office, the parties hereto agree as follows: 1. For as long as Parcel 2 of the above-described real property is occupied by the proposed savings and loan office, not less than eighteen (18) parking spaces shall be provided on Parcel 1 of said property. These spaces shall be for the exclusive use of the customers and business invitees of the savings and loan office and shall be provided as set forth on the Plan of Parking, which is attached hereto as Exhibit "A", and incorporated herein as if fully set forth. 2. In the event ASSOCIATION'S ownership of the off-site parking lot is terminated for any reason, it shall immediately thereafter obtain additional off-site parking spaces satisfactory to and approved by the CITY in order to meet the municipal code requirements existing at that time. If ASSOCIATION is unable to obtain such new parking facili- ties, it shall close the savings and loan office. 3. This agreement shall run with the real property described herein and shall bind the heirs, successors and assigns of the parties hereto, and it shall be recorded in the office of the County Recorder of the County of Orange. -2- IN WITNESS WHEREOF, the parties hereto have executed this agreement as of the day and year first above written. I X Authorized by Resolution No. 8152. _ City Manager authorized by Resolution No. 6773 to accept easement deeds. x �X� Laura Lagios City Clerk LL:swk enc. • i RESOLUTION NO. 8 15 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF AN OFF -SITE PARKING AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH AND LOS ANGELES FEDERAL SAVINGS AND LOAN ASSOCIATION WHEREAS, there has been presented to.the City Council of the City of Newport Beach a certain off -site parking agreement between the City of Newport Beach and Los Angeles Federal Savings and Loan Association; and WfMREAS, the City Council has considered the terms and conditions of said off -site parking agreement and found them to be fair and equitable, and in the best interests of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said off -site parking agreement above described is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach. Mayor mh 12/4/73 �r 71 December 6, 1973 r City Council Meeting December 10, 1973 Council Agenda No. H -2 (f) CITY OF NEWPORT BEACH TO: City Council FROM: Department of Community Development SUBJECT: Off -Site Parkin A reement for Los An eles Federal Savings and Loan Association Use Permit No. 1646 LOCATION: A Los Angeles Federal Savings and Loan Association branch to be constructed at- 32 01_.Newgo_rt.39-t1Evi�rd, on the northwest corner of Newport Boulevard and 32nd Street, and the proposed off -site parking lot to be located at the northerly corner of 32nd Street and Marcus Avenue in Central Newport. RECOMMENDATION: Adopt resolution authorizing the execution of an off -site parking agreement between the City of Newport Beach and the Los Angeles Federal Savings and Loan Association. BACKGROUND: At its meeting of January 18, 1973, the Planning Commission approved Use Permit No. 1646 to permit two R -2 lots to be used for parking in conjunction with the subject savings and loan office in the C -1 District. A condition of approval attached to the use permit provides that "an off -site parking agreement be approved by the City Council." At its meeting of February 26, 1973, the City Council adopted Reso- lution No. 7932, authorizing the execution of a Grant Deed conveying surplus public property, comprised of approximately 1,020 sq.ft. at the northerly corner of 32nd Street and Marcus Avenue, to the Los Angeles Federal Savings and Loan Association that would permit ad- ditional landscaping and parking spaces for the proposed parking lot. ANALYSIS: The attached parking layout indicates that nineteen parking spaces can be accommodated in the proposed parking lot, where only eighteen spaces are required as a condition of approval of Use Permit No. 1646. The proposed structure will have a net floor area of approximately 4,500 sq.ft., and the condition of approval states that "a minimum of one parking space shall be provided in the parking lot for each 250 sq.ft. of net floor area in the savings and loan building."
