the above project.
One copy is to be forwarded to Simpson- Steppat and the

This agrmwent was authorized by the City Council on
March 25 by the adoption of Resolution No. 8226.

SUBJECT: FORD ROAD IMPROVEMENTS FROM JAMBOREE ROAD TO 570 FEET
WESTERLY OF MACARTHUR BOULEVARD

Attached are the originals and two copies each of the
Cooperative Financing Agreement and the Agreement for Engineering
Services for funding and design of the subject project. Both agree-
ments have been executed by the second parties.
Please return two copies of each agreement when they have
been fully executed by the Mayor and yourself. One copy of the
Financing Agreement will be forwarded to The Irvine Company, and one
copy of the Engineering Agreement will be forwarded to the engineer.

AGREEMENT FOR ENGINEERING SERVICES
(Ford Road Improvements From Jamboree Road
To A Point 570 Feet Westerly Of MacArthur Boulevard)
THIS AGREEMENT is made and entered into this as tr% day
of MA R CH , 1974, by and between the CITY OF
NEWPORT BEACH, a municipal corporation hereinafter referred to as
"CITY ", and the firm of SIMPSON- STEPPAT, Consulting Civil Engineers,
herein referred to as "ENGINEER ".
W I T N E S S E T H•
WHEREAS, CITY intends to construct the following improvements
in Ford Road from Jamboree Road to a point 570 feet westerly of
MacArthur Boulevard (SH73):
(1) Widening and reconstruction of Ford Road
within the above - described limits;
(2) Construction of new, and reconstruction of
existing longitudinal and transverse storm drainage
systems in Ford Road within the above - described limits;
(3) Installation of a street lighting system in
Ford Road for the entire project length;
(4) Construction of a bicycle trail on the
southerly side of Ford Road for the entire project
length;
(5) Reconstruction and modification of the
existing traffic signal at the intersection of Ford
Road with Jamboree Road; and
WHEREAS, ENGINEER has submitted a proposal to CITY to perform
the engineering services in connection with the design of said
project; and
WHEREAS, CITY desires to accept said proposal.

NOW, THEREFORE, in consideration of the foregoing, the
parties hereto agree as follows:
1. General
A. CITY engages ENGINEER to perform the services
hereinafter described for the compensation herein stated.
B. ENGINEER agrees to perform said services upon the
terms hereinafter set forth.
2. Services To Be Performed By Engineer
ENGINEER hereby agrees to perform the following services:
A. Perform supplemental field surveys as needed to
complete a final design, and to preserve existing monumentation.
B. Prepare detailed plans for the construction of the
project. The plans will be prepared on standard plan and profile
sheets to be furnished by the City. The plan view scale will be
1" = 40'.
C. Set precise alignment centerline monumentation after
completion of construction. Prepare and record a record of survey
map for the centerline survey.
D. Prepare a drainage study for the sub -areas tributary
to Ford Road. This study shall include a map showing the drainage
sub - areas, the direction of flow and the location and size of
and
existing /proposed facilities. Hydrologic and hydraulic data
calculations shall be included.
E. Prepare the necessary special provisions and bid
proposal in conjunction with the City's Standard Specifications,
and the State of California Standard Specifications on Xerox
masters suitable for use by the City in calling for competitive
bids.
F. Prepare a final engineer's estimate based on the
quantities used in the bid proposal. A cost breakdown by bid items
or portions of same shall be prepared in accordance with criteria
to be provided by the City, showing the proportion of the cost

of the project to be borne by the City, the County and The
Irvine Company.
G. Review the progress of the design with the City
staff at appropriate times during preparation.
H. Coordinate plan preparation with the consulting
firm which will be designing the traffic signal modifications
at the Jamboree Road intersection.
I. Provide professional consultation and advice during
construction of the project.
3. Duties of City
CITY hereby agrees to supply ENGINEER with the following
information and materials:
A. Soils investigation report prepared by the Orange
County Road Department.
B. Mylar plan and profile and standard sheets for
preparation of original project drawings.
C. Any other additional information available which the
parties agree may be beneficial to the final design of the
project.
4. ownership of Project Documents
Original drawings, reports, notes, maps and other documents
shall become the property of the City and may be reproduced as
deemed necessary by the Public Works Director.
5. Engineer In Charge
Fritz C. Steppat, RCE No. 19249, shall be the Engineer
in charge of the project design.
6. Right of Termination
CITY reserves the right to terminate this agreement at
any time by giving ENGINEER three (3) days' prior written notice;
notice shall be deemed served upon deposit in the United States
mail, postage prepaid, addressed to any of ENGINEER's business

offices. In the event of termination due to fault of ENGINEER,
CITY shall be relieved of any obligation to compensate ENGINEER.
If this agreement is terminated for any reason other than fault
of ENGINEER, CITY agrees to compensate ENGINEER for the actual
services performed up to the effective date of the notice of
termination, on the basis of the fee schedule contained herein.
7. Completion of Final Design
All plans and other documents for the project shall be
submitted to the Public Works Director of CITY for final review
by June 1, 1974.
8. Fee Schedule and Payment
A. In consideration of the performance of the above-
described engineering services, CITY hereby agrees to pay ENGINEER
an amount based upon the hourly rate schedule set forth below.
In no event shall said amount be greater than Twenty -One Thousand
Three Hundred Dollars ($21,300.00):
(1) Hourly rates for office and field personnel

(Hourly rates for field survey crews are subject to an
increase after August 1, 1974.)
as follows:
(2) The contract amount shall be paid to ENGINEER
(a) Monthly partial payments shall be based
on the amount earned each month, as determined by the fee schedule.
The sum of the monthly partial payments shall not exceed ninety
(90) percent of the maximum fee.
(b) Balance of the total amount earned to be
paid upon completion of work specified in Section 2 above.
(Services To Be Performed By Engineer)
(c) In addition, CITY agrees to reimburse

ENGINEER for the actual cost of reproduction of copies
of said plans, and related documents, as well as computer
costs, filing fees, checking fees, cost of aerial topographic
mapping, and other related costs authorized by the Public
Works Director and advanced by ENGINEER.
9. Additional Work
Should ENGINEER complete any additional work not outlined
in this agreement, but authorized by CITY, such as legal descriptions,
revisions to final plans, design of off -site facilities, additional
topography, additional utility design or construction staking,
the extra work shall be performed on an hourly basis in accordance
with the hourly rate standard fee schedule set forth in Section 8
above. (Fee Schedule and Payment)
10. Project Scope Revisions
The scope of the project may be changed and the maximum
fee revised upon prior written approval of the Public Works Director
if the increase in the maximum fee does not exceed $2,100. If
revisions to the scope of the project would result in an increase
in the maximum fee exceeding $2,100, an amendment providing for
such revisions shall be processed and executed by the parties hereto.
11. Hold Harmless
ENGINEER shall indemnify and save harmless CITY, and its
officers and employees, from any damage or liability arising from
any errors, omissions or negligence in ENGINEER's performance of
this agreement, or in the engineering work and services herein
provided.
IN WITNESS WHEREOF, the parties have executed

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
AN ENGINEERING SERVICES AGREEMENT BETWEEN THE
CITY OF NEWPORT BEACH AND SIMPSON- STEPPAT,
CONSULTING CIVIL ENGINEERS, FOR THE WIDENING OF
A PORTION OF FORD ROAD
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain engineering services
agreement between the City of Newport Beach and Simpson - Steppat,
Consulting Civil Engineers, in connection with the widening of
Ford Road from Jamboree Road to 570 feet west of MacArthur
Boulevard; and
WHEREAS, the City Council has considered the terms
and conditions of said engineering services agreement and found
them to be fair and equitable, and in the best interests of the
City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said engineering services agree-
ment for the services above described is approved, and the Mayor
and City Clerk are hereby authorized and directed to execute
the same on behalf of the City of Newport Beach.
