Attached are the original and one copy of the executed
agreement between the City of Newport Beach and the
Newport -Mesa Unified School District in connection with
the cos•ualty recreation programs.
This agreement was authorised by the City Council on
October 14, 1976 by the adoption of Resolution No.
8609.

THIS AGREEMENT made and entered into this 73th day
o: January 1976, by and between the CITY OF NEi,IPORT BEECH,
a chartered municipal corporation, hereinafter called "City ",
and the NEtv'PORT -MESA UNIFIED SCHOOL DISTRICT, hereinafter called
"District ";
W I T N E S S E T H:
WHEREAS, Sections 16651- 16664, Chapter 6 of Division 12,
of the California Education Code authorize school districts to
cooperate with other recreation agencies having public authority
in the development and execution of community recreation programs;
and
WHEREAS, City and District desire to establish a basis
for the cooperative use of swim facilities and professional staff
at the Newport Harbor High School pool for the purpose of develop-
ing a swim program for the identified District's schools;
NOW, THEREFORE, IT IS AGREED that cooperative use shall
be made according to the following:
1. City will provide swim instruction for boys and
girls in Grade 4 at Corona del liar, Harbor View, Harper, Mariners,
Nes:-port, Newport Heights, and Whittier Schools on a one to fifteen
instructor - student ratio.
2. City will provide certified swim instructors at all
times.
3. Each class (room) will be given ten (10) thirty
(30) minute instruction units in the fundamentals of swimming and /or
lifesaving techniques.
4. Locker space and shower and dressing facilities for
uil students will be provided at the Newport Harbor High School

6. The District schools will ensure that at least
one teacher accompany each class (room) for purpose of supervision
on1y. Teach -ors will not be called upon to instruct.
7. Tile District will provide transportation between
schools and the pool..
8. The program will be conducted during the months of
April, may, and June, 1976.
9. District will be financially responsible to City
for all mutually accepted dates, with the exception of days when
weather conditions prevent attendance as determined by the build-
ing principal.
10. District will reimburse City at the rate of Five
Dollars ($5.00) per child per ten (10) lesson session as listed
on District -City of Newport Beach Swim Program Enrollment Reports_
11. Each agency will indemnify and hold one another harm-
less from any and all suits arising from or out of the performance
of the terms of this Agreement.
This Agreement shall terminate on June 30, 1976, unless
terminated earlier with or without cause by either party upon
thirty (30) days' prior written notice.
IN WITNESS WHEREOF, the District and the City have
caused this Agreement to be executed pursuant to authorization
given by their respective governing bodies.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AGREE-
MENT BETWEEN THE CITY OF NEWPORT BEACH
AND THE NEWPORT -MESA UNIFIED SCHOOL
DISTRICT (COMMUNITY SWIM PROGRAM)
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain agreement between the
City of Newport Beach and the Newport -Mesa Unified School District
in connection with the development of a community swim program; and
WHEREAS, the City Council has considered the terms and
conditions of said agreement and found them to be fair and equit-
able, and in the best interests of the City;

NOW, THEREFORE, BE IT RESOLVED by the City Council of

the City of Newport Beach that said agreement above described is

approved, and the Mayor and City Clerk are hereby authorized and
directed to execute the same on behalf of the City of Newport Beach.
