SUBJECT: GROUNDWATER MONITORING PROGRAM FOR BIG CANYON RESERVOIR- -
AMENDED AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
RECOMMENDATION:
Adopt a resolution authorizing the Mayor and the City Clerk to
execute the subject agreement with James M. Montgomery, Con-
sulting Engineers Inc. for the continuation of the groundwater
monitoring program.
DISCUSSION:
On September 9, 1974, Council approved a program to study groundwater
conditions in the vicinity of Big Canyon Reservoir. The program, which will
be completed in October 1975, is collecting geologic, hydrologic, and water
quality data to define the direction and quantity of groundwater flow in the
area of the reservoir. During the course of the study, the need for additional
data collection and testing beyond the scope of the original agreement has
been established. The amended agreement if approved will provide for the fol-
lowing services:
1. Completion of data collection and monitoring of piezometers
and underdrain discharge monitoring as stipulated in the
original agreement.
2. Perform a dual shutdown and measurement program of the east
wall drain system.
3. Conduct additional groundwater sampling and analysis for
comparison with original sample analysis.
4. Installation of two additional piezometers.
5. Perform an irrigation water application study of tributary
areas to the ground water basin near the reservoir.
A proposal for the additional work has been obtained from the firm
of James M. Montgomery, Consulting Engineers Inc., which is currently conduct-
ing the original study program.
Compensation will be based on standard hourly rates with the maximum
fee not to exceed $9,600. Sufficient funds for the work are available (see
attached schedule) for the project from last year's and the current year's budget.

CITY CLERK TO EXECUTE AN AMENDMENT TO AN
AGREEMENT WITH JAMES M. MONTGOMERY, CONSULTING
ENGINEERS, INC. FOR CONTINUATION OF THE GROUND-
WATER MONITORING PROGRAM FOR BIG CANYON RESERVOIR
WHEREAS, there has been presented to the City Council
of the City of Newport Beach an amendment to the Professional
Services Agreement between the City of Newport Beach and James M.
Montgomery, Consulting Engineers, Inc., for the continuation
of the groundwater monitoring program for Big Canyon Reservoir;

WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair and
equitable, and in the best interests of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said amendment to agreement
above described is approved, and the Mayor and City Clerk are
hereby authorized and directed to execute the same on behalf of
the City of Newport Beach.

RECOMMENDATIONS:
Adopt a resolution authorizing the Mayor and the City Clerk to
execute the subject agreement with James M. Montgomery, Consulting Engineers
Inc. for the implementation of the groundwater monitoring program.
DISCUSSION:
This program will provide for a study of groundwater conditions
adjacent to Big Canyon Reservoir. The study program will collect geologic,
hydrologic, and water quality data to define the quantity and direction of
the groundwater flow. The study will be one year in duration with progress
reports made every three months and a final report presented upon completion.
Services to be provided by the Engineer as a part of the Study
Program include the following:
1. Drilling, logging and sampling at 11 bores in the vicinity
of Big Canyon Reservoir.
2. Conduct permeability tests of various soil samples collected
during drilling.
3. Install piezometers (water level indicators) at 7 drill sites.
4. Conduct a comprehensive data collection and monitoring program
to include: Groundwater levels, water quality measurements,
reservoir surface levels, precipitation, and measurement of
underdrain discharges.
5. Conduct tracer studies, temperature surveys, and shallow
trench sampling as required.
6. Submit progress report on a quarterly basis and a final report
upon completion of the program.
A proposal has been obtained from the firm of James M. Montgomery,
Consulting Engineers Inc. for performing the study program. The firm is well
qualified to perform this type of work and has performed studies and designs
involving the reservoir in the past.
Compensation will be based on standard hourly rates with a maximum
fee not to exceed $23,000.

AMENDED PROFESSIONAL SERVICES AGREEMENT
GROUND WATER MONITORING PROGRAM FOR BIG CANYON RESERVOIR
THIS AGREEMENT is made and entered into this
day of , 1975, by and between the CITY OF NEWPORT
BEACH, a municipal corporation, hereinafter referred to as "City"
and the firm of JAMES M. MONTGOMERY, Consulting Engineers, Inc.,
hereinafter referred to as "Engineer ".
W I T N E S S E T H:
WHEREAS, City and Engineer have entered into a
Professional Services Agreement dated September 9, 1974, which provides
for the conduct of a ground water monitoring program to collect
sufficient geologic, hydrologic, and water quality data to define
the quantity and direction of ground water flow in the vicinity of
Big Canyon Reservoir; and
WHEREAS, during the course of said program, the need for
the collection of additional data and the performance of additional
tests and analysis by Engineer has been determined; and
WHEREAS, Engineer has submitted a proposal dated May 29,
1975, to City to perform the professional services in connection
with the aforementioned data collection, tests and analysis;
NOW, THEREFORE, in consideration of these premises, the
parties hereto agree as follows:
1. General.
A. City engages Engineer to perform the services
set forth in paragraph 2 below for the compensation herein stated,
in addition to the services to be performed by Engineer pursuant
to the Agreement dated September 9, 1974.
B. Engineer agrees to perform said services upon the
terms and conditions hereinafter set forth.

third quarterly and final progress reports as set forth in the
above said agreement dated September 9, 1974.
B. Perform a dual shutdown and measurement program
of the east wall drain system to include bi- weekly monitoring.
C. Conduct additional ground water sampling and
analysis for comparison with original sample analysis to include
10 partial and 4 standard mineral analysis.
D. Installation of two additional piezometers to
be located at the southeast corner of the reservoir.
E. Perform a study of irrigation water application .
in adjacent tributary areas to include runoff, percolation, and
evapo- transpiration considerations.
3. Revised Fee Schedule
City agrees to pay Engineer for all services called
for under the provisions of this agreement on the basis of the
hourly rate schedule attached hereto as Exhibit "A" which is
incorporated herein as if fully set forth; but not to exceed the
total sum of Ninety Six Hundred Dollars ($9600.00).
4. Terms and Conditions of Original Agreement
All terms and conditions of the original agreement
entered into by and between City and Engineer on September 9, 1974,
not inconsistent herewith, shall remain in full force and effect.

PROFESSIONAL SERVICES AGREEMENT
GROUNDWATER MONITORING PROGRAM FOR BIG CANYON RESERVOIR
THIS AGREEMENT is made and entered into this
day of SfPTE.M,O,E,i , 1974, by and between the CITY OF
NEWPORT BEACH, a municipal corporation, hereinafter referred to
as "CITY ", and the firm of JAMES M. MONTGOMERY, Consulting Engineers,
Inc., hereinafter referred to as "ENGINEER ".
W I T N E S S E T H:
WHEREAS, CITY intends to undertake a groundwater monitoring
program to collect sufficient geologic, hydrologic, and water quality
data to define the quantity and direction of groundwater flow in
the vicinity of Big Canyon Reservoir; and
WHEREAS, ENGINEER has submitted a proposal dated May 13,
1974, and a revised proposal dated August 30, 1974, to CITY to
perform the professional services in connection with performance
of the program; and
WHEREAS, CITY desires to accept said proposal.
NOW, THEREFORE, in consideration of these premises, the
parties hereto agree as follows:
1. General
A. CITY engages ENGINEER to perform the services
hereinafter described for the compensation herein stated.
B. ENGINEER agrees to perform said services upon the
terms and conditions hereinafter set forth.
2. Services to be Performed by Engineer
ENGINEER hereby agrees to perform the following services:
A. Drilling, Logging and Sampling
Complete exploratory test drilling, logging and
sampling of 11 sites in the vicinity of Big Canyon Reservoir to depths
of forty (40) feet maximum.
B. Permeability Tests
Conduct permeability tests of various soil samples.
A portion of the tests will be run in a laboratory and the remainder
in situ at the specific drill site.

C. Piezometers
Install two (2) inch diameter piezometers at
seven (7) drill sites.
D. Data Collection and Monitoring
Conduct a comprehensive data collection and
monitoring program of (1) Ground water levels and water quality at
the new and existing piezometers; (2) Reservoir water surface
elevation and precipitation at a manually measured rainfall gage.
This program shall commence within one and one -half (1 1/2) months
from the notice to proceed.
E. Underdrain Discharge Monitoring
Provide general designs for the discharge measure-
ment devices for Big Canyon Reservoir's underdrain system, and the
Harbor View Hills subdrain system hereinabove mentioned.
When measuring devices have been installed by the
City, monitor discharge measurement devices on flows of the Big
Canyon Reservoir's east wall drain system, its underdrain system
and the Harbor View Hills (Bren) subdrain system on Newport Hills
Drive East. Monitoring shall continue for one (1) year to analyze
a complete hydrologic cycle, on a minimum two (2) week frequency.
F. Additional Investigations
Conduct and supervise additional investigations
as required for tracer studies, temperature surveys and local
shallow trenching.
G. Progress and Final Reports
Submit progress reports of results and initial
analysis at the end of each three (3) month period. Ten (10) copies
of each progress report shall be provided.
Submit a final report including description, con-
clusions and recommendations from the investigation after the
compilation and evaluation of one (1) year data. Ten (10) copies
of the final report shall be provided.
H. Review
Review elements of the program with CITY staff
at appropriate points during the course of the study. CITY and
ENGINEER shall mutually determine when review and decisions by CITY
are needed.

3. Duties of City
CITY hereby agrees to supply ENGINEER with the
following information, services and materials:
A. Provide ENGINEER with all available information
and data pertaining to Big Canyon Reservoir.
B. Install discharge measurement devices on the Big
Canyon Reservoir underdrain outlet and the Harbor View Hills
subdrain system on Newport Hills Drive East.
C. Consultation with ENGINEER as needed to accomplish
completion of the study program.
4. Ownership of Program Documents
Original drawings, reports, notes, maps and other
documents shall become the property of the CITY and may be reproduced
as deemed necessary by the Public Works Director or his designated
representative.
5. Engineer in Charge
DuWayne R. Lidke, RCE No. 13888, shall be Engineer in
charge of the program.
6. Right of Termination
CITY reserves the right to terminate this agreement
at any time by giving ENGINEER three (3) days' prior written notice;
notice shall be deemed served upon deposit in the United States Mail,
postage prepaid, addressed to any of the ENGINEER's business offices.
In the event of termination due to fault of the ENGINEER, CITY shall
be relieved of any obligation to compensate ENGINEER. If this
agreement is terminated for any reason other than fault of ENGINEER,
CITY agrees to compensate ENGINEER for the actual services performed
up to the effective date of the notice of termination, on the basis
of the fee schedule contained herein.
7. Completion of Program and Final Report
The program shall be completed and the final report
submitted to the Public Works Director by November 1, 1975.
8. Fee Schedule and Payment
CITY agrees to pay ENGINEER for all services called for
under the provisions of this agreement on the basis of the hourly

rate schedule attached hereto as Exhibit "A ", which is incorporated
herein as if fully set forth; but not to exceed the total sum of
Twenty -three Thousand Dollars ($23,000).
The hourly rates shown on Exhibit "A" may be subject
to increase during fiscal year 1975 -76.
The amount to be paid ENGINEER shall be payable as
follows:
(a) Monthly partial payments, each payment to be
the amount earned as determined by the fee schedule. The sum of
the monthly partial payments shall not exceed ninety (900%) percent
of the above maximum fee.
(b) Balance of the total amount to be paid upon
receipt of the Final Report.
(c) CITY agrees to reimburse ENGINEER for the actual
cost of reproduction of copies of said progress and final reports,
and related documents, as well as computer costs, travel costs at
the rate of fifteen (15) cents per mile of auto travel, and other
related costs authorized by the Public Works Director and advanced
by ENGINEER.
9. Amendment
The scope of services to be furnished by ENGINEER may
be changed and the maximum fee revised upon prior written approval
by CITY's Public Works Director if the increase in the maximum fee
specified does not exceed Two Thousand Dollars ($2,000).
If the change in the scope of services to be furnished
by ENGINEER would result in the increase in the specified maximum
fee exceeding Two Thousand Dollars ($2,000), a written amendment to
this agreement providing for such change shall be executed by the
parties hereto.
10. Hold Harmless
ENGINEER shall assume the defense of and indemnify
and save harmless the CITY, and its officers and employees, from
all claims, loss, damage, injuries, or liability; directly or
indirectly arising from any errors, omissions, or negligence in
