Newport Beach for data processing services, C -1685
Enclosed is a fully executed copy of subject agreement.
The City Council of Newport Beach authorized the execution of this
agreement on January 27, 1975 by the adoption of Resolution No. 8429.

AGREEMENT C -16 85
THIS AGREEMENT is made and entered into this 4th
day of February ,. 1975, by and between the CITY OF NEWPORT
BEACH, a municipal corporation, hereinafter referred to as "NEWPORT
BEACH,." ind the CITY OF PLACENTIA, a municipal corporation, hereinafter
referred to as " PLACENTIA."
W I T N E S S E T H:
WHEREAS,.NEWPORT BEACH is capable and willing to perform

certain data processing services; and
WHEREAS, PLACENTIA and NEWPORT BEACH desire to share the
use of such capabilities and data processing facilities; and
WHEREAS, it is recognized that the sharing of the use of.
such data processing facilities will be advantageous to both parties
to this Agreement,
NOW, THEREFORE, in consideration of the mutual covenants,
conditions, agreements and stipulations hereinafter expressed, the
parties hereto hereby agree as follows:
1. NEWPORT BEACH shall perform data processing services
as requested by PLACENTIA. Said services shall be conducted at such
times and in the manner deemed appropriate by NEWPORT BEACH;

2. PLACENTIA will furnish pick -up and delivery for all
materials used by it in connection with this activity;
3. PLACENTIA will pay to NEWPORT BEACH One Hundred Dollars
($100.00) per month for processing vehicle cost system;
4. PLACENTIA will be billed monthly and amount will be
due and payable within thirty (30) days;
5. NEWPORT BEACH will furnish to PLACENTIA non - chargeable
NCR pre - packaged computer programs when available;
6. The term of this contract shall be for one (l) month
and shall continue for successive periods of one (1) month each unless
the legislative body of either party hereto votes to terminate the
contract. Notice of termination shall be provided to the other party
in writing at least thirty (30) days prior to the date of termination.

7. PLACENTIA agrees to hold NEWPORT BEACH harmless from
any costs or liabilities, bodily injury, personal injury, death or
property damage arising from the performance of this Agreement.
IN WITNESS WHEREOF, the parties hereto have set their hands

RESOLUTION NO. 8429
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND THE CITY OF
PLACENTIA IN CONNECTION WITH DATA PROCESSING
SERVICES
WHEREAS, there has been presented to the City Council
of the City of Newport Beach an agreement between the City of
Newport Beach and the City of Placentia in connection with data
processing services; and
WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair and
equitable, and in the best interests 'of the City;
NOW, THEREFORE, BE IT RESOLVED by the 'City Council
of the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on.behalf of the City of Newport
Beach.
