Subject: Contract for Publication of legal Notices and
Designation of Official Newspaper for the City
Enclosed is a fully executed copy of subject contract for
the fiscal year 1974 -75. Also enclosed is a copy of the
resolution,. warding the contract.

THIS AGREEMENT, made and entered into this
day of June
10th
1974, by and between the CITY OF
NEWPORT BEACH, hereinafter referred to as "City ", and the
Newport Harbor Ensign
"Newspaper ";
hereinafter referred to as
WHEREAS, Section 419 of the City Charter requires the
City Council of the City of Newport Beach prior to the beginning
of each fiscal year to public a notice inviting bids and to
contract for the publication of all legal notices or other
matter required to be published in a newspaper of general circu-
lation in the City during the ensuing fiscal year; and
WHEREAS, said notice was published and bids were
received in accordance therewith; and
WHEREAS, the City Council upon analysis of the bids
received has made an award for the publication as aforesaid in
the fiscal year beginning July 1, 19 74 ; and
WHEREAS, Newspaper was the successful bidder for said
publication;
NOW, THEREFORE, the parties agree:
1. Newspaper agrees to publish all legal notices of
City and other matter required to be published for the fiscal
year beginning July 1, 1974 The rates for said publication
are as follows, which are not in excess of the customary rates
charged by Newspaper for the publication of legal notices of a
private character:
$1.20 per column inch for all publication, with
the exception that any portion of a legal notice that
requires strike -over or underlining will be charged-at
double price, or $2.40 per column inch ;,based on
one - column width in 9 -point type on 10 -point body,

2...City agrees to submit to Newspaper all legal
notices and other matter required to be published during said
fiscal year.
3. City agrees to pay Newspaper for said publication
in accordance with the schedule hereinabove set out.
4. In the event that Newspaper for any reason is
unable to make timely publication of any legal notice or other
matter required to be published during the term of this
contract, City may submit such matter to any other newspaper
or newspapers qualified to publish such matters for the City
during the term hereof. Such determination shall be at the
discretion of the City.
5. Fifteen (15) copies of each issue of the official
newspaper must be furnished to City on the date of publication.
6. Affidavits of Publication for every item published
will be furnished to City with no additional charge.
IN WITNESS WHEREOF, the parties have executed this

RESOLUTION NO. 8268
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AWARDING A CONTRACT FOR THE
PUBLICATION OF LEGAL NOTICES AND OTHER MATTER
AND DESIGNATING AN OFFICIAL NEWSPAPER FOR
PUBLICATION OF NOTICES
WHEREAS, Section 419 of the Newport Beach City
Charter provides that the City Council shall publish a notice
inviting bids and contract for the publication of legal
notices and other matter required to be published in a news-
paper of general circulation in the City during the ensuing
fiscal year; and
WHEREAS, the City Council has published such notices
and bids have been received in accordance therewith; and
WHEREAS, the City Council has analyzed said bids and
determined to make the award as hereinafter provided;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that the bid of the NEWPORT
HARBOR ENSIGN be accepted and that the Mayor and
City Clerk be and hereby are authorized and directed to execute
a contract in accordance with this award for the fiscal year
beginning July 1, 1974 ;
BE IT FURTHER RESOLVED that the NEWPORT HARBOR
ENSIGN is hereby designated the official newspaper
for the publication of legal notices and other matter required
to be published, for the fiscal year beginning July 1, 1974
