H-2 c TO: CITY COUNCIL FROM: Public Works Department SUBJECT: PROFESSIONAL ENGINEERING SERVICES AGREEMENT - -WATER TRANSMISSION MAIN IMPROVEMENTS IN ALLEY SOUTHERLY OF EAST COAST HIGHWAY FROM MARGUERITE AVENUE TO HAZEL DRIVE (C -1663) RECOMMENDATION: Adopt a resolution authorizing the Mayor and the City Clerk to execute the subject agreement with Alderman, Swift and Lewis, Consulting Engineers DISCUSSION: This project will provide for the installation of a water transmission main in the alley southerly of East Coast Highway from Marguerite Avenue to Hazel Drive. The facility will connect on the west to the recently completed 18" transmission main in Bayside Drive. The proposed project will also con- nect to and be built in conjunction with the East Coast Highway water trans- mission main from Hazel Drive to the easterly City limits, which is currently under design. The combined project will complete the installation of a trunkline supply system in eastern Corona del Mar. It will provide a source of water supply independent of the 30" Laguna Beach County Water District Feeder, which presently serves Cameo Highlands and portions of Shorecliffs, Cameo Shores and Corona Highlands. Increased fire protection and domestic service flexi- bility will result from this project. A proposal has been received from the engineering firm of Alderman, Swift and Lewis for design and preparation of plans, specifications, and esti- mates for the project. The principal services to be furnished by the engineer include the following: 1. Prepare detailed construction drawings, special provisions and construction estimate. Assist the City in establishing parameters for soils in- vestigation. Establish traffic control criteria. Consultation as required during construction. Compensation will be based on standard hourly rates with a maximum fee not to exceed $11,500. (Rate schedule is attached.) Sufficient funds are available in the Water Fund for this project. As a part of this project, the City will reconstruct the existing alleys through which the new transmission main passes. The alley improve- ments will be designed by the City. 4 eph(T. H -2 (a) SUBJECT: PROFESSIONAL ENGINEERING SERVICES AGREEMENT- - WATER TRANSMISSION MAIN IMPROVEMENTS EAST COAST HIGHWAY (SH NO. 1) FROM POPPY AVENUE TO THE EASTERLY CITY LIMITS RECOMMENDATION: Adopt a resolution authorizing the Mayor and the City Clerk to execute the subject agreement with Alderman, Swift and Lewis, Consulting Engineers. DISCUSSION: This project will provide for the design of a water trans- mission main to allow a direct connection to the City water system for domestic and fire protection service to Cameo Highlands, and to portions of Shorecliffs, Cameo Shores, and Corona Highlands. The above areas are presently wholly or partially dependent on the 30 -inch Laguna Beach County Water District line as their source of supply. The project will also give increased operational flexibility to the City's water system in eastern Corona del Mar. A sketch is attached delineating the limits of the work. A proposal has been received from:the engineering firm of Alderman, Swift and Lewis for design and preparation of plan and speci- fications for the project. The principal services to be furnished by the engineer include the following: Preliminary Design Phase Prepare a preliminary project report to study 1211, 16 ", and 18" transmission main alternatives. (Includes: cost comparison, schematic drawings, and narrative report.) B. Final Design Phase Perform horizontal and vertical control, and topographic surveys. 2. The firm of Alderman, Swift and Lewis is well qualified in this field of work. Compensation will be based on standard hourly rates with a maximum fee not to exceed $16,000. Laura Lagios City Clark t • AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES _ WATER TRANSMISSION MAIN IMPROVEMENTS ALLEY SOUTHERLY OF EAST COAST HIGHWAY (SH 1) MARGUERITE AVENUE TO HAZEL DRIVE THIS AGREEMENT is made and entered into this ►x rH day of q ✓ G up 7 , 1975, by and between the City of Newport Beach, a municipal corporation, hereinafter referred to as "CITY" and the firm of Alderman, Swift and Lewis Consulting Engineers, hereinafter referred to as "ENGINEER ". WITNESSETH: WHEREAS, CITY intends to install a water transmission main including appurtenances and connections to existing distribution systems in the alley southerly of East Coast Highway (SH 1) from Marguerite Avenue to Hazel Drive, hereinafter referred to as "PROJECT "; and WHEREAS, ENGINEER has submitted a proposal to CITY to perform engineer- ing services in connection with the design of PROJECT: and WHEREAS, CITY desires to accept said proposal, NOW, THEREFORE, in consideration of the foregoing, the parties hereto agree as follows: I. General A. CITY engages ENGINEER to perform the services hereinafter described for the compensation herein stated. B. ENGINEER agrees to perform said services upon the terms hereinafter set forth. II. Services to be Performed by ENGINEER ENGINEER hereby agrees to perform the following services: 1. Assist the CITY in establishing the parameters of a soils investigation for the PROJECT; 2. Prepare detailed construction drawings on City furnished standard plan and profile sheets to a plan view scale of 1" = 20', horizontally; 3. Prepare special provisions and contract documents on Xerox masters in conjunction with City's Standard Specifications (Standard Specifications for Public Works Construction, 1973 Edition including supplements); 4. Coordinate plans, special provisions and contract documents with the East Coast Highway Water Transmission Main Improve- ment Project from Hazel Avenue to the Easterly City Limits, to provide for a single construction contract with this PROJECT: - 1 - 0 5. Design traffic control implementation for the construction phase of the PROJECT. 6. Calculate the construction quantities and estimate their cost. Provide a final ENGINEER'S estimate in bid proposal format. 7. At key milestones present design solutions for review by CITY. 8. Provide consultation and /or interpretation of plans and specifications during the construction phase of the PROJECT, including review of shop drawings. III. Duties of CITY CITY hereby agrees to supply ENGINEER with the following infor- mation and materials: A. Record and pothole information regarding the location of existing underground utilities. B. Horizontal and vertical control, and topographic surveys for the PROJECT. C. As -built construction drawings of surface improvements in the PROJECT area. D. Soils investigation report. E. Mylar plan and profile and standard sheets for preparation of original PROJECT drawings. F. Field measurements to reflect "as- built" condition of work (CITY will also make "as- built" amendments to the drawings). G. Any other additional information available which the parties hereto agree may be beneficial to the final design of the PROJECT. IV. Ownership of Project Documents Original drawings, reports, notes, maps and other documents shall become the property of the CITY and may be reproduced and utilized as deemed necessary by the Public Works Director. V. Engineer in Charge William D. Lewis, RCE No. 11543, shall be the engineer in charge of PROJECT design. - 2 - 0 0 VI. Right of Termination CITY reserves the right to terminate this agreement at any time by giving ENGINEER three (3) days' prior written notice; notice shall be deemed served upon deposit in the United States Mail, postage prepaid, addressed to any of ENGINEER's business offices. In the event of termination due to fault of ENGINEER, CITY shall be relieved of any obligation to compensate ENGINEER. If this agreement is terminated for any reason other than fault of ENGINEER, CITY agrees to compensate ENGINEER for the actual services performed up to the effective date of the notice of termination, on the basis of the fee schedule contained herein. VII. Completion of Final Design Final design, including all plans and other documents for the PROJECT shall be submitted to the Public Works Director of CITY for final review within ninety (90) calendar days following authorization by CITY to proceed with final design. VIII. Fee Schedule and Payment In consideration of the performance of the above - described engineering services, CITY hereby agrees to pay ENGINEER an amount based upon the hourly rate schedule set forth below. In no event shall said amount be greater than Eleven Thousand Five Hundred Dollars ($11,500.00), except as otherwise provided herein. A. Hourly rates for office and field personnel shall be as follows: Principal $35.00 /hour Registered Civil Engineer $25.00 /hour Designer $20.00 /hour Draftsman $16.50 /hour Typist $10.50 /hour B. The contract amount shall be paid to ENGINEER as follows: 1. Monthly partial payments shall be based on the amount earned each month, as determined by the fee schedule. The sum of the monthly partial payments shall not exceed ninety percent (90%) of the maximum fee; 2. Balance of the total amount earned to be paid upon completion of work specified in Section II (Services to be Performed by ENGINEER), or by September 1, 1976, whichever occurs first; - 3 - 3. In addition, CITY agrees to reimburse ENGINEER for the actual cost of reproduction of copies of said plans and related documents, as well as computer costs, filing fees, checking fees, cost of aerial photography, materials cost related to survey work plus ten percent (10Y), and other related costs authorized by the Public Works Director and advanced by ENGINEER. IX. Additional Work Should ENGINEER complete any additional work not outlined in this agreement, but authorized by CITY, such as legal descriptions, revisions to final plans, design of off -site facilities, additional topography, additional utility design or construction staking, the extra work shall be performed on an hourly basis in accordance with the hourly rate standard fee schedule set forth in Section VIII (Fee Schedule and Payment) above. X. PROJECT Scope Revisions The scope of the PROJECT may be changed and the maximum fee revised upon prior written approval of the Public Works Director if the increase in the maximum fee does not exceed One Thousand Two Hundred Dollars ($1,200.00). If revisions to the scope of the PROJECT would result in an increase in the maximum fee exceeding One Thousand Two Hundred Dollars ($1,200.00), an amendment providing for such revisions shall be processed and executed by the parties hereto. XI. Hold Harmless ENGINEER shall indemnify and save harmless CITY and its officers and employees from any damage or liability arising from any errors, omissions or negligence in the ENGINEER's performance of this agreement, or in the engineering work and services herein provided.
