AMENDED AGREEMENT FOR PROFESSIONAL ENGINEERING
SERVICES - SUPERIOR AVENUE WIDENING - FIFTEENTH
STREET TO INDUSTRIAL WAY C -1665
This Agreement is made and entered into this zdz. day of
c� Lei 1977, by and between the City of Newport Beach, a
municipal corporation, hereinafter referred to as "City" and the firm of
McHugh- Norris, Incorporated, (formerly Wilson, McHugh Norris, Inc.) Civil
Engineers and Land Surveyors, hereinafter referred to as "Engineer"
WITNESSETH:
WHEREAS, City and Engineer entered into an Agreement for Pro-
fessional Engineering Services, hereinafter referred to as "Agreement ",
dated December 3, 1975 to have Engineer design the Superior Avenue widening
project from Fifteenth Street to Industrial Way; and
WHEREAS, City intends to revise the entrances to Hughes Aircraft
Co. and City Corporation Yard adjacent to Superior Avenue and Industrial
Way, revise the retaining wall design and add a masonry screen wall adjacent
to City Corporation Yard fronting Superior Avenue and Industrial Way, add
cross - section for Superior Avenue to the plans, and determine the actual
line and grade of the footing at the Mar Vista Convalescent Hospital; and
WHEREAS, Engineer has submitted a proposal to City to perform
engineering services in connection with the design of said additional

modifications and revisions to the plans; and
WHEREAS, City desires to accept said proposal;
NOW, THEREFORE, in consideration of the foregoing, the parties
hereto agree as follows:
I. General
A. City engages Engineer to perform the services set forth
in paragraph II below for the compensation herein stated, in addition
to the services to be performed by Engineer pursuant to the Agreement
dated December 3, 1975.
B. Engineer agrees to perform said services upon the terms
hereinafter set forth.

II. Additional Services to be Performed by Engineer
Engineer hereby agrees to perform the following services:
A. Perform additional calculations and drafting, as needed,
to complete a final design of drive entrance to Hughes Aircraft Co.
and City Corporation Yard, final design of retaining wall and masonry
perimeter wall adjacent to City Corporation Yard, and cross- sections
for Superior Avenue.
B. Perform additional topographic location, elevation
surveys, and subsurface investigation, as needed to determine the
actual grade and alignment for the Mar Vista Convalescent Hospital.
III. Duties of City
City hereby agrees to supply Engineer with the following
information and materials:
A. Record information regarding the site of the work.
B. Mylar plan sheets.
C. Any other additional information available which the
parties agree may be beneficial to the final design of the project.
IV. Revised Fee Schedule
City agrees to pay Engineer for all services called for
under the provisions of this Agreement on the basis of the hourly rate
schedule set forth in Paragraph VIII of said Agreement, which is incor-
porated herein as if fully set forth; but not to exceed the total sum
of One Thousand Eight Hundred Dollars ($1,800.00).
V. Terms and Conditions of Original Agreement
All terms and conditions of the original Agreement entered
into by and between City and Engineer on December 3, 1975 not incon-
sistent herewith, shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this Agree-
ment on the day and year first above written.

RECOMMENDATION:
Execute the subject agreement on behalf of the City in
accordance with Council Policy F -14.
DISCUSSION:
Attached are three (3) copies of the subject agreement with
McHugh- Norris (formerly Wilson - McHugh - Norris), Consulting Civil
Engineers and Land Surveyors. The amendment provides for additional
design required to revise entrances to Hughes Aircraft Co., revise
and modify retaining wall and masonry perimeter wall adjacent to
Superior Avenue Corporation Yard, revise and modify plans to incor-
porate design of Industrial Way access road and grading, preparation
of Superior Avenue cross - section sheets and subsurface investigations
to determine line and grade of footing at Mar Vista Convalescent
Hospital.

AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
SUPERIOR AVENUE WIDENING - FIFTEENTH STREET TO
INDUSTRIAL WAY (C -1665)
THIS AGREEMENT is made and entered into this day of

municipal corporation, hereinafter referred to as "CITY" and the firm of
Wilson- McHugh- Norris, Incorporated, Civil Engineers and Land Surveyors,
hereinafter referred to as "ENGINEER"
W I T N E S S E T H:
WHEREAS, CITY intends to widen Superior Avenue from Fifteenth
Street to Industrial Way, under a project to be cooperatively financed with
the County of Orange, hereinafter referred to as "PROJECT "; and
WHEREAS, ENGINEER has submitted a proposal to CITY to perform
engineering services in connection with the design of PROJECT: and
WHEREAS, CITY desires to accept said proposal;
NOW, THEREFORE, in consideration of the foregoing, the parties
hereto agree as follows:
I. General
A. CITY engages ENGINEER to perform the services hereinafter
described for the compensation herein stated.
B. ENGINEER agrees to perform said services upon the terms
hereinafter set forth.
II. Services to be Performed by ENGINEER
ENGINEER hereby agrees to perform the following services:
1. Perform supplemental topographic location and elevation
surveys as needed to complete a preliminary and final
design as shown on Exhibit "A" attached hereto and by
this reference made a part hereof; and tie out all
existing centerline monuments to clear anticipated
construction.
2. Prepare detailed plans for the construction of the
project. Plans will be prepared on standard plan and
profile sheets to be furnished by the CITY. The plan
view will be 1" = 20'.
3. Provide straddle ties for the setting of precise align-
ment centerline monumentation after construction at the
Dana Road - Superior Avenue intersection, punch brass
cap and provide centerline tie notes.
4. Prue the necessary special provisis and bid proposal,
in conjunction with the City's Standard Specifications
(Standard Specifications for Public Works Construction, 1973
Edition including supplements) on Xerox masters suitable
for use by the CITY in calling for competitive bids.
5. Prepare a final ENGINEER's estimate based on the quantities
used in the bid proposal.
6. Review progress of the design with CITY staff at appropri-
ate points during preparation. The timing of such reviews
shall be at CITY's discretion.
7. Provide professional consultation for interpretation of
plans and specifications and advice during the construction
of the PROJECT.
8. Set 6 property corners for parcels to be acquired for com-
pletion of the PROJECT widening.
III. Duties of CITY
CITY hereby agrees to supply ENGINEER with the following informa-
tion and materials:
A. Record information regarding the location of existing
underground utilities.
B. As -Built construction drawings of surface and underground
improvements in the PROJECT area.
C. Soils investigation report.
D. Mylar plan and profile and standard sheets for preparation
of original PROJECT drawings.
E. Any other additional information available which the parties
hereto agree may be beneficial to the final design of the
PROJECT.
IV. Ownership of PROJECT Documents
Original drawings, reports, notes, maps and other documents
shall become the property of the CITY and may be reproduced
and utilized as deemed necessary by the Public Works Director.
V. ENGINEER in Charge
Jack P. Norris, RCE No. 15446, shall be the engineer in charge
of PROJECT design.
VI. Right of Termination
CITY reserves the right to terminate this agreement at any
time by giving ENGINEER three (3) days' prior written notice;

notice shall be deemed served upon deposit in the United States
Mail, postage prepaid, addressed to any of ENGINEER's business
offices. In the event of termination due to fault of ENGINEER,
CITY shall be relieved of any obligation to compensate ENGINEER.
If this agreement is terminated for any reason other than fault
of ENGINEER, CITY agrees to compensate ENGINEER for the actual
services performed up to the effective date of the notice of
termination, on the basis of the fee schedule contained herein.
VII. Completion of Final Design
Final design, including all plans and other documents for the
PROJECT shall be submitted to the Public Works Director of CITY
for final review within ninety (90) calendar days following
authorization by CITY to proceed with final design.
VIII. Fee Schedule and Pavment
In consideration of the performance of the above - described
engineering services, CITY hereby agrees to pay ENGINEER an
amount based upon the hourly rate schedule set forth below.
In no event shall said amount be greater than Nine Thousand
One Hundred Dollars ($9,100.00), except as otherwise provided
herein.
A. Hourly rates for office and field personnel shall be as
follows:
Registered Engineer $30.00 /hour
Licensed Land Surveyor $30.00 /hour
Designer and Supervisor $24.00 /hour
Draftsman $20.00 /hour
Survey Crew (2 -man) $50.00 /hour
(3 -man) $65.00 /hour
B. The contract amount shall be paid to ENGINEER as follows:
1. Monthly partial payments shall be based on the amount
earned each month, as determined by the fee schedule.
The sum of the monthly partial payments shall not exceed
ninety percent (90%) of the maximum fee;
2. Balance of the total amount earned to be paid upon
completion of work specified in Section II (Services to
be Performed by ENGINEER), or by November 1, 1976,
whichever occurs first;

3. In addition, CITY agrees to reimburse ENGINEER for '
the actual cost of reproduction of copies of said plans
and related documents, as well as computer costs, filing
fees, checking fees, cost of aerial photography,
materials cost related to survey work plus ten percent
(10 %), and other related costs authorized by the Public
Works Director and advanced by ENGINEER.
IX. Additional Work
Should ENGINEER complete any additional work not outlined in this
agreement, but authorized by CITY, such as legal descriptions,
revisions to final plans, design of off -site facilities, additional
topography, additional utility design or construction staking, the
extra work shall be performed on an hourly basis in accordance with
the hourly rate standard fee schedule set forth in Section VIII
(Fee Schedule and Payment) above.
X. PROJECT Scope Revisions
The scope of the PROJECT may be changed and the maximum fee
revised upon prior written approval of the Public Works Director
if the increase in the maximum fee does not exceed One Thousand
Dollars ($1,000.00). If revisions to the scope of the PROJECT
would result in an increase in the maximum fee exceeding One
Thousand Dollars ($1,000.00), an amendment providing for such
revisions shall be processed and executed by the parties hereto.
XI. Hold Harmless
ENGINEER shall indemnify and save harmless CITY and its officers
and employees from any damage or liability arising from any
errors, omissions or negligence in the ENGINEER's performance of
this agreement, or in the engineering work and services herein
provided.
IN WITNESS WHEREOF, the parties hereto have executed this agreement
on the date first above written.

SUBJECT: AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
SUPERIOR AVENUE WIDENING - FIFTEENTH STREET TO INDUSTRIAL WAY
(C -1665)
RECOMMENDATION:
Execute the subject agreement on behalf of the City in
accordance with Council Policy F -14.
DISCUSSION:
Attached are three (3) copies of the subject agreement for the
design of the Superior Avenue Widening project which is included in the
current year's budget. The project is being financed cooperatively with
the County of Orange under its Arterial Highway Financing Program (AHFP).
The fee of Wilson- McHugh- Norris, Consulting Civil Engineers
and Land Surveyors is $9,100.00 which is less than the $12,000.00 limit
of Council Policy F -14 for agreements with consulting engineers executed
by the City Manager.
