Enclosed are two executed copies of an agreement with
Coast Catamaran and two executed copies of an agreement
with Hobie Newport to provide boats for subject program.
Please transmit one oDM of each to the respective
companies.

by the adoption of Resolution No. 8522 and 8523.

A G R E E M E N T
THIS AGREEMENT is made and entered into this
day of , 1975, by and between the CITY OF NEWPORT
BEACH, a municipal corporation, hereinafter referred to as "CITY"
and HOBIE NEWPORT, hereinafter referred to as "HOBIE ".
W I T N E S S E T H:
WHEREAS, HOBIE has offered to supply CITY with three (3)
catamaran sailboats to be used in the City's summer recreation
sailing program; and
WHEREAS, HOBIE has offered and whereas CITY desires to
accept the boats for its summer recreation sailing program; and
WHEREAS, CITY agrees that instructors hired by it will
maintain the boats; and
WHEREAS, HOBIE understands,and agrees that Ritchie Moore,
doing business as "Powered By Nature Childrens' Outdoor Recreation
Program ", as a contractor for the City will be liable for any
damage done to said sailboats during the operation of the summer

recreation sailing program; and
WHEREAS, CITY agrees to provide liability insurance to
protect HOBIE against bodily injury and property damage claims
arising out of the City's summer recreation sailing program in
connection with said sailboats.
NOW, THEREFORE, in consideration of the premises, it is
hereby agreed by and between the parties hereto that:
1. CITY shall have the use of three (3) catamaran
sailboats owned by HOBIE from July 1, 1975, to September 1, 1975,
to be used in the City's summer recreation sailing program.
During this period CITY shall have the exclusive use of said

catamaran sailboats.
2. Ritchie Moore, doing business as "Powered By Nature
Childrens' Outdoor Recreation Program ", will be responsible for
any loss or damage of or to any sailboat or equipment thereon
during the period when said sailboats are used in the City's
summer recreation sailing program.
3. CITY agrees to indemnify and hold HOBIE harmless
from any and all liability or damage arising out of injury to
persons or property while CITY is using HOBIE catamaran sailboats,
and CITY shall name HOBIE as an additional insured on its third
party liability insurance policy.
4. Upon termination of this Agreement, CITY shall
return said sailboats to HOBIE.
IN WITNESS WHEREOF, the parties hereto have executed
this agreement as of-,the day and year first above written.

RESOLUTION NO. 85 23
F A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY.CLERK TO EXECUTE AN AGREEMENT BETWEEN
THE CITY OF NEWPORT BEACH AND HOBIE NEWPORT
TO PROVIDE BOATS FOR A SUMMER SAILING PROGRAM
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and Hobie Newport in order to provide
catamaran sailboats for use in a summer sailing program; and
WHEREAS, the City Council has considered the terms
and conditions of said agreement, and found them to be fair and
equitable and in the best interests of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized

and directed to execute the same on behalf of the City of Newport
Beach.
