Background When the new tower was completed at Hoag Hospital, the facilities which had been located in the Hoag North Unit (located at the northwest corner of Newport Boulevard and Hospital Road) were relocated, and the Hoag North Unit was taken over by the First Healthcare Corporation. They restored a portion of the building to a convalescent hospital and converted the remainder to office uses. The First Healthcare Corporation also owns the Newport Villa Healthcare, a residential nursing care facility located to the north of the convalescent hospital and office building. In order to provide the additional parking for the offices, First Healthcare requested an amendment to Use Permit No. 1396, covering the Newport Villa Healthcare, which would reduce the number of beds from 170 to 125. The Planning Commission approved this amendment on November 21, 1974, with the condition (Condition No. 2) that First Healthcare Corporation provide an off -site parking agreement between their two facilities. The off -site parking agreement is for nineteen spaces. Slavik, Pasadena Application This application requests approval of an amendment to a previously approved use permit for an adult retirement care center by reducing the number of beds from 170 to 125. Use permit procedures are out- lined in Chapter 20.46 of the Newport Beach Municipal Code. The applicant is also requesting approval of an offsite parking agreement so as to allow a portion of the existing parking spaces for said adult retirement center to be utilized by a permitted convalescent hospital adjoining the site at 393 Hospital Road. In accordance with Section 20.38.040 of the Newport Beach Municipal Code, the Planning Commission shall not recommend and the City Council shall not approve off - street parking on a separate lot from the build- ing site or sites unless: (a) Such lot is so located as to be useful in connection with the proposed use or uses on the building site or sites. (b) Parking on such lot will not create undue traffic hazards in the surrounding area. (c) Such lot and the building site are in the same ownership, or the owners of the building sites have a common ownership in such lot, and the owner or owners are entitled to the immediate possession and use thereof (ownership of the off -site lot must be ownership in fee or a leasehold interest of a duration adequate to serve all proposed uses on the building site or sites). (d) The owner or owners and the City, upon the approval of the City Council, execute a written instrument or instruments, approved as to form and content by the City Attorney, providing for the maintenance of the required off - street parking on such lot for the duration of the proposed use or uses on the building site or sites. Should a change in use or additional use be proposed, the off - street parking regulations applicable at the time shall apply. Such instruments shall be recorded in the office of the County Recorder and copies thereof filed with the Department of Community Development. Item No. 4 • 0 TO: Planning Commission - 2. Environmental Significance This project has been reviewed, and it has been determined that it will not have any significant environmental impact. Background Permit 1285, 1285 -A, 1285 -8 - Northwesterly corner of At its meeting of July 20, 1967, the Planning Commission approved Use Permit No. 1285 permitting a two hundred bed convalescent hospital on the subject site. Subsequently on November 20, 1969, Use Permit No. 1285 -A was approved so as to permit Hoag Hospital to operate a north unit consisting of ninety three acute medical beds for a period of three years. The use permit was further amended on January 15, 1970, with the approval of Use Permit No. 1285 -B which allowed thirty - seven psychiatric beds. The expiration of Use Permit No. 1285 -B was timed to coincide with the expiration of Use Permit No. 1285 -A. At its meeting of December 21, 1972, the Commission approved the extensions of Use Permit No. 1285 -A and Use Permit No. 1285 -B until June 1, 1974, pending the construction of proposed additional facilit- ies on the main Hoag Hospital site. Use Permit No. 1285 -A has become void, but the Modifications Committee on May 21, 1974, approved a six month extension for Use Permit No. 1285 -B to allow time for the modification of the buildings at Hoag Hospital and to accommodate the relocation of the 37 psychiatric beds. It should be noted that the Use Permits noted above were approved pursuant to Section 20.08.080 of the Newport Beach Municipal Code which will permit institutional uses such as hospitals and etc. in any district subject to a use permit. Since that time the zoning on the subject property has been changed from the R -3 and the C -O -H to the A -P District (A -390) where medical centers, physical, medical and diagnostic laboratories, pharmacies for dispensing of drugs and medical supplies, and other uses of a similar nature are automatically permitted. The applicant now proposes to reuse the site noted above for a 96 bed "skilled care" convalescent hospital and medical and corporate office space. The Board of Directors of the Orange County Health Planning Council has approved the relocation of the applicants "skilled care" convalescent hospital from its Superior Avenue location in the unincorporated County area to the former Hoag North Building and approvals for that portion of the proposed use have been secured from the City. However, permits for the medical and corporate office space have not been obtained inasmuch as these uses will require more parking than was originally provided under the use permits noted above. Use Permit No. 1396 - 4000 Hilaria Way On October 3, 1968, the Planning Commission approved Use Permit No. 1396 permitting a one hundred and seventy bed adult retirement care center on the subject property. This permit was processed pursuant to Section 20.16.030 of the Newport Beach Municipal Code which allows rest homes in the R -3 District subject to a use permit. As noted above the zoning on the subject property has since been changed from the R -3 and the C -O -H Districts to the A -P District. The applicant now proposes to amend this use permit by reducing the number of beds from 170 to 125 and to use the proportionate reduction in required parking spaces for the proposed medical and corporate office uses on the adjoining site. Item No. 4 TO: Analysis i Planning Commission - 3. E Existing Parking Requirements for Approved Use Permits The 200 bed convalescent hospital (i.e. Use Permit No. 1285) required one parking space for each two beds, or 100 parking spaces. The conditions of approval included the requirement that 83 of the required parking spaces be provided on the site, and that the other 17 required parking spaces be provided on the adjacent Park Lido Building parking lot. An off -site parking agreement for the subject 17 spaces was approved by the City Council in 1968, and the document was recorded. It should be noted that the off -site parking spaces in the Park Lido Building parking lot will still be available for the proposed develop- ment in the Hoag North Building. The 170 bed adult retirement resident care center (i.e. Use Permit No. 1396) located on the property in question required 82 parking spaces, or one parking space for each 2.07 beds. Proposed Development and Required Parking Spaces The applicant proposes to convert a portion of the Hoag North Building into medical and corporate offices and a physical and occupational therapy out - patient clinic. It was apparent that the traffic congestion of the area has been greatly relieved since the construction of the parking structure. There were at least 50 empty parking spaces in the parking lot of the Park Lido Building when inspected by staff. Approximately twenty of the one hundred parking spaces required for the Hoag North Building were being utilized for the parking of auto- mobiles, but the parking demand will obviously be increased with the proposed office development on the site. It should also be noted that thirteen parking spaces (i.e. parking spaces Nos. 57 through 69 on the attached plot plan) have been eliminated and "no parking" signs have been placed on the wall adjacent to Patrice Road. Staff suggests that the parking spaces be remarked and the "no parking" signs be removed prior to the development of the proposed uses. Only eighteen automobiles were parked in the eighty two space parking areas on the Newport Villa Building site when inspected by staff. It appears that the number of parking spaces far exceed the needs of the resident, visitors, and employees of the adult retirement care center. The Administrator for the facility has been maintaining a daily count of spaces utilized since October 1, 1974, and the average count on a daily basis is 16 spaces with a maximum of 25 spaces used on one day. A letter from the applicant detailing the parking needs of the adult retirement care center is attached. It should be noted, however, that two of the parking spaces under the existing facility were being utilized for the storage of wood. Staff suggests that the existing storage be removed. Recommendation Approval of Use Permit No. 1396 (Amended) is recommended, subject to the following conditions: That development shall be in substantial conformance with the approved plot plans and floor plans. That an off -site parking agreement shall be approved, guaranteeing that a minimum of nineteen parking spaces shall be provided on the existing Newport Villa Building site for the duration of the proposed office development in the existing Hoag North Building site. That all signs for the proposed development shall be approved by the Director of Community Development. That the number of beds for the adult retirement care center on the subject property shall not exceed 125 beds with the proposed office development in the Hoag North Building. 5. That the number of beds for the "skilled care" convalescent hospital in the Hoag North Building shall not exceed 96 beds with the proposed office development in the complex. This request is based on the following data: There are 85 resident rooms in the building. They are as follows: Single rooms = 77 2 suites (2 rooms each which could be converted to single rooms) = 4 2 suites (2 rooms each which cannot be converted to single rooms) = 4 Total 85 The license, which was granted on February 1, 1971 for 170 beds, was based on double occupancy in all rooms. The private room census has averaged between 45 -50 since the opening. Based on this fact alone, the maximum 2 bed room occupancy with every room filled could only reflect 40 rooms for a census of 80. This would mean an effective capacity of 125 total. Our business projects reflect an effective capacity of 115 -117. (The effective capacity is less also if a suite is privately occupied, which often occurs.) Our average census is 100 -105.
