AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
(DRAFT ENVIRONMENTAL IMPACT REPORT
FOR THE WIDENING OF

THIS AGREEMENT is made and °irtered into this ay of
Q r, 7-0 .3 CfR 1975, by and between the CITY OF NEWPORT BEACH, a
municipal corporation, hereinafter referred to as "CITY ", and the firm of
ALDERMAN, SWIFT & LEWIS, CONSULTING ENGINEERS, hereinafter referred to as
"ENGINEER ".
W I T N E S S E T H
WHEREAS, CITY's Circulation Element - Master Plan of Streets and
Highways has designated Jamboree Road between Coast Highway and the northerly
City boundary a Major Road (six lanes divided), and
WHEREAS, the roadway improvements for Jamboree Road between Ford Road
and MacArthur Boulevard have not been completed to a Major Road cross section
and CITY desires to complete these improvements, hereinafter referred to as
"PROJECT ", and
WHEREAS, the California Environmental Quality Act of 1970 requires
that an Environmental Impact Report (EIR) be prepared to inform public decision
makers and the general public of the environmental effects of projects they
propose to carry out, and
WHEREAS, ENGINEER has submitted a proposal to CITY to perform engineer-
ing services in connection with the preparation of an EIR for PROJECT: and
WHEREAS, CITY desires to accept said proposal,
NOW, THEREFORE, in consideration of the foregoing, the parties hereto
agree as follows:
I. General
A. CITY engages ENGINEER to perform the services hereinafter
described for the compensation herein stated.
B. ENGINEER agrees to perform said services upon the terms
hereinafter set forth.
II. Services to be Performed by ENGINEER
ENGINEER hereby agrees to perform the following services:
A. Prepare a Draft EIR for PROJECT following the "Guidelines
for Implementation of the California Environmental Quality
Act of 1970" issued by State of California Resources
Agency and complying with CITY procedures for the

preparation of EIR's. The Draft EIR shall include but
not be limited to data and environmental assessments
more specifically described in ENGINEER's proposal
dated October 8, 1975, and by this reference is made
a part hereof. A preliminary Draft EIR shall be sub-
mitted for review prior to completion of the Draft EIR
and comments from this review shall be synthesized
into the Draft EIR. A sufficient number of copies of
the Draft EIR shall be provided for circulation to
reviewing agencies.
B. Prepare addendum for the final EIR responding to
questions regarding the report and making comments,
if appropriate, on reviews by other agencies.
C. Attend public hearings when required.
III. Duties of CITY
CITY hereby agrees to supply ENGINEER with the following informa-
tion and materials:
A. Existing plans and mapping of the PROJECT and adjacent
areas.
B. Current traffic studies and traffic counts.
C. Estimates of future traffic volumes.
D. Existing soils investigation reports.
E. Other such data pertinent to the PROJECT.
F. If southbound traffic diversion is required for the
noise assessment, provide the traffic control.
IV. Time of Completion
The preliminary Draft EIR shall be presented to CITY for
review by December 19, 1975. The ENGINEER shall submit the
Draft EIR for review by CITY fourteen days after receipt
of comments and a notice to proceed from CITY. The ENGINEER
shall submit the addendum for the Final EIR fourteen days
after receipt of a notice to proceed from CITY.
V. Ownership of Project Documents
Original drawings, reports, notes, maps and other documents
shall become the property of the CITY and may be reproduced
and utilized as deemed necessary by the Public Works Director.

VI. Engineer in Charge
Lewis Garber, RCE No. 16150, shall be the engineer in charge
of PROJECT design.
VII. Right of Termination
CITY reserves the right to terminate this agreement at any time
by giving ENGINEER three (3) days' prior written notice; notice
shall be deemed served upon deposit in the United States Mail,
postage prepaid, addressed to any of ENGINEER's business offices.
In the event of termination due to fault of ENGINEER, CITY shall

be relieved of any obligation to compensate ENGINEER. If this
agreement is terminated for any reason other than fault of
ENGINEER, CITY agrees to compensate ENGINEER for the actual
services performed up to the effective date of the notice of
termination, on the basis of the fee schedule contained herein.
VIII. Fee Schedule and Payment
In consideration of the performance of the above - described
engineering services, CITY hereby agrees to pay ENGINEER an
amount based upon the hourly rate schedule set forth below.
In no event shall said amount be greater than Eighteen

Thousand Five Hundred Dollars ($18,500.00), except as otherwise
provided herein.
A. Hourly rates for office and field personnel shall be as
follows:
Principal $35.00 /hour
Registered Civil Engineer $25.00 /hour
Computer Analyst $25.00 /hour
Designer /Reasearch Staff $20.00 /hour
Draftsman $16.50 /hour
Keypunch Operator $15.00 /hour
Typist $10.50 /hour
B. The contract amount shall be paid to ENGINEER as follows:
1. Monthly partial payments shall be based on the amount
earned each month, as determined by the fee schedule.
The sum of the monthly partial payments shall not
exceed ninety percent (90 %) of the maximum fee;
2. Balance of the total amount earned to be paid upon com-
pletion of work specified in Section II (Services to be
Performed by ENGINEER), or by July 30, 1976, whichever
occurs first;

3. In addition CITY agrees to reimburse ENGINEER for the
actual cost of reproduction of copies of said plans and
related documents, as well as computer costs, filing
fees, checking fees, cost of aerial photography, materials
cost related to survey work plus ten percent (10 %), and
other related costs authorized in advance by the Public
Works Director and advanced by ENGINEER.
IX. Additional Work
Should ENGINEER complete any additional work not outlined in this
agreement, but authorized by CITY, the extra work shall be performed
on an hourly basis in accordance with the hourly rate standard fee
schedule set forth in.Section VIII (Fee Schedule and Payment) above.
X. PROJECT Scope Revisions
The scope of the PROJECT may be changed and the maximum fee revised
upon prior written approval of the Public Works Director if the
increase in the maximum fee does not exceed One Thousand Five
Hundred Dollars ($1,500.00). If revisions to the scope of the
PROJECT would result in an increase in the maximum fee exceeding
One Thousand Five Hundred Dollars ($1,500.00), an amendment providing
for such revisions shall be processed and executed by the parties
hereto.
IN WITNESS WHEREOF, the parties hereto have executed this agreement on

In response to your invitation we enthusiastically submit our
detailed proposal to assess the environmental impact and pre-
pare an environmental impact report for the widening of
Jamboree Road from Mac Arthur Boulevard to Ford Road.
We understand the project consists generally of widening the
existing 4 -lane highway to 6 -lanes within the present 132 foot
wide right of way and the widening of two existing bridges
across the San Diego Creek. Additionally, the project would
provide for bicycle traffic throughout its length.
Our report will be prepared in conformity with the require-
ments of the City of Newport Beach, the California Environ-
mental Quality Act as well as those of the Regional Coastal
Zone Conservation Commission. Although all aspects of the
project will be thoroughly studied, with special emphasis on
Noise and Water Resources as they appear to be of major con-
cern. At critical stages of the document preparation we will
consult with City Staff.

regarding report and make comments, if appropriate, on
reviews by other agencies.
V. Attend public hearings when required.
In developing the noise exposures contours for the projected
environment on nearby residential locations, we will examine
the possibility of diverting southbound traffic onto the paved
shoulder to simulate future conditions. The value of this
technique will depend on how closely future predicted traffic
conditions can be simulated (volumes, traffic mix, etc.).
From our initial discussions, we feel that sufficient source
data is available to make a valid assessment of the Bioecolog-
ical Resources. If after exhausting this source data further
data contributions are necessary, we will engage a biologist
having substantial familiarity with the local environmental
setting to provide this contribution. Please note that we have
included a qualitative assessment of the air quality. If it is
found that a quantitative analysis is desirable, we will engage
a qualified firm to perform this analysis. The costs for these
additional services are not included in the fee estimate provided.
It is our understanding the City will provide us with the follow-
ing information and materials:
1. Existing plans and mapping of the project and
adjacent areas.
2. Current traffic studies and traffic counts.
3. Estimates of future traffic volumes.
4. Existing soils investigation reports.
5. Other such existing data pertinent to the project.
6. If southbound traffic diversion is required for the
noise assessment, provide the traffic control as per
a plan acceptable to the City.
We are confident that the Preliminary Draft EIR can be completed
in 10 weeks and preparation of the final EIR within two weeks
after receipt of all comments.

We propose that our fee be based on the regular hourly rates
shown below and that our fee will not exceed $18,500. Monthly
payments to be based on actual hours spent by our staff and
those of our subcontractors in the preparation of the report
in accordance with the following schedule:

Reimbursement for necessarily incurred expenses in connection

per mile.
This project will be directed by Mr. Lewis Garber, RCE No. 16150.
Noise assessments will be provided by J. J. Van Houten and
Associates under the direction of Mr. John Van Houten. His
resume along with the firm's experience record is attached.

MENT BETWEEN THE CITY OF NEWPORT BEACH
AND ALDERMAN, SWIFT & LEWIS, IN CONNECTION
WITH ENGINEERING SERVICES FOR THE PREPARA-
TION OF AN ENVIRONMENTAL IMPACT REPORT
(WIDENING OF JAMBOREE ROAD FROM FORD ROAD
TO MACARTHUR BOULEVARD)
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and Alderman, Swift & Lewis, in connection
with engineering services for the preparation of an environ-
mental impact report for the widening of Jamboree Road from
Ford Road to MacArthur Boulevard; and
WHEREAS, the City Council has considered the terms
and conditions of said agreement and found them to be fair and
equitable, and in the best interests of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said agreement above described is
approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of Newport
Beach.
