RECITALS
1. The Council on Criminal Justice approved, on
April 17, 1974, a grant application for the City of Garden Grove
to provide "pack -set radios" (walkie - talkies) to law enforcement
agencies in Orange Councy.

2. Under the terms of the grant, the City of Garden
Grove is acting as prime sponsor for the distribution of pack -set
radios to law enforcement agencies in Orange County.
3. By the terms of this agreement, the City of Garden
Grove and Agency desire to set forth the terms under which the
pack -set radios will be distributed and paid for and the terms
and conditions related thereto.
AGREEMENT '
THE PARTIES MUTUALLY AGREE AS FOLLOWS:
4. Garden Grove, by separate agreement will contract
for and receive from Motorola Communications and Electronics Inc.,
2041 Business Center Drive, Irvine, California, pack. -set radios i
•of which Agency desires to obtain and use 8 of Type B
at the unit price plus tax of $ 1,095.90 , for a total price
of $ 91293.23 including tax and local matching funds
of $ 2,323.30 ,

manufacturer of units by September 1, 1974, and distribution by
September 15, 1974.
6. Warranty and servicing will be the responsibility
of the Agency and will be accomplished under their current servic-
ing agreement with the Orange County Department of Transportation
and Communication and the several cities.
7. Agency agrees to pay the total sum of $ 2,323.30
to the City-of Garden Grove no later than June 15, 1974. In the
event Agency fails or refuses to pay the amount described above,
by the deadline date, Garden Grove reserves the right to refuse
delivery to Agency of the requested units.
8. In the event less than fifteen (15) agencies execute'
agreements with the City of Garden Grove, Garden Grove reserves
the right to terminate the agreement with the State Council on
Criminal Justice.
The parties hereto have executed this agreement the

with the City of Garden Grove in ommaction with the distribution
of the "walkie- talkie" pads set radios. one copy is marked to
be returned to our, office after its execution by the City of Garden
Grove.

RESOLUTION NO. $ 2:`i
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECDTION OF
AN AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH
AND THE CITY OF GARDEN GROVE IN CONNECTION WITH
THE COUNCIL ON CRIMINAL JUSTICE GRANT FOR THE
PROVISION OF PACK -SET RADIOS
WHEREAS, there has been presented to the City
Council of the City of Newport Beach a certain agreement
between the City of Newport Beach and the City of Garden
Grove following approval by the Council on Criminal Justice
of a grant application for the City of Garden Grove to provide
"pack -set radios" (walkie- talkies) to law enforcement agencies
in Orange County; and
WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair
and equitable, and in the best interests of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said agreement for the
distribution of pack -set radios above described is approved,
and the Mayor and City Clerk are hereby authorized and
directed to execute the same on behalf of the City of Newport
Beach.
ADOPTED this 13th day of May, 1974.
