A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING EXECUTION OF AN
OFF -SITE PARKING AGREEMENT BETWEEN THE CITY
OF NEWPORT BEACH AND DONALD M. KOLL IN CONNECTION
WITH THE WAREHOUSE RESTAURANT
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and Donald M. Koll pertaining to provisions
for off -site parking in connection with the Warehouse Restaurant;
and
WHEREAS, the City Council has considered the terms
and conditions of said off -site parking agreement and found
them to be fair and equitable, and in the best interests of the
City;
NOW, THEREFORE, BE IT. RESOLVED by the City Council of
the City of Newport Beach that said off -site parking agreement
above described is approved, and the Mayor and City Clerk are
hereby authorized and directed to execute the same on behalf of
the City of Newport Beach.

Adopt resolution authorizing the execution of an off -site parking
agreement between the City of Newport Beach and Donald M. Koll for
the Warehouse Restaurant.
Background
At its meeting of February 7, 1974, the Planning Commission approved
Use Permit No. 1711 of Donald M. Koll which will permit the interior
remodeling and expansion of the former Berkshire Restaurant on the
site. Under the terms of the use permit, the restaurant operator
will be permitted to operate the restaurant with a maximum occupancy
not to exceed 277 persons prior to 6:00 P.M. daily, and a maximum
occupancy of 400 persons after 6:00 P.M.
It should be noted that the daytime occupant load of 277 persons
is identical to the occupant load of the former nonconforming
restaurant and that the parking requirement for the daytime operation
of the restaurant has been waived by the Planning Commission. How-
ever, full parking for the night -time restaurant operation is
required, and it is proposed that these parking spaces will be
provided across the street in the 367 space parking structure.
Inasmuch as these spaces are in an off -site location, an off -site
parking agreement is required.
