Enclosed are two fully executed copies of subject agreement. Please
transmit one copy to the appropriate federal agency and retain a copy
for your files.
Said agreement was authorized by the City Council an February 24, 1975
by the adoption of Resolution No. 3446.

HOLD HARMLESS AGREEMENT
(Los Alamitos Naval Air Station -
Helicopter Training)
On this .257N day of FEES 1975, the
CITY OF NEWPORT BEACH, a municipal corporation, hereinafter
referred to as "CITY," finds and declares that:
WHEREAS, CITY desires to conduct police helicopter
training at the Los Alamitos Naval Air Station, Los Alamitos,
California, for the purpose of initial pilot qualification
training and for safety of flight check rides; and
WHEREAS, the Los Alamitos Naval Air Station will permit
such activity on the airfield to be conducted when the airfield
is open, under operational control of the tower, and in accord
with all applicable operational procedures; and
WHEREAS, CITY may use said facility only if the CITY
executes a "Hold Harmless Agreement" prior to the use of the
field,
NOW, THEREFORE, in consideration of permission to use
the Los Alamitos Naval Air Station for helicopter training purposes,
the CITY herewith agrees to hold the Department of Navy, the
Department of Army and California Army National Guard harmless
from all demands, claims, liabilities or judgments or damages
arising out of or resulting from injury or death to persons or
property, caused by or growing out of or occurring in connection
with the use of said Los Alamitos Naval Air Station by the CITY
for helicopter training.
The CITY further agrees that this Hold Harmless Agreement
may be terminated by the CITY upon giving ten (10) days' written
notice to the Department of Navy, Department of Army and the
California Army National Guard prior to the effective termination
of this Agreement.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY
CLERK TO EXECUTE A HOLD HARMLESS AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND THE DEPARTMENT OF
NAVY, THE DEPARTMENT OF ARMY AND THE CALIFORNIA
ARMY NATIONAL GUARD, PERMITTING USE OF THE AIR
STATION FOR PERIODIC TRAINING AND TESTING OF
HELICOPTER PILOTS
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a hold harmless agreement between
the City of Newport Beach and the Department of Navy, the
Department of Army and the California Army National Guard,
permitting use of the air station for periodic training and testing
of helicopter pilots; and
WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair and
equitable, and in the best interests of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of
Newport Beach.
