Copies to: FiLC C_t;gg AGREEMENT FOR ENGINEERING SERVICES (Lido Park Drive - -The Rhine Wharf Park) THIS CONTRACT is made and entered into this !,p Ty day of 0-19A y , 1974, by and between the CITY OF NEWPORT I BEACH, a municipal corporation, hereinafter referred to as "CITY ", and RAUB, BEIN, FROST & ASSOCIATES, a civil engineering consulting firm, hereinafter referred to as "ENGINEER ": W I T N E S S E T H: WHEREAS, CITY intends to improve portions of Lido Park Drive (as shown on Exhibit "A" attached hereto and made a part hereof by this reference), with the construction of the Rhine Wharf Park, street improvements, storm drain modifications, street lighting improvements, and other miscellaneous improvements; and WHEREAS, ENGINEER has submitted a proposal to CITY to perform the engineering services in connection with said project; and WHEREAS, CITY desires to accept said proposal. NOW, THEREFORE, in consideration of the foregoing, it is hereby agreed by and between the parties hereto as follows: 1. General CITY engages ENGINEER to perform the services hereinafter described, for the compensation herein stated, and ENGINEER agrees to perform said services upon the terms hereinafter set forth. 2. Services to be Performed by Engineer ENGINEER shall: A. Perform a preliminary investigation of the overall project, including contacts with the City, the Orange County Harbors, Beaches, and Parks District and all affected utility i companies. B. Perform supplemental field topographic location and elevation surveys necessary for the completion of project design. -1- 0 C. Prepare a preliminary engineering design of sufficient detail for the City's use in reviewing and coordinating the design among City Departments. D. Prepare detailed and complete street improvement plans in accordance with the standard requirements of the City of Newport Beach, for the improvement of Lido Park Drive from approxi- mately 125 feet easterly of Lafayette Avenue to 28th Street, including the construction or reconstruction of the following: (1) New wood wharf and boardwalk overhanging the existing bulkhead at The Rhine (approximately 360 linear feet) of which the portion adjacent to the loading area shall be designed for legal -limit wheel loading. Particular attention shall be directed to long -term durability, minimizing maintenance requirements, and use of the wharf for commercial fishing boat service operations; required; (2) Curb, gutter, sidewalk and drive approaches as (3) Permanent loading ramp (from Station 1 + 25± to Station 3 + 00 ±); 28th Street; at the wharf; (4) Storm drain system modifications as required; (5) A.C. pavement overlays and joins as required; (6) Extension of existing 6" A.C.P. water main to (7) Fire hydrant and sprinkler fire protection service (8) Domestic water supply facilities to the wharf; (9) Sewer connection to the loading area; (10) Electrical power supply facilities to the wharf (this portion of the plans to be signed by registered electrical engineer); (11) Street lighting system, and other miscellaneous street improvements required for a complete project. E. Prepare estimate of construction quantities and costs, and verify the adequacy of CITY budget figures for the project during the course of design and plan preparation. Any discrepancies between -2- r' the project scope and the budget shall be immediately brought to the CITY's attention, and the discrepancy resolved before proceeding further with the plans. F. Verify with the CITY the acceptability of the various design features of the project during the course of plan prepara- tion. G. Prepare special provisions, bid proposals, and contract documents for the improvements outlined above suitable for use by the CITY in calling for competitive bids. H. Not be responsible for performing any revisions required by any State and /or Federal agencies, commissions or boards. I. Prepare final quantity and related ENGINEER's cost estimate for the improvements outlined above. J. Coordinate design with the public utility companies. K. Be available for consultations and advice during design and construction of the project. L. Check the required shop drawings and make minor revisions of the plans and specifications as necessary in order to accommodate unknown conditions discovered during construction. 3. Duties of City CITY shall: project. A. Provide standard plan sheets. B. Provide consultations as required during the project. C. Provide soils information required for design of the D. Prepare any irrigation and landscaping plans which may be needed. E. Make such project presentations as may be necessary to the Parks, Beaches and Recreation Commission and other groups. F. Prepare right -of -way descriptions and drawings as required. 4. Original drawings, reports, notes, maps and other documents -3- 0 0 shall become the property of the CITY and may be reproduced as deemed necessary by the Public Works Director. 5. CITY reserves the right to terminate this contract at any time by giving ENGINEER three (3) days' prior written notice in the United States mails, postage prepaid, addressed to any of ENGINEER's business offices. In the event of termination due to fault of ENGINEER, CITY shall be relieved of any obligation to compensate ENGINEER. If this agreement is terminated for any reason other than fault of ENGINEER, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termination on the basis of the fee schedule contained in this agreement. 6. All engineering services for the project as set forth in paragraph 2 of this agreement shall be completed to the satis- faction of the Public Works Director of CITY within one hundred and twenty (120) consecutive calendar days following authorization by CITY to proceed. The above time of completion includes 30 consecutive calendar days for the CITY's review of the preliminary drawings. 7. In consideration of the performance of the above- described engineering services, CITY agrees to pay ENGINEER an amount based upon the hourly rate schedule set forth below, but in no event shall said amount be greater than eleven thousand eight hundred dollars ($11,800.00). Professional Consultation $35.00 per hour Registered Engineer $30.00 " Engineering Design Calculations and Supervision $24.00 " Drafting $20.00 " Field Survey Crew (3 -Man) $64.00 " Technician $15.00 " These hourly rates will be subject to an eight percent (8 %) increase each ensuing August 1, beginning August 1, 1975 until completion of the project. Should CITY authorize work at overtime rates, the rates set forth above will be increased to 1 1/2 times the amounts shown. • ENGINEER reserves the right to increase the unbilled portion of the maximum fees by eight percent (8%) per year or to terminate this agreement and renegotiate the costs as provided herein should any of the work outlined in this proposal still need to be completed on August 1, 1976. The amount to be paid to ENGINEER shall be payable as follows: A. monthly partial payments, each payment to be the amount earned as determined by the fee schedule. The sum of the monthly partial payments shall not exceed ninety percent (9(r) of the above maximum fee. B. The balance of the total amount to be paid upon acceptance of the construction work by the City Council, but in no event later than twelve (12) months after the Public Works Director signs the plans. In addition, CITY shall reimburse ENGINEER for the actual cost of reproduction of copies of said plans, specifications and related documents and other related costs authorized by the Public Works Director and advanced by ENGINEER. 8. The scope of services to be furnished by ENGINEER may be changed and the maximum fee revised upon prior written approval of the Public Works Director if the increase in the maximum fee specified does not exceed one thousand five hundred dollars ($1,500.00). If a change in the scope of services to be furnished by ENGINEER would result in an increase in the specified maximum fee exceeding one thousand five hundred dollars ($1,500.00), a written amendment to this agreement providing for such change shall be prepared and executed by the parties to the agreement. 9. ENGINEER shall indemnify and hold harmless CITY, and its officers, agents and employees, from all damage and liability arising from any errors, omissions, or negligence in ENGINEER's performance of this contract and of the engineering work and services herein provided. -5- I IN WITNESS WHEREOF, the parties have executed this contract as of the day and year fi above written. ATTEST:�'� CITY "OF NEWPORT BEACH, a municipal corporation U\� ity Cler Mayor APPROVED AS TO FORM: As istant City Attorney CITY RAUB, BEIN, FROST AND ASSOCIATES, T44 ok exz= Fn':'� C-- it i cz NAI ..- 0 a lz JUL 8 1974 By the CITY COUNCIL CITY OF lofiwp"i BEACH 0 0 RESOLUTION NO. 830 9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH AND RAUB, BEIN, FROST & ASSOCIATES FOR ENGINEERING SERVICES IN CONNECTION WITH RHINE WHARF PARK DESIGN AND LIDO PARK DRIVE IMPROVEMENTS WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain engineering services agreement between the City of Newport Beach and Raub, Bein, Frost & Associates for the design of the Rhine Wharf Park and miscellaneous street improvements on Lido Park Drive; and WHEREAS, the City Council has considered the terms and conditions of said engineering services agreement and found them to be fair and equitable, and in the best interests of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said engineering services agreement for the services above described is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach.
