W I T N E S S E T H WHEREAS, the United States Department of Interior has proposed to expand the Outer Continental Shelf (OCS) oil and gas leasing program to approximately 10- pillion acres; and WHEREAS, the Department of Interior has released for public review a draft environmental impact statement for such expansion (programmatic EIS) ; and trrIEREAS, the Department of Interior is prepariTg a draft environmental impact statement for the specific areas on the Southern California OCS proposed to be leased in iaid- 1975 (tract specific EIS); and IVHEREAS, an ad hoc coalition of concerned cities and counties (Coalition) has been formed in Southern California to insure the greatest possible public participation in the Department of Interior's consideration of the proposal to expand OCS oil and gas leasing; and i MiEREAS, the Coalition has determined that it is necessary to obtain thorough, independent critiques of both the programmatic EIS and the tract specific EIS; and 101E REAS, each member of the Coalition is ready acid willing to contribute money to the cost of such critigp and is willing to follow a formula for such contributions t.hich is based upon the relationship of the money contributed by the City of Los Angeles and that City's population, assessed valuation, and miles of shoreline; and WHEREAS, the City Council of the City of Los Angeles has already caused a separate account to be established for this purpose in the Office of the Controller of the City of Los Angeles and for the above purposes has caused to be therein deposited the sun of 515,000 and authorized the expenditure of up to said sum as the City's share of such a critique; and WHEREAS, the Coalition has determined that the fund established pursuant to this contract and contracts with other members of the Coalition is to administered by the 'iayor of the City of Los Angeles, on behalf of the Coalition, with full and complete authority to expend funds and execute contracts on behalf of the Coalition in futherance of the ains of the Coalition as set forth hereinabove. NOW, THEREFORE, IT IS AGREED: 1. The Coalition :ie::bers shall each make a doposit to that account designated 6042 Cii Critique Fund in the Office of the Controller of the City of Los Angeles in a swn aetermined according to the ormuia sat fo-L-., :,arei:_balu;; which is based upon a City of Los Angeles contribution, said City's population, its assessed valuation and its shoreline: a. The contribution of the Citv of Los Angeles shall be the s-c:? of $IS,000. �L� 0 b. The contribution of each of the other members of the Coalition shall be equal to or greater than a sum determined on the basis of $0.002 per capita, plus X0.000 000 6 per dollar of assessed valuation, plus $112.61 per mile of shoreline of such other member. 2. The City of Newport Beach hereby agrees to contribute and pay forthwith to the City of Los Angeles the sun of $ 3,181.12 Which sun is at least equal to a sum com- puted pursuant to the formula contained in Section 1. above, said sum to be deposited into the 6942 Oil Critique Fund in the Office of the Controller of the City of Los Angeles and be disbursed therefrom only upon demand by the -iayor or the City of Los Angeles in furtherance of the purposes of this contract. 3. The Mayor of the City of Los Angeles is authorized to expend said sun, or any portion thereof, to obtain a critique, or critiques, to his satisfaction, of the programmatic EIS and /or tract specific EIS, for purposes of preparing and presenting testimony at public hearings on said EIS's or either of them, preparing and presenting written coiuments to the Department of Interior regarding said EIS's or either of them, and preparing and presenting testimony ana reports to members of Congress and Congressional Committees and any other governmental entity regarding the proposal to expand oil and gas development on the OCS. -3- • • 4. Any funds contributed and not expended for the purposes set forth in paragraph 3 shall be returned to the contributing members of the Coalition on a pro rata basis, each member's refund to be determined on the basis of the relationship its contribution bears to the total sum con- tributed by the Coalition. CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF LOS ANGELES AND THE CITY OF NEWPORT BEACH TO SHARE IN THE COSTS TO RETAIN A SCIENTIFIC CRITIQUE OF THE DEPARTMENT OF INTERIOR'S ENVIRONMENTAL IMPACT STATEMENT FOR THE PROPOSED EXPANSION OF THE OUTER CON - TINENTAL SHELF OIL AND GAS LEASING PROGRAM WHEREAS, there has been presented to the City Council of the City of Newport Beach an agreement between the City of Los Angeles and the City of Newport Beach in connection with the sharing of the costs to retain a scientific critique of the Department of Interior's Environmental Impact Statement for the proposed expansion of the Outer Continental Shelf Oil and Gas Leasing Program; and WHEREAS, the City Council has considered the terms and conditions of said agreement and found them to be fair and equitable, and in the best interests of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said agreement above described is approved, and the Mayor and City.Clerk are hereby authorized and directed to execute the same on behalf of the City of Newport Beach.
