Attached are two executed copies of the Amendment
to the Agreement with Hardy House for transmittal
to them as well as for your records.
This Amendment was authorised by the City Council
on September 8 by the adoption of Resolution No.
5593.
AMENDMENT TO AGREEMENT
THIS AMENDMENT TO AGREEMENT is made and entered into
this Ib -r day of September, 1975, by and between the CITY OF
NEWPORT BEACH, a municipal corporation, hereinafter referred to
as "CITY ", and HARDY HOUSE PUBLISHING COMPANY, hereinafter
referred to as "HARDY ".
W I T N E S S E T H:
WHEREAS, on May 29, 1975, the parties hereto entered
into an agreement whereby HARDY was to publish a pictorial history
of CITY in consideration of the Bicentennial Committee endorse-
ment; and
WHEREAS, pursuant to paragraph 1 of said agreement
said publication was to be ready for distribution on or before
July 4, 1975; and
WHEREAS, HARDY has requested an extension of time to
August 31, 1975, within which to produce and have ready for
distribution said publication,which extension was granted on
July 14, 1975; and
WHEREAS, HARDY has requested an additional extension
of time to October 1, 1975; and
WHEREAS, CITY has considered HARDY'S request for an
extension and found it to be reasonable under the circumstances.
NOW, THEREFORE, in consideration of these premises, the
parties hereto agree as follows:
1. Paragraph 1 of the Agreement between CITY and
HARDY dated May 29, 1975, as amended on July 14, 1975 is hereby
amended to read as follows:
"On or before October 1, 1975, HARDY will produce,
publish and have ready for distribution a bound book
containing pictures and historical data about the
Nation in general and the City of Newport Beach in
particular."

2. The remainder of all other terms and conditions
of the original Agreement dated May 29, 1975, are unaffected
by this Agreement and do hereby remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have set their
hands the day and year as is first above written.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AMENDMENT TO AN
AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH
AND HARDY HOUSE PUBLISHING COMPANY IN CONNECTION
WITH AN EXTENSION OF TIME TO OCTOBER 1, 1975
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain amendment to an agreement
between the City of Newport Beach and Hardy House Publishing
Company in connection with an extension of time to October 1,
1975; and
WHEREAS, the City Council has considered the terms
and conditions of said amendment to the agreement, and found
them to be fair and equitable and in the best interests of the
City;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said amendment above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of Newport
Beach.

AGREEMENT
OF NEWPORT BEACH, a municipal corporation, hereinafter referred
to as "CITY ", and HARDY HOUSE PUBLISHING COMPANY, hereinafter
referred to as "HARDY"
W I T N E S S E T H:
WHEREAS, HARDY has submitted a proposal to CITY to
publish a pictorial history of CITY to be sold and distributed
as part of the Nation's Bicentennial celebration; and
by HARDY;
WHEREAS, CITY desires to accept the proposal presented
NOW, THEREFORE, in consideration of the mutual covenants,
conditions, agreements and stipulations hereinafter expressed,
the parties hereto agree as follows:
1. On or before July 4, 1975, HARDY will produce,
publish and have ready for distribution a bound book containing
pictures and historical data about the Nation in general and
the City of Newport Beach in particular.
2. The contents of said book shall be subject to
review and final determination by a committee consisting of
two (2) members of the Newport Beach Bicentennial Committee and
one (1) representative from HARDY.
3. HARDY will assume all production costs during
preparation of the book, as well as all future costs connected
with the distribution of said book.
4. CITY assumes no cost, obligation, duty or responsi-
bility for the production, publication, printing or distribution
of said book.

5. CITY agrees that HARDY can represent to purchasers,
sponsors or advertisers that said book is endorsed by the
Newport Beach Bicentennial Committee.
6. In consideration of said endorsement by the
Newport Beach Bicentennial Committee, HARDY will on or about
August 1, 1975, pay the sum of Five Thousand Dollars ($5,000)
to the Newport Beach Bicentennial Committee to be used in
furtherance of the Committee's purposes and activities. HARDY
will not be obligated to pay said sum unless two hundred (200)
book sponsorships are sold at an average price of Two Hundred
Dollars ($200) each. If less than two hundred sponsorships are
sold, HARDY will pay a pro rata share to CITY of the sponsorships
actually sold.
7. The term of this agreement shall be for a period
of six (6) months commencing on the date of this agreement,
unless sooner terminated by CITY upon ten (10) days prior written
notice.
IN WITNESS WHEREOF the parties hereto have set their

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND HARDY HOUSE
PUBLISHING COMPANY TO PRODUCE A PICTORIAL
HISTORY OF NEWPORT BEACH
WHEREAS, Hardy House Publishing Company has submitted
a proposal to the Bicentennial Committee to publish a pictorial
representation of Newport Beach from its early days to modern
development; and
WHEREAS, in return for the use of the Bicentennial
Committee's name as sponsoring the publication, Hardy House
Publishing Company will remit the sum of Five Thousand Dollars
($5,000) from the proceeds realized from the sale of the booklet
to be used by the Committee in furtherance of their duties and
purposes; and
WHEREAS, the City Council has reviewed said proposal
and found it to be in the best interest of the City;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Newport Beach approves the proposal of Hardy House
Publishing Company to produce a pictorial history of the City
of Newport Beach and hereby authorizes the Mayor and City Clerk
to execute said agreement on behalf of the City of Newport Beach.
BE IT FURTHER RESOLVED that the City Council hereby
accepts the sum of Five Thousand Dollars ($5,000) from Hardy
House Publishing Company in consideration for the use of the
Bicentennial Committee's name as sponsoring said publication,
said sum to be used in furtherance of the duties and purposes of
the Bicentennial Committee.
ADOPTED this 12th day, of May , 1975.
