Enclosed is one copy each of subject agreements for trans-
mittal to the respective Boy Scout troops.
The City Council authorized the execution of these agreements
on January 14, 1974 by the adoption of Resolutim No. 8179.

THIS AGREEMENT made and entered into this /yam day of

a municipal corporation, hereinafter referred to as "CITY" and
BOY SCOUT TROOP #330, a non - profit organization sponsored by the
Kiwanis Club of Corona del Mar, hereinafter referred to as "SCOUTS ";
W I T N E S S E T H
WHEREAS, there exists on the school site of the Harbor
View Hills Elementary School two buildings that are owned by the
City that have heretofore been used by the Scouts as a meeting
place; and
WHEREAS, these two buildings were previously owned and
maintained by the Community Youth Center Board of Directors, but
were conveyed to the City when the Youth Center Board dissolved
in 1972; and
WHEREAS, Troop #330 has had exclusive use of the smaller
of the two buildings; and
WHEREAS, the City and the Scouts desire to continue the
exclusive use of these buildings for scouting purposes.
NOW, THEREFORE, the City conveys to Troop #330 exclusive
use of the small building subject to the following conditions:
1. Scouts will provide all maintenance to the interior
and the exterior of the building including painting, cleaning,
window repair, etc.
2. Scouts keep the grounds around the buildinlg free of
litter, weeds and other debris.
3. Scouts notify the City quarterly of the dates and
times that the building will be in use.
4. City will continue to provide utilities.

This Agreement shall automatically be renewed annually
but shall terminate ten years from the original date of execution.
Either party may terminate the Agreement by giving written notice
one year prior to the desired date of termination.
IN WITNESS WHEREOF, the parties hereto have executed
this Agreement on the date first above written.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH AUTHORIZING THE
EXECUTION OF AGREEMENTS BETWEEN THE CITY
OF NE7,4PORT BEACH AND BOY SCOUTS OF
ALMERICA, TROOPS NO. 17 AND NO. 330 FOR
THE USE OF FACILITIES AT COMMUNITY
YOUTH CENTER
WHEREAS, there has been presented to the City
Council of the City of Newport Beach certain agreements
between the City of Newport Beach and Boy Scouts of America,
Troops No. 17 and No. 330 for the use of facilities at
Community Youth Center; and
WHEREAS, the City Council has considered the terms
and conditions of said agreements and found them to be fair
and equitable, and in the best interests of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said agreements for the
services above - described are approved, and the Mayor and
City Clerk are hereby authorized and directed to execute the
same on behalf of the City of Newport Beach.
