During the deliberations that resulted in a lease extension for the residents of the Marinapark, considerable discussion was given to widening of the walkway. To widen the walkway it will be necessary to re- locate Trailer 12 -B approximately 5'. Therefore, the following section was added to the lease document. -- "City is contemplating walkway located along of Marinapark. In or widening it may be ne ing improvements on t 5' to the west. City to relocate mobilehom widening the public the easterly boundary der to accomplish this cessary to relocate exist - he premises a distance of hereby reserves the right e and other improvements on the premises a distance of 5' to the west of its current location, the relocation to be at City expense , provided, however, lessee shall bear any expense incurred by City in excess of the sum of $10,000." On October 31, 1985 I requested the Building Director to give me an estimate of relocating the subject mobilehome. Attached, is a copy of this estimate. In addition, the lease for Lot 12 -D, which is the lot immediately adjacent and south of Lot 12 -B has a provision which reads as follows: "Lessee acknowledges the right to relocat provements on the pro north of the premises that e the City has reserved mobilehome and im- perty located immediately City and lessee agree that such relocation could adversely impact lessee's view of the bay. In the event City relocates the mobilehome and improvements located on property immediately north of the premises, City shall, upon written request of lessee made within 90 days of the date of re- location, move the mobilehome and related im- provements located on the premises approximately 2' to the west of its current location. This V 0 a • Page -2- relocation will be.done at City expense provided those costs and expenses do not exceed the sum of $10,000. Lessee shall assume any cost or expense in excess of that amount." The Committee should, therefore, understand that if mobilehome 12 -B is relocated 5' that the City may be obligated to also relocate mobilehome 12 -D. T do not.have an estimate for the relocation of 12 -D. The purpose of this memo is to refresh the memories of the Committee and to determine if the Committee has a recommenda- tion with respect to the relocation. This estimate was prepared by Bob Liskey, a general contractor, and the proposal is attached for your review. If it is decided to relocate this mobile home 5 feet to the west, demo- tion and restoration of a shed located on the south side will be necessary to maintain the required clearances between space no. 12B and the mobile home to the south. It is reasonable to assume that this would add $2,000 to the relocation cost. I believe that the contract proposal is self explanatory; the overall cost may come to $22,000. Reinhart OCT 2 81985 SUBJECT: Mobile hoes offer A"ROVEn May I respectfully submit the following reasons why I would recoamed Accepting the mobile home now in space k-A in Marinapark being offered to the City at no cost. However, the cost of appro3dastely $4.500 for moving the mobile home would be the City's obligation. The trailer now occupied by the Marinapark Attendant consists of 256 square feet and needless to say, it is extremely crowded. Further, this trailer is in need of considerable repairs. This is an old steel trailer and the roof is badly rusted and has am V holes that have been repaired with a mastic type filler. This is an ongoing problem since the holes continue to rust out mom. It Deeds several windows replaced since the frames are rusted. There are also holes in the outside walls. It is impossible to control rust on old steel trailers especially in the salt air. The newer mobile hoses have aluminum siding which is not effected with the rust problems. Both the interior and prxterior are in need of paint as well. The total cost will probably amount to $2,500 with no assurance as to the life of the trailer and certainly would not last the life of the lease. It would seem that by replacing the old trailer with the mobile home being offered the City would save costly repairs and would improve the appearance upon entering the Park and would probably last the life of the lease. 1770 W. We plan to replace the existing mobile home in Space 4 -A with a new one. The mobile home presently in that space is still in good condition and is free and clear of any encumbrances. We are offering to donate this mobile home to the City of Newport Beach to replace the City's small, 28 year old eight foot trailer one sees immediately upon entering Marinapark. The mobile home we are offering to donate to the City is valued at approximately $20,000 and would.certainly enhance and help to upgrade the park. We would be very pleased if the Newport Beach City Council were to accept our offer. We would appreciate an early reply and would like the mobile home removed from the present location by December 10, 1985. Harry C. Patterson and Marcia Patterson, the lessees of Trailer Space No. 3 -D, propose to sell their interest in their mobilehome and trailer space. The new lessees, Joseph Foreman and Blossom Foreman, have signed an appropriate document agreeing to be bound by all of the terms and conditions of the existing lease, and the Marinapark Manager is recommending that the City Council approve of the transaction. WYLIE ChRLYLE, County leeorder Qa660 7294 THIS AGREEMENT, made this ZS'r#day of JUNE , 1973, by and between the CITY OF NEWPORT BEACH, a municipal corporation, hereinafter sometimes termed "Lessor" and the lessees of 58 trailer park spaces in that park known as Newport Marinapark, hereinafter sometimes termed "Lessees," which Lessees are individually identified by their signatures to this document. W I T N E S S E T H: WHEREAS, the City of Newport Beach is the owner of that certain real property located on Balboa Boulevard in the City of Newport Beach presently utilized as a trailer park and known as Newport Marinapark; and WHEREAS, the City has leased 58 trailer park spaces to certain Lessees under separate standard form rental agree- ments; and WHEREAS, although said leases by their terms will expire on June 30, 1974, various alleged representations have been made concerning extension of said leases and a dispute has arisen between Lessor and Lessees concerning the termina- tion date of said leases; and WHEREAS, on October 10; 1972, the City Council of the City of Newport Beach voted to accept the recommendation of the Parks, Beaches and Recreation Committee to convert Newport Marinapark into a public recreation area at the termination of said leases; and WHEREAS, the City Council of the City of Newport Beach wishes to terminate the Marinapark leases on a date certain; and -1- 0 0 WHEREAS, pursuant to Newport Beach Resolution No. 7976, a copy of which is attached hereto, marked Exhibit "A" and made a part herein by this reference,.Lessor and Lessees are desirous of agreeing to a transitional period to resolve their differences concerning when said leases shall terminate; and WHEREAS, Lessor and Lessees are desirous of other- wise modifying said leases. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach as Lessor and the Lessees of Newport Marinapark hereby agree as follows: 1. A transitional period shall be established whereby leases for all 58 trailer park spaces shall be extended to and including September 30, 1977. 2. Any time after September 30, 1977, City may give ninety (90) days written notice to vacate said premises to all Lessees of Newport Marinapark. Said notice shall not be given by City until City has allocated necessary funds, approved necessary plans, and obtained all necessary govern- mental approvals, including environmental requirements, zoning requirements and any other requirements to achieve the conver- sion of Newport Marinapark into a public recreational area. Until said written notice to vacate is given, all Lessees shall remain on a month -to -month tenancy subject to the same terms and conditions as their leases shall provide as herein modified. 3. Upon the expiration of the ninety (90) days pursuant to written notice to vacate as described in paragraph 2, all 58 Newport Marinapark Lessees unconditionally agree to vacate the premises without contest, legal or otherwise. Said Newport Marinapark Lessees expressly agree to waive any and -2- 0 W all legal rights they may have to contest said vacation of the premises and agree to release said City from any and all to claims they may have.of whatever nature to otherwise extend �7 said lease period. Lessees further agree to waive any relo- cation assistance or any other assistance from Lessor resulting from vacating the premises. 4. At the end of said ninety (90) days written notice to vacate period Lessees agree that any remaining trailers and /or appurtenances in Newport Marinapark shall be deemed property of Lessor and Lessor shall have the absolute right to demolish, or otherwise remove, any such trailers and /or appurtenances without further notice or compensation of any kind to Lessees. 5. Failure of the Lessees to vacate said premises as provided in paragraphs 2 and 3 will result in damages being sustained by Lessor. Such damages are, and will con- tinue to be, impracticable and extremely difficult to deter- mine. .Those individual Lessees who fail to vacate said premises in accordance with paragraphs 2 and 3 will pay Lessor One Hundred Dollars ($100) each for every day those individual Lessees fail to vacate said premises. It is agreed that the One Hundred Dollars ($100) per day per each individual lessee refusing to.vacate said premises is the minimum value of the actual damage caused by said failure to vacate, that such sum is to be considered liquidated damages and shall not be con- strued as a penalty. 6. Lessees agree to notify any purchaser or assignee of their interest in a trailer or tenancy in Newport Marinapark of this agreement and secure any such purchaser or assignee's express consent to the terms and provisions of this Agreement. -3- W 7. All Newport Marinapark Lessees agree to a rental increase in accordance with the following schedule, effective July 1, 1973: 1972 -73 1973 -74 1974 -75 1975 -76 Front Trailers (24) per month $170 $200 $215 $230 V P4 1976 -77 $245 Rear Trailers (34) per month 145 170 180 190 200 8. All Newport Marinapark Lessees shall cooperate with Lessor in the installation of wider pathway access to the public beach at the east end of Newport Marinapark. 9. Lessees shall also cooperate with City should City desire to install additional tennis courts on the public area. 10. The provisions of the existing Rental Agreements and Regulations between Lessor and Lessees shall remain in ef- fect through the periods herein specified except as otherwise modified by this Agreement. 11. Should Lessor be required to bring suit in court to enforce any of the terms or conditions of this Agreement, Lessees agree to pay Lessor its costs and reasonable attorneys' fees. 12. This Agreement will be deemed null and void unless executed by each and every one of the 58 Lessees on or before November 7, 1973. 13. This Agreement shall be binding upon the Lessees' heirs, successors and assigns and shall be recorded in the office of the County Recorder of Orange County. QL A • �O -6- Space No. . - RESOLUTION No. 79?6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH EXPRESSING ITS REAFFIRi•LATION OF THE LEASE TEP-MINATION AND ITS INTENTION TO PEP1IIT A TRANSITION PERIOD FOR NEWPORT NiAR_INAPARK AT THE TERMINATION OF THE TRAILER SPACE RENTAL AGREEMENTS WHEREAS, the City of Newport Beach is the owner of that certain real property located on Balboa Boulevard in the City of Newport Beach presently utilized as a trailer park and known as.NEWPORT MARINAPARK; and WHEREAS, the City has leased fifty -eight (58) trailer park spaces to certain lessees under a standard form rental agreement; and WHEREAS, all of said leases will expire -on June 301 1974; and WHEREAS, on October 10, 1972, the City Council voted to accept the recommendation of the Parks, Beaches & Recreation Commission to convert Marinapark into a public recreation area at the termination of the agreement; and WHEREAS, the Council wishes to reaffirm its decision to terminate the Marinapark leases when they expire; and WHEREAS, certain residents of Plarinapark have requested that the City Council consider permitting a transitional period at the expiration of the leases; and WHEREAS, the City Council has considered the proposal for a transitional period and finds that to grant such a period .would be in the best interests of the City of Newport Beach. NOW, THEREFORE,.BE IT RESOLVED that the City Council of the City of.Newport Beach hereby agrees to permit a transition period for the residents of Marinapark under the following terms and conditions: 1 1.977. All 58 Marinapark residents will sign appropriate waivers and releases guaranteeing that they will unconditionally and without contest vacate the premises at the expiration of the period specified in the vacation notice referred to in Paragraph 2 above. The form and substance of said waivers and releases will be subject to the approval of the City . Attorney. 4. Said: waivers and releases must be executed by all 58 Marinapark residents within six (6) months of the date of the adoption of this Resolution or the transitional period as.granted under this Resolution will be deemed null and'void and of no further force and effect. 5.
