At its meeting on July 14, 1975, the City Council
adopted Resolution Mo. 8553 authorizing the
subject contract.
Attached are two fully executed copies for transmittal
to Simpson- Steppat and for your file with a copy of
the resolution.

AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
(BALBOA AVENUE STORM DRAIN IMPROVEMENTS - MARINE
AVENUE TO THE GRAND CANAL - CONTRACT NO. 1683)
THIS AGREEMENT is made and entered into this aJ�
day of 1975, by and between the CITY OF
NEWPORT B ACH, I corporation, municipal oration, hereinafter referred to as

"CITY," and the firm of SIMPSON- STEPPAT, CONSULTING CIVIL ENGINEERS,
hereinafter referred to as "ENGINEER."
W I T N E S S E T H:
WHEREAS, CITY intends to install a storm drainage.system
on Balboa Avenue from Marine Avenue to the Grand Canal (Alternate "A"
Gravity System, Alternate "B" Pump System), hereinafter referred to
as "PROJECT," as shown on Exhibit "A," attached hereto and by this .
reference made a part hereof; and
WHEREAS, ENGINEER has submitted a proposal to CITY to
perform engineering.services in connection with the preparation of
a preliminary design report and with a final design for the PROJECT;
and
WHEREAS, CITY desires to accept said proposal,
NOW, THEREFORE, in consideration of the foregoing, the parties
hereto agree as follows:
I. General.
I
A. CITY engages ENGINEER to perform the services
hereinafter described for the compensation herein
stated.
B. ENGINEER agrees to perform said services upon the
terms hereinafter set forth.
II. Services to be Performed by ENGINEER.
ENGINEER agrees to perform the following services:
A. Preliminary Design Report.
1. Prepare preliminary designs for Alternates"
"A" and "B." Plans will be prepared on

8 1/2" x 11" sheets to be furnished by
the CITY.
2. Prepare preliminary cost estimates for
Alternates "A" and "B."
3. Prepare estimates of maintenance and operation
costs over a 20 -year period for Alternates "A"
and "B."
4. Provide a brief letter -type report summarizing
the advantages and disadvantages of the alter-
nate design concepts.
B. Final Design.
1. Perform topographic surveys as required to com-
plete a final design of the selected alternate.
2. Prepare detailed plans, special provisions and
proposal for the construction of the PROJECT.
Plans will be prepared on mylar plan and profile
and standard sheets to be provided by the CITY.
The plan scale will be 1" = 201. The plans and
special provisions shall be assembled in con-
junction with the CITY's Standard Specifications
(Standard Specifications for Public Works
Construction, 1973 Edition, including supplements.)
The special provisions and bid proposal shall be
prepared on Xerox masters suitable for use by
the CITY in calling for competitive bids.
3. Prepare a final engineer's estimate based on the
quantities used in the bid proposal.
4. Review progress of the design with CITY staff at
appropriate points during its preparation. The
timing of such reviews shall be at the ENGINEER's
discretion.
5. Provide professional consultation for interpre
tations of the plans and specifications during
the construction of the PROJECT.
6. Review shop drawings.
III. Duties of CITY.
CITY hereby agrees to supply ENGINEER with the
following information and materials:
A. Vellum 8 1/2" x 11" plan sheets for the pre-
liminary design report;
B. Mylar plan and profile and standards sheets
for preparation of original project drawing;
C. Field measurements to reflect "as- built" con-
dition of work; (CITY will also make "as- built"
amendments to the drawings.)
D. Drainage study information for the area.
E. Any other additional information available which
the parties hereto agree may be beneficial to
the final design of the PROJECT.
F. Determine after ENGINEER completes preliminary
design report whether to proceed to final design
using Alternate "A" or "B" and instruct ENGINEER
to proceed to final design on the selected alternate.
IV. Ownership of PROJECT Documents.
Original drawings, reports, notes, maps and other docu-
ments shall become the property of the CITY and may be
reproduced and utilized as deemed necessary by the
Public Works Director.
V. Engineer in Charge.
Fritz C. Steppat, RCE No. 19249, shall be the engineer in
charge of PROJECT design.
VI. Right of Termination.
CITY reserves the right to terminate this agreement at
any time by giving ENGINEER three (3) days' prior written
notice; notice shall.be deemed served upon deposit in the
United States Mail, postage prepaid, addressed to any of
ENGINEER's business offices. In the event of termination

due to fault of ENGINEER, CITY shall be relieved of
any obligation to compensate ENGINEER. If this
agreement is terminated for any reason other than
fault of ENGINEER, CITY agrees to compensate ENGINEER
for the actual services performed up to the effective
date of the notice of termination, on the basis of the
fee schedule contained herein.
VII. Completion of Preliminary Project Report and Final Design.
All plans and other documents for the preliminary project
report shall be submitted to the Public Works Director of
CITY for review by April 11, 1975. CITY will review the
findings of the.preli.minary project report and notify the
ENGINEER (not later than April 301 1975) to proceed with
the final design of the selected alternate system. Final
design, including all plans and other documents for the
PROJECT, shall be submitted to the Public Works Director
of CITY for final review by June 30, 1975.
VIII. Fee Schedule and Payment.
In consideration of the performance of the above described
engineering services, CITY hereby agrees to pay ENGINEER
an amount based upon the hourly rate schedule set forth
below. In no event shall said amount be greater than
Six Thousand Five.Hundred Dollars ($6,500.00) for Alternate
"A" or Twelve Thousand Dollars ($12,000.00) for Alternate
"B," except as otherwise provided herein.
A. Hourly rates for office and field personnel
shall be as follows:
Principals $35.00 /hour
Project Engineer $22.50 /hour
Designers $18.00- $20:00 /hour.
Senior Draftsmen $13.50 /hour
Junior Draftsmen $9.50 - $12.00 /hour
Typist $12.00 /hour

B. The contract amount shall be paid to ENGINEER
as follows:
1. Monthly partial payments shall be based on
the amount earned each month as determined
by the fee schedule. The sum of the monthly
partial payments shall not exceed ninety
percent (908) of the maximum fee;
2. Balance of the total amount earned to be
paid upon completion of work specified in
Section II (Services to be Performed by
ENGINEER), or by June 1, 1976, whichever
occurs first;
3. In addition, CITY agrees to reimburse
ENGINEER for the actual cost of reproduction
of copies of said.plans and related documents,
as well as computer costs and other related
costs authorized by the Public Works Director
and advanced by ENGINEER.
IX. Additional Work.
Should ENGINEER complete any additional work not
outlines in this agreement, but..authorized by CITY,.
such as legal descriptions, revisions to final plans,
design of off -site facilities, additional topography and
construction staking, the extra work shall be performed
on an hourly basis in accordance with the hourly rate
standard fee schedule set forth in Section VIII (Fee
Schedule and Payment) above.
X. Project Scope Revisions.
The scope of the PROJECT may be changed and the maximum
fee revised upon approval of the Public Works Director,
if the increase in the maximum fee does not exceed
Six Hundred Fifty Dollars ($650.00) for Alternate "A"
or One Thousand Two Hundred Dollars ($1,200.00) for
Alternate "B." An amendment providing for such revisions

shall be processed and executed by the parties hereto,
if the increase in the maximum fee exceeds the above
amounts.
XI. Hold Harmless.
ENGINEER shall indemnify and save harmless CITY and its
officers and employees from any damage or liability
arising from any errors, omissions or negligence in
ENGINEER's performance of this agreement, or in the
engineering work or services herein provided.
IN WITNESS WHEREOF, the parties hereto have executed this
agreement on the date first above written..

OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN ENGINEERING SERVICES
AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH
AND SIMPSON - STEPPAT FOR BALBOA AVENUE STORM
DRAIN IMPROVEMENTS (MARINE AVENUE TO GRAND
CANAL), CONTRACT NO. 1683
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain engineering services
agreement between the City of Newport Beach and Simpson - Steppat
for Balboa Avenue Storm Drain Improvements (Marine Avenue to
Grand Canal), Contract No. 1683; and
WHEREAS, the City Council has.considered the terms.
and conditions of said agreement and found them to be fair and
equitable, and in the best interests of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of Newport
Beach.
