SUBJECT: ADDITION TO MARINE DEPARTMENT BUILDING (CONTRACT NO. 1760)
RECOMMENDATIONS:
Accept the work.
2. Authorize the City Clerk to file a notice of completion,
and to release the bonds 35 days after the notice of
completion has been filed.
3. Withhold the sum of $863 from the contractor's final
retention until the drapes are installed.
DISCUSSION:
On February 23, 1976 the City Council awarded the contract to
Coy Atkins for the price of $42,000. The contract date of completion was
July 2, 1976. The addition was substantially completed by June 30, 1976.
There has been a delay in obtaining the material for the drapes.
The contractor is confident that the drapes will be installed before the
final retention is due. The price bid for carpets and drapes together
was $863. The contractor has suggested that the City accept the contract,
but withhold a sum of up to $1200 from the final payment until the drapes
are installed. With the exception of the drapes and several minor items
that are being taken care of, the work has been completed to the satis-
faction of the City staff.

ADDITION TO MARINE DEPARTMENT BUILDING (CONTRACT 1760)
RECOMMENDATION:
Adopt a resolution awarding contract No. 1760 to Coy Atkins
for $42,000.00 and authorizing the Mayor and the City Clerk
to execute the contract.
DISCUSSION:
On February 12, 1976 at 10:30 A.M. 5 bids were received and
opened in the office of the City Clerk for the construction of an addition
to the Marine Department building.

The low bid is 3.9% under the architect's estimate of $43,700.
Coy Atkins has recently gone into business after having spent
the previous seven years as building superintendent for three different
building contractors. He is properly licensed, and a check with Mr. Atkins'
references indicate that he is qualified to carry out the work.
The project consists of two parts:
1. 1344 square feet of office space above the existing garage.
2. 90 square feet of additional locker room on the first floor,
and 90 square feet of office space above on the second floor.
The proposal was set up so that all of the work shown in the bid
documents could be done for a lump sum price. The bids were compared based
on the price bid for the complete project. The proposal also contains four
deductive items. Because the bids are within the proposed budget, it is
recommended that these items not be deducted from the contract.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AWARDING A CONTRACT TO
COY ATKINS, FOUNTAIN VALLEY, IN CONNECTION
WITH THE ADDITION TO THE MARINE DEPARTMENT
BUILDING, CONTRACT NO. 1760
WHEREAS, pursuant to the notice inviting bids for
work in connection with the addition to the Marine Department
Building, in accordance with the plans and specifications
heretofore adopted, bids were received on the 12th day of
February, 1976, and publicly opened and declared; and
WHEREAS, it appears that the lowest responsible
bidder therefore is Coy Atkins, Fountain Valley;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that the bid of Coy Atkins,
Fountain Valley, for the work in the amount of $42,000 be
accepted, and that the contract for the described work be
awarded to said bidder;
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are hereby authorized and directed to execute a contract in
accordance with the specifications, bid and this award on behalf
of the City of Newport Beach, and that the City Clerk be directed
to furnish an executed copy to the successful bidder.

Bids must be submitted *dn the proposal form, attached-
with the contract doeomentg'furnished by the.PUblic Works'
Department. The additional. copy of the proposal form is
to be retained by the bidder for his records.
Each bid must be accompanied by cash, certified check
or Bidder's Bond, made payable to the City of Newport
Beach, for an amount equal to at least 10 percent of the
amount bid.
The title. of the project and the words "SEALED BID"
shall be clearly marked on the outside of the envelope
containing the bid.
The contract documents that must be completed, exe-
cuted, and returned in the sealed bid are:
A. Proposal
B. Designation of Subcontractors
C. Bidder's Bond
D. Non - collusion Affidavit
E. Statement of Financial Responsibility
F. Technical Ability and Experience References
These documents shall be affixed with the signature
and titles of the persons signing on behalf of the bidder.
For corporations, the signatures of the PRESIDENT or
VICE PRESIDENT and SECRETARY or ASSISTANT SEC-
RETARY are required and the CORPORATE SEAL shall
be affixed to all documents requiring signatures. In the
case of a Partnership, the signature of at least one general
partner is required.
No bids will be accepted from a contractor who has
not been licensed in accordance with the provisions of
Chapter 9, Division III.of the Business and Professions'
Code. The contractor. shall state his license number and
classification In the proposal.
One set of plans and contract documents, including
special provisions, may be obtained at the Public Works
Department, City Hall, Newport Beach, California, at no
cost to licensed, contractors. It is requested that the plans
and contract,documents be returned within 2-weeks after
bid opening.
The City has adopted the STANDARD SPECIFICATIONS
FOR PUBLIC WORKS CONSTRUCTION (1973 Edition) as
prepared by the Southern California Chapters of the Amer-
ican Public Works Association and the Associated General
Contractors of America. Copies may be obtained from
Building News, Inc., 3055 Overland Avenue, Los Angeles,
California 90034, (213) 870 -9871.
The City has adopted Standard Special Provisions and
Standard Drawings. Copies of these are available at the
Public Works Department at a cost of $5.00 per set'.
A standard "Certificate of Insurance for Contract Work
for City" form has been adopted by the City. This form
is the only certificate of insurance acceptable to the City.
The successful low bidder will be required to complete
this form upon award of the contract. .
For any required bonds, the company issuing Bid Bonds,
Labor and Material Bonds, and Faithful Performance.
Bonds must be an insurance company or surety company
licensed by the State of California. The companies must
also have a current General Policy Holders Rating of
A or better; and a Financial Rating of at least AAA as
per the latest edition of Best's Key Rating Guide (Prop-
erty - Liability).
In accordance with the provisions of Article 2, Chapter 1,
Part 7 of the California Labor Code (Sections 1770 at seq.),
the City Council of the City of Newport Beach has ascer-
tained the general prevailing rate of per diem wages
in the locality in which the work is to be performed for
each craft, classification, or type of workman or mechanic
needed to execute the contract and "has set forth these.
items in Resolution No. 8090, adopted September 10, 1973.
A copy of said resolution is available In the office of the
City Clerk. All parties to the contract shall be governed
by all provisions of the California Labor Code relating
to prevailing wage rates (Sections 1770 -1781 inclusive).
The City reserves the right to reject any or.all.bids
and to waive any informality in such bids.

opened at 10:30 A.M. on February 12, 1976.
DISCUSSION:
On October 28, 1975, the city entered into an agreement with Kermit
Dorius and Associates, Architects, to prepare plans, specifications, and an
estimate for an addition to the Marine Department Building. In the 1975 -76
budget an appropriation of $53,000 has been included to cover the cost of
architectural services and the proposed building contract.
The project consists of two parts:
1. 1344 square feet of office space above the existing garage.
2. 90 square feet of additional locker room on the first floor,
and 90 square feet of office space above on the second floor.
The project estimate is as follows:

It should be pointed out that the beach in front of the existing
Marine Department Building has experienced severe erosion since the construc-
tion of the rock groins in West Newport. In an effort to cope with the problem,
the city has constructed temporary protection for the building, and has re-
quested both the County of Orange and the U.S. Corps of Engineers to investi-
gate long -range protection for the area.

RECOMMENDATION:
Adopt a resolution authorizing the Mayor and the City Clerk to exe-
cute the subject agreement with Kermit Dorius and Associates to
prepare plans and specifications for the subject project.
DISCUSSION:
Included in the 1975 -76 budget is $53,000 for the construction of an
addition to the Marine Department Building at the Newport pier. The project
consists of two parts:
Part 1 - Second -story addition above garages consisting of office,
conference and storage areas.
Part 2 - Locker room extension to first floor with equivalent
space extension on second floor.
A proposal has been received from Kermit Dorius and Associates to
prepare plans and specifications for the proposed new addition. The major
services to be performed by the architect are:
I. Preliminary Design Development Phase
A. Conference with City staff to determine all requirements
and limitations.
B. Refinement of design to satisfaction of all parties.
C. Preparation of preliminary drawings, specifications,
project budget and schedule. This will include outline,
structural, mechanical and electrical design.
II. Final Design and Contrast Documents

of the City of Newport Beach that said agreement above described
is approved, and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of
Newport Beach.

ARCHITECTURAL SERVICES AGREEMENT
(Kermit Dorius & Associates - Addition to Marine Dept. Bldg.)
THIS AGREEMENT is made and entered into this 21 Tjy
day of dr- re e3 ,e pt , 1975 by and between the CITY OF
NEWPORT BEACH, a municipal corporation, hereinafter referred
to as "CITY ", and KERMIT DORIUS & ASSOCIATES, hereinafter
referred to as "ARCHITECT ".

WHEREAS, City
intends
to
construct an addition to
the Marine Dept. Building; and
WHEREAS, Architect has submitted a proposal to
City to perform the architectural services in connection with
the construction of the addition to the Marine Dept. Building;
and
WHEREAS, City desires to accept Architect's proposal,
NOW, THEREFORE, in consideration of the foregoing,
the parties hereto agree as follows:
I. General
A. City engages Architect to perform the
services hereinafter described and agrees to
compensate Architect as herein provided;
B. Architect agrees to perform the subject
architectural services on the terms and conditions
hereinafter set forth.
C. The project shall consist of two parts:
1. Second story addition, above existing
garages, consisting of office, conference and
storage areas; and
2. Locker room extension on first floor
with equivalent space extension on second floor.

II. Services to be performed by Architect.
Architect shall perform services under this
agreement in the following phases. Separate
cost estimates shall be prepared by Architect for
each part of the project.
A. The preliminary design development phase
which shall include the following:
1. Investigation and conferences with
City staff to determine all requirements and
limitations;
2. Refinement of design to the satis-
faction of all parties;
3. Preparation of preliminary drawings,
specifications, project budget and schedule. This
phase will include outline, structural, mechanical
and electrical design;
B. The final design and construction document
phase which shall include the following:
1. Preparation of complete construction
drawings and specifications that will include
architectural, structural, mechanical and electrical
work;
2. Preparation of a final cost estimate
based on projected costs at time of contract award;
3. One set of final drawings on mylar
film, size 22" by 34" and one set of the technical
provisions of the specifications typed on white bond
paper.
4. Response by Architect to request
for information during construction bidding or
negotiation;
C. Construction phase which shall include
the following:

1. Response by Architect to requests
for information during construction;
2. On -site inspections from time -to -time
as construction proceeds.
III. Services to be performed by City
A. Obtaining a permit for the project from
the California Coastal Zone Conservation Commission;
B. Timely review and approval of work sub-
mitted by Architect.
C. Preparation of legal responsibilities
section specifications;
D. Reproducing and assembling contract
documents;
E. Construction bidding, negotiation and
contract award;
F. Construction supervision;
G. Selection of carpets, draperies and
movable furnishings;
H. Pay building pennit fees, if any.
IV. Ownershio of Proiect Documents
Original drawings, reports, maps, notes and
other documents shall become the property of the
City and may be reproduced and utilized as deemed
necessary by the Director of Public Works.
V. Right of Termination
City reserves the right to terminate this
agreement at any time by giving Architect three (3)
days' prior written notice. Notice shall be deemed
served upon deposit in United States Mail, postage
prepaid, addressed to any of Architect's offices.
In the event of termination due to the fault of
Architect, City shall be relieved of any obligation
to compensate Architect. If this Agreement is

terminated for any reason other than fault of
Architect, City agrees to compensate Architect
for the actual services performed up to the
effective date of the notice of termination,
on the basis of the fee schedule contained herein.
VI. Completion of Final Design
All plans and other documents for the
project shall be submitted to the Public Works
Director of City for final approval.
VII. Fee Schedule and Payment
A. in consideration of the performance
of the above described architectural services,
City hereby agrees to pay Architect the following
amounts for each of the separate phases under this
agreement. in no event shall said amount be
greater than Seven Thousand Six Hundred Twenty
Dollars ($7,620);
1. The maximum amount to be paid during
the preliminary design development phase is One
Thousand One Hundred Twenty Dollars ($1,120);
2. The maximum amount to be paid during
the final design and construction documents phase
and construction bidding or negotiation phase shall
be Six Thousand Dollars ($6,000).
3. The maximum amount to be paid during
the construction phase shall be Five Hundred Dollars
($500). In the event a construction contract is not
awarded this fee will not be paid to Architect..
B. The contract amount shall be paid to
Architect as follows: Monthly partial payments
shall be based on the amount earned each month as
determined by the fee schedule attached hereto and
incorporated herein by this reference and marked
Exhibit "A ", and it is agreed that City may elect

not to proceed with construction of Part 2 of
the construction, and that said maximum fees
may not be earned by Architect.
VIII. Hold Harmless
Architect shall indemnify and hold harmless
City, its officers, employees and agents from any
damage or liability arising from any errors,
omissions, negligence or other wrongful acts per-
formed by Architect in performance of this
agreement.
IN WITNESS WHEREOF, the parties hereto have
executed this agreement as of the date and year first above
written.
