The recording information is shown in the upper right hand corner of the documents. Please transmit one Copy to E. G. Warmington and the other is for yaw files. G. WARMINGTON, SR., hereinafter referred to as "Warmington". W I T N E S S E T H WHEREAS, Warmington is the owner of that certain parcel of real property located in the City of Newport Beach, County of Orange, State of California and described as Lot 2 of Tract 1235 as recorded in Book 47 page 24 of Miscellaneous Maps, Records of Orange County, California referred to as Parcel "A"; and WHEREAS, Warmington desires to make improvements to the structure located on said property which will require an additional parking space, under the provisions of the Newport Beach Municipal Code; and WHEREAS, Warmington has entered into an agreement with the Don Koll Company, Inc. to permit Warmington to use a parking space in the parking structure owned by Don Koll Company, Inc., a copy of which is attached hereto for illustrative purposes and is marked Exhibit "A"; and WHEREAS, the Planning Commission of the City of Newport Beach at its meeting of April 17, 1975 considered the outside parking agreement and recommended approval to the City Council of the City of Newport Beach of said off street parking agreement provided that the agreement would not be executed by the City until such time as the parking structure had been restriped to provide sufficient parking spaces and no building permit should be issued to improve the real property owned by Warmington on said parcel until the parking structure had been restriped; and WHEREAS, the City Council at its meeting of April 28, 1975 considered the provisions of Section 12.38.040 of the Newport Note: The City of Newport Beach - RECORDED IN OFFICIAL RECORDS requests free recor.Aation OF ORANGE COUNTY, CALIFORNIA pursuant to Go Code 6103. , �a` a 9°05 A.M.OCT 291915 8 Civ J. WY1.iE CAALYLE, County Re00rder RK 11551 PG 1888 Beach Municipal Code and determined that the off-street parking agreement should be approved, NOW, THEREFORE, in consideration of the foregoing, IT IS AGREED by and between the parties hereto as follows: 1) Warmington will lease from Don Koll Company, Inc. a parking space in the parking structure owned by Don Koll Company, Inc., located near the intersection of Via Lido and Central Avenue, Newport Beach, California. 2) In the event the use of the parking space as referred to in paragraph 1 should be terminated and loss to Warmington for any reason, Warmington will immediately thereafter obtain an additional off-street parking space satisfactory to and to be approved by the City. I.f the substitute parking space is not obtained, Warmington will physically modify the structure which presently houses Port O'Call, Pasadena, located on the subject property at 3400 Via Lido, in the Lido Shops area, in such a fashion as to reduce the parking requirement for said structure by one off-street parking space. 3) This agreement shall run with the property described within as parcel "A" and shall bind the heirs, successors in interest and assigns of -the parties hereto and it shall be recorded in the office of the County Recorder at the County of Orange, State of California. I am returning herewith the original and the three copies. Please forward to Warmington for attachment of the required lease and execution. By this memo I am also forwarding a copy of the agreement to the City Clerk with instructions that it should not be executed by the City until such time as the Don Koll Company, Inc. has restrlped the parking structure. Hewicker, ssistant Director - Planning Director - Planning JDH /sh # ft RESOLUTION NO. 8477 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN OFF -SITE PARKING AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH AND WARMINGTON DEVELOPMENT, INC. WHEREAS, there has been presented to the City Council of the City of Newport Beach a certain off -site parking agreement between the City of Newport Beach and Warmington Development, Inc.; and WHEREAS, the City Council has considered the terms and conditions of said agreement and found them to be fair and equitable, and in the best interests of the City; NOWT THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that said off -site parking agreement above described is approved, and the Mayor and City Clerk are hereby authorized and directed to execute the same on behalf of f the City of Newport Beach.
